GOP lawmakers direct Legislative Reference Bureau not to publish Evers’ rules

The Joint Committee on Legislative Organization voted by paper ballot along party lines Friday afternoon to direct the Legislative Reference Bureau not to publish any rule that hasn’t gone through a review by the Legislature in accordance with Wisconsin law.

Republican lawmakers on the committee proposed a vote on the motion Thursday after Gov. Tony Evers told agencies to skip lawmakers in the final steps of the rulemaking process. There are 27 administrative rules, including one to address the state’s policy on gray wolf management, that Evers submitted to the LRB for publication. Of those, 13 have not been reviewed by a standing legislative committee and are yet to be published. 

It’s the latest step the administration has taken in testing the bounds of the recent Evers v. Marklein II ruling by the Wisconsin Supreme Court. The majority found in the case that the state laws giving the Joint Committee for Review of Administrative Rules broad powers to block administrative rules indefinitely were unconstitutional.

The statutes cited in the Republicans’ motion Thursday were not included in the Court’s ruling.

“We are following the law and maintaining the fundamental checks and balances of lawmaking,” Assembly Speaker Robin Vos (R-Rochester) and Senate President Mary Felzkowski (R-Irma) said in a joint statement about the motion on Thursday. “The governor is flagrantly disregarding the rule of law and egregiously abusing the power of his office.”

Evers’ spokesperson Britt Cudaback said Republicans were defying the law in an email Thursday. 

“Republicans are reaching new levels of lawlessness, whether it’s President Trump trying to take over Washington DC, Republicans in Texas trying to rig maps and elections in their favor, or Republicans in Wisconsin who appear poised to disobey decisions made by our state’s highest court,” Cudaback wrote in an email message. “Republicans are not above the law — they should follow the law like everyone else is expected to.”

The measure passed 6-4. Republicans on the committee, including Vos, Felzkowski, Senate Majority Leader Devin LeMahieu (R-Oostburg), Sen. Dan Feyen (R-Fond du Lac), Rep. Tyler August (R-Walworth) and Rep. Scott Krug (R-Rome), voted for the motion. Democrats on the committee, including Assembly Minority Leader Greta Neubauer (D-Racine) and Senate Minority Leader Dianne Hesselbein (D-Middleton), voted against it.

Fight over rulemaking power escalates after Evers bypasses Legislature

Republican leaders of the Legislature moved Thursday to block the Evers administration from bypassing legislative committees in implementing administrative rules.

Republican leaders of the Joint Committee on Legislative Organization (JCLO), with members from both the Assembly and the Senate, sent committee members a motion Thursday instructing the Legislative Reference Bureau not to finalize or publish any rules unless they have gone through a review by the Legislature in accordance with Wisconsin law.

The motion came two days after a published report that Gov. Tony Evers  instructed cabinet heads to skip the Legislature in the final steps of the rulemaking process.

It is the latest development in an ongoing feud between the Democratic governor and Republican leaders in the Legislature over the power of the executive branch to write rules in order to carry out state laws.

In a memo Aug. 12, Evers told department secretaries, “There no longer remains any statutory requirement to wait for legislative committee review before promulgating a rule once I have approved it.”

The governor’s memo cited the July 8 Wisconsin Supreme Court ruling in the case Evers v. Marklein that curtailed the power of the Joint Committee for the Review of Administrative Rules (JCRAR) to block executive branch rulemaking.

In the 4-3 decision, which has become known as Evers v. Marklein II, the Court majority ruled that state laws giving JCRAR broad powers to block administrative rules indefinitely were unconstitutional.

“This is good and important news as it means we can — and must — continue the people’s work in earnest,” Evers wrote in the memo, first reported by WisPolitics.com. “Accordingly, I am directing agencies to submit rules that have made it through that relevant part of the process to the Legislative Reference Bureau for finalization and publication.”

The motion distributed to JCLO members Thursday takes direct aim at the assertion in Evers’ memo.

The motion states that “the Legislative Reference Bureau (LRB) shall neither finalize nor publish any rules or proposed rules that failed to comply with the standing committee statutory requirements of s. 227.19 (2) to (4), Stats., including rules or proposed rules that have already been submitted to the LRB.”

Those statutes require that when administrative rules are in final draft form, the Legislature must be notified, a detailed report on the rule must be submitted, and the rule must be reviewed by a standing committee of the Legislature.

There are 27 administrative rules submitted to the Legislative Reference Bureau currently awaiting publication in the Administrative Register.

The bureau director, Rick Champagne, told the Wisconsin Examiner on Thursday that 13 of those rules have not yet completed standing committee review. Those have been classified as not to be published.

Evers v. Marklein II did not address the constitutionality of standing committee review of proposed administrative rules,” Champagne wrote in an email message.

Among the rules held up pending review are one addressing the state’s policy on gray wolf management and one on surface water degradation. 

The remaining 14 rules have completed the standing committee review and are before the Joint Committee for the Review of Administrative Rules or have completed that process, according to Champagne.  

“I believe these are ready for publication under Evers v. Marklein II,” Champagne told the Examiner.

“JCLO has the authority to direct the manner in which the LRB will carry out its statutory duties,” Champagne added.  “The Wisconsin Supreme Court, in Evers v. Marklein II, did not eliminate standing committee review of proposed administrative rules.  If JCLO so directs, the LRB will not finalize or publish any proposed administrative rules that have not completed standing committee review.”

The paper ballot votes on the motion are due Friday and results are expected to be posted by the end of the day. The motion is expected to pass given the committee’s GOP majority.

The committee’s Republican co-chairs, Assembly Speaker Robin Vos and Senate President Mary Felzkowski, issued a press release Thursday calling Evers’ action to sidestep submitting rules to the Legislature for committee review a “direct contradiction” of the Court’s ruling.

“In Evers v. Marklein, the Wisconsin Supreme Court clearly stated that the Legislature ‘alone maintains the ability to amend, expand, or limit the breadth of administrative rulemaking in other branches” of government, the press release said. “Governor Tony Evers is attempting to circumvent statutory requirements that are part of the rule-making process and that no court has held to be invalid in any respect.”

“We are following the law and maintaining the fundamental checks and balances of lawmaking,” Vos and Felzkowski said in a joint statement. “The governor is flagrantly disregarding the rule of law and egregiously abusing the power of his office.”

Evers’ communications director, Britt Cudaback, countered with a charge that the Republican lawmakers were defying the law. 

“Republicans are reaching new levels of lawlessness, whether it’s President Trump trying to take over Washington DC, Republicans in Texas trying to rig maps and elections in their favor, or Republicans in Wisconsin who appear poised to disobey decisions made by our state’s highest court,” Cudaback wrote in an email message. “Republicans are not above the law — they should follow the law like everyone else is expected to.”

Budget deal’s $15 million in earmarks for Robin Vos’ district highlight politicization of Wisconsin’s conservation funding

Wisconsin’s recently passed budget doesn’t include the extension of a popular land conservation program, but it does include two earmarks for environmental projects in the home district of the state’s most powerful Assembly Republican.

After Republican legislators declined to reauthorize the Knowles-Nelson Stewardship Fund in the state budget, Democratic Gov. Tony Evers vetoed five natural resources projects, criticizing the Legislature for choosing “to benefit the politically connected few” instead of supporting stewardship through the statewide fund. 

“I am vetoing this section because I object to providing an earmark for a natural resources project when the Legislature has abandoned its responsibility to reauthorize and ensure the continuation of the immensely popular Warren Knowles-Gaylord Nelson Stewardship program,” Evers wrote in his veto message.

However, Evers didn’t veto other natural resources projects, including two totaling $15 million in Assembly Speaker Robin Vos’ district in southeastern Wisconsin west of Racine. Asked why Evers spared those projects, his spokesperson Britt Cudaback referred Wisconsin Watch, without specifics, to the agreement between Evers and legislative leadership that cemented the $111 billion two-year budget. 

Local environmental earmarks in the state budget are nothing new, but the latest examples highlight how such projects can take on greater political dimension when not overseen by civil servants at the DNR and the Legislature’s budget committee, as has been the process for more than 30 years since the creation of the Knowles-Nelson fund. Legislators have allowed the program to inch closer to expiration while attempting to secure stewardship programs in their own districts.

The Knowles-Nelson Stewardship Fund supports land conservation and outdoor recreation through grants to local governments and nonprofits and also allows the Wisconsin Department of Natural Resources to purchase and maintain state land. The program is currently funded at $33 million a year until the end of June 2026.

Local governments and nonprofit organizations can apply for Knowles-Nelson grants during three deadlines every year, and DNR staff evaluate and rank projects based on objective criteria including local public support, potential conservation benefits and proximity to population centers. 

Despite not authorizing the fund through the state budget, Rep. Tony Kurtz, R-Wonewoc, and Sen. Patrick Testin, R-Stevens Point, committed to reauthorizing the fund and introduced stand-alone legislation in June to reauthorize the stewardship fund at $28.25 million per year for the next four years.

Burlington receives $15 million for two natural resources projects

The two projects in Vos’ district received a total of $15 million in state taxpayer dollars from the general fund and were the only natural resources earmarks mentioned in the state budget agreement between Republicans and Evers.

The only larger natural resources earmark — a $42 million grant for a dam in Rothschild — was added by the Joint Finance Committee and included in the final state budget, though it wasn’t mentioned in the agreement. That grant isn’t funded with general fund revenue, but rather a separate forestry account, which includes revenues from the sale of timber on public lands.

In a statement on the inclusion of funding for the projects, Vos, R-Rochester, touted how $10 million for the Echo Lake Dam will save Burlington residents an average of $3,000 in taxes that would otherwise fund the project. Upgrades to Echo Lake will cost as much as $12 million including $3.5 million for dam modifications and up to $5 million for lake dredging. 

For years, city officials in Burlington have grappled with how to address the Echo Lake Dam. In 2022, the Burlington City Council considered removing the 200-year-old dam but ultimately voted to keep it after residents expressed support though an advisory referendum. The dam needs upgrades because it doesn’t meet DNR requirements to contain a 500-year flood.

The Browns Lake Sanitary District also received $5 million for the removal of sediment in Browns Lake. Local residents have raised concerns over sedimentation in the lake, affecting the lake’s usability for recreation and ecological balance. 

In a website devoted to the Browns Lake dredging, Claude Lois, president of the Browns Lake Sanitary District, thanked Vos for including $5 million for the project and advised residents: “If you see Robin Vos, please thank him.”

DNR spokesperson Andrea Sedlacek directed Wisconsin Watch to Evers’ spokesperson, declining to answer questions on whether the two projects in Vos’ district could have been covered by Knowles-Nelson funds. The Echo Lake Dam project tentatively received a grant for over $700,000 from the Knowles-Nelson Stewardship Fund last fall for development of gathering spaces adjacent to the lake. 

Vos did not respond to a request for comment. 

Other conservation projects were vetoed by Evers, including a $70,000 dredging project on a section of the Manitowoc River in the town of Brillion. Ultimately, the DNR and the Evers administration provided funding for the project after Sen. Andre Jacque, R-New Franken, and local farmers criticized the veto, claiming that they were at risk of flooding without funds for the dredging project. 

Rep. Rob Swearingen, R-Rhinelander, said he was surprised and disappointed with Evers’ veto of the Deerskin River dredging project in his district. He called Evers’ reasoning a “lame excuse, using the Knowles-Nelson program as political cover” in an email statement to Wisconsin Watch. Swearingen said he and Senate President Mary Felzkowski, R-Tomahawk, were considering alternative funding sources, including introducing stand-alone legislation to finance the dredging project.

Swearingen declined to say what he thought about the projects in Vos’ district getting funded. Other Republican lawmakers with vetoed projects in their districts didn’t respond to a request for comment.

Rep. Deb Andraca, D-Whitefish Bay, a member of the budget-writing Joint Finance Committee, told Wisconsin Watch she supports Evers’ vetoes because the earmarked projects did not go through the process the DNR uses to evaluate the benefits of particular projects.

Andraca said while several earmarked projects were likely strong contenders for Knowles-Nelson, without the DNR’s process of evaluating project merit, the most beneficial projects may not receive funding.

“We need to make sure that we’re taking into account that the best, most important projects are being funded, not just the projects that are in someone’s (district) who might have a little bit more sway in the Legislature,” Andraca said.

Paul Heinen, policy director for environmental advocacy organization Green Fire, lobbied for the first stewardship fund in 1989. Heinen said legislators have pushed for stewardship projects in their districts through the state budget process for as long as the stewardship fund has existed.

“The DNR has a process by which they go through to analyze projects, and that’s all set up in the code and everything,” Heinen said. “But of course, just like Robin Vos and any other legislator, if they can get something in the budget, it’s faster and you don’t have to go through the steps in order to get something done.”

In the 2023-25 budget cycle, the largest natural resources earmark was $2 million for dredging Lake Mallalieu near River Falls. 

Heinen said legislators are faced with a conundrum — they claim to oppose statewide government spending on stewardship, but want projects in their own districts. 

“Publicly, they say they’re opposed to government spending in this boondoggle stewardship fund,” Heinen said. “But then when it gets down to something in their district, they are at the ribbon cutting.” 

State Supreme Court decision complicates reauthorization

For years the JFC halted Knowles-Nelson conservation projects by not taking a vote on them, something critics referred to as a “pocket veto.” The Evers administration sued over the practice, and in July 2024 the Wisconsin Supreme Court ruled 6-1 the Legislature’s pocket veto was unconstitutional.

“What the court said was that the finance committee by going back after the fact and blocking an appropriation that had already been approved by the entire Legislature, and that was an unconstitutional infringement on executive authority,” said Charles Carlin, director of strategic initiatives for Gathering Waters, an alliance of land trusts in the state.

Republicans have said trust issues with both the DNR and the Evers administration prevented them from releasing Knowles-Nelson funds without more control.

Kurtz and Testin’s proposed bill also includes new requirements for legislative approval for larger projects over $1 million in an effort to allow legislative oversight without the pocket vetoes.

The bill’s funding level is below the $100 million per year for 10 years that Evers proposed in his budget, but close to current funding levels of $33 million per year. 

In 2021, the fund was reauthorized with $33.2 million per year for four years. In 2019, the fund was reauthorized for only two years, breaking a cycle of reauthorization in 10-year increments.

A poll of 516 Wisconsin voters commissioned by environmental advocacy organization The Nature Conservancy found 83% supported Evers’ proposal, with 93% of voters supporting continued public funding for conservation. However, most respondents were unaware of the Knowles-Nelson Stewardship Fund.

Funding for Knowles-Nelson peaked in 2011 and was reauthorized under both Republican and Democratic administrations. Former Republican Gov. Tommy Thompson was the first governor to approve funding for the stewardship fund in 1989.

“There was a lot of talk initially from mostly Republican legislators who were skeptical of the governor’s proposal,” Carlin said. “But it’s really only a huge amount of money in comparison to how the program had kind of been whittled down through the years.”

In a January interview with the Cap Times, Vos said the chances of Republicans reauthorizing the fund were less than half. 

Andraca said she hears more from constituents about the Knowles-Nelson Stewardship Fund than almost any other program.

“I seriously hope that my Republican colleagues are serious about passing something because it would be a real tragedy to lose something like this that has bipartisan support and has been so instrumental in preserving Wisconsin’s natural areas,” Andraca said.

‘Totally uncharted territory’ for stewardship funding

Carlin said the failure to reauthorize Knowles-Nelson puts land stewardship organizations and local municipalities — the typical recipients of Knowles-Nelson grants — in “totally uncharted territory.” 

Although Knowles-Nelson funding is set to expire at the end of next June, Carlin said local governments and land trusts face uncertainty in planning because they aren’t sure the Legislature will get the new reauthorization bill done.

“Similar to what you’re probably hearing from folks about federal budget cuts … this just totally scrambles the planning horizon,” Carlin said.

Heinen, however, is more optimistic the Legislature will vote to reauthorize Knowles-Nelson. 

“90-plus percent of the people in the state of Wisconsin want the stewardship fund,” Heinen said. “Legislators know that. They’re not going to go running for reelection in November of next year and have their opponents say, ‘Why are you against the stewardship fund?’ So I’m really not worried about it at all.”

Federal funding cut endangers Wisconsin unemployment system update

In the early days of the COVID-19 pandemic, when many businesses closed or laid off workers, a massive influx of 8.8 million unemployment claims overwhelmed Wisconsin’s aging unemployment insurance system. 

That created a backlog of hundreds of thousands of claims. Many potential applicants weren’t able to connect to the department’s call center to complete the process, and some Wisconsinites waited months without receiving a single unemployment payment. 

Following those backlogs, the state has made strides to update the system and move away from outdated, decades-old computer systems, said state Department of Workforce Development Secretary Amy Pechacek. 

She said DWD now has a digital portal for people to file unemployment claims and send documents online. The department also uses online chatbots to respond to questions in multiple languages, as well as uses artificial intelligence tools to assist with data entry.

“With these enhancements, the department is now paying 88% of all claims filed within three days or less,” Pechacek said. “That other 12% of claims that go a little bit longer are typically just because we have to do investigations if there’s some discrepancies between what the claimant and the employer are saying.”

In a letter to the Trump administration on Tuesday, Gov. Tony Evers said the administration is blocking nearly $30 million in federal funding to Wisconsin, which could prevent the state from finishing the project and potentially leave it vulnerable to cyberattacks and fraud.

“If the Trump Administration does not reverse course and provide the $29 million Wisconsin expected to receive, the state will not be able to complete its UI system modernization project,” Evers wrote to U.S. Labor Secretary Lori Chavez-DeRemer.

That funding was part of the American Rescue Plan Act, a pandemic recovery law signed by former President Joe Biden, and was being primarily used on anti-fraud measures, according to the governor’s office. Evers’ letter says the U.S. Labor Department “suddenly terminated” the funding in late May. 

The termination halted work on identity authentication tools, a digital employer portal, artificial intelligence enhancements, fraud prevention and cybersecurity tools, according to Pechacek. She said the employer portal was the DWD’s next major rollout and would have made it easier for employers to provide information to the state.

“The employer portal is really one of the largest losses from this federal action,” Pechacek said. “Our employers … have to submit quarterly wage information (and) verify claim information, and some of those components are still very antiquated.”

Evers wrote that the Department of Labor “cited no objections” to those initiatives beyond “an unsupported assertion that they ‘no longer effectuate the Department’s priorities.’”

Pechacek said the state has already spent “slightly over half” of the $29 million. She said those grants were “reimbursement-based,” meaning the state first had to spend the money and then be paid back by the federal government.

“There are seven projects that have now been paused in a variety of different states of completion, so those are sunk costs,” she said. “Without realizing the full modernization effort, we can’t roll those projects out.”

The state appealed the Labor Department’s termination and received a letter from the federal government in late July that “acknowledged the appeal while restating the Department’s earlier basis for termination,” the governor’s letter states.

“The people of Wisconsin deserve systems that function, state of the art, with high integrity and accuracy,” Pechacek said. “We are also going to pursue litigation to reclaim the funds which were rightfully awarded to us already and improperly rescinded.”

In addition to the $29 million in lost funding, the project was using $80 million from a different program under the American Rescue Plan Act, according to a report sent to the Legislature’s budget committee. The document states that the $80 million has not been impacted but is “insufficient to support the full modernization work.”

Pechacek said DWD has also asked the state Legislature to allocate additional state funds toward finishing the effort but said there hasn’t been much movement on that front.

Wisconsin isn’t the only state that’s had federal funding to upgrade unemployment systems clawed back by the Trump administration. In May, Axios reported the White House terminated $400 million of that funding across the country. A July report from state agencies said $675 million in grants awarded to unemployment programs in over 30 states and territories had been terminated.

The U.S. Department of Labor did not immediately respond to WPR’s request for comment. In May, the federal agency told Axios in a statement that the unemployment modernization funding was “squandered” on “bureaucratic and wasteful projects that focused on equitable access rather than advancing access for all Americans in need.”

In the letter, Evers also said failing to complete Wisconsin’s modernization effort would put the state’s unemployment system at risk of becoming overwhelmed again during any future economic downturn. He says that would “create acute hardship for Wisconsin families.”

“It is our obligation to prevent this scenario from coming to pass,” Evers wrote. “I urge you to reverse the decision to defund these critical government efficiency and fraud prevention initiatives.”

Pechacek said the state isn’t reverting back to old technology in the pieces of the modernization that have already been completed in “major areas.” But she said failing to fully finish the effort poses a risk to Wisconsinites because there are still aspects of the system running on an outdated coding language.

“Any time we don’t fully invest in upgrading and reach the programmatic goals that we have set to get fully off of the antiquated systems, we are at risk to be overwhelmed again,” she said. “All of that leads us to be more vulnerable, in a time of significant increase of accessing the system, to the cyber attacks, to fraudulent efforts, to being compromised.”

Gov. Tony Evers is implementing pay raises for state employees without additional approval from the Legislature’s Joint Committee for Employment Relations, citing a recent state Supreme Court ruling.

The state budget, which was passed by the Republican-led Legislature and signed by Evers last month, included about $385 million to provide state and University of Wisconsin employees with a 3% pay increase in the first year of the budget and a 2% increase in the second year.

“I fought hard in our bipartisan budget negotiations to secure much deserved pay increases for our talented state workers,” Evers wrote in a letter to state employees on Monday, adding that he was proud to sign the budget last month and it was important to him that state workers receive the wage adjustment as soon as possible.

Eligible employees will receive the 3% base pay adjustment to their current pay rate with their Sept. 4 paychecks, including a lump sum back pay from June 29. The second year of raises is supposed to be implemented June 28, 2026.

“The work that we do together every day on behalf of the people of Wisconsin is so important — perhaps never more so than it is today,” Evers wrote. “With Washington creating continued uncertainty through devastating cuts to investments and programs that so many across our state rely on, Wisconsinites will continue looking to us to lead, support them and build upon the work we’ve done together over the last six years. There is, as always, much hard work ahead of us. Having committed and exceptional partners like you in this good work will make all the difference.” 

The Joint Committee on Employment Relations has been tasked by state law with holding hearings on changes to state employee compensation and approving those changes. Assembly Speaker Robin Vos (R-Rochester) and Senate President Mary Felzkowski (R-Tomahawk) and Co-chairs of the Joint Committee of Employment Relations have not responded to requests for comment on Evers’ announcement. 

In a bulletin about the raises, the Department of Administration cited the recent Wisconsin Supreme Court ruling in the case Tony Evers v. Howard Marklein, which addressed the Knowles-Nelson Stewardship Program and the ability of the Joint Finance Committee to hold up already appropriated funds. The Evers administration asserted that the decision clarified its authority to implement the raises without the additional approval of the committee.

The Court ruled 6-1 in July 2024 that the ability for the committee to withhold funds was unconstitutional and a violation of the separation of powers. 

Justice Rebecca Bradley wrote for the majority that a statute that authorizes lawmakers to “exercise core powers of the executive branch violates the constitutional separation of powers and cannot be enforced under any circumstances.” 

“While the constitution gives the legislature the power to appropriate funds, the power to spend the funds the legislature has appropriated for a specific project belongs to the executive branch,” Bradley wrote. “While the legislature has the power to create an agency, define its powers, and appropriate funds to fulfill the purpose for which the legislature established it, the power to spend appropriated funds in accordance with the law enacted by the legislature lies solely within the core power of the executive to ensure the laws are faithfully executed. We conclude these statutes interfere with the executive branch’s core function to carry out the law by permitting a legislative committee, rather than an executive branch agency, to make spending decisions for which the legislature has already appropriated funds and defined the parameters by which those funds may be spent.”

The original lawsuit filed by Evers in October 2023 included the Knowles-Nelson program and two other issues: JOCER’s ability to withhold raises approved in the budget and the Joint Committee for Review of Administrative Rules’s block on administrative rules related to conversion therapy. At the time, JOCER was withholding pay raises approved in the budget for University of Wisconsin employees, so the raises could be used as a bargaining chip in Republican lawmakers’ efforts to eliminate diversity, equity and inclusion efforts in the system. The pay raises, approved in the budget in July, were released by JOCER in December 2023

The majority decided in February 2024 that it would only take up the Knowles-Nelson issue and leave the other two “held in abeyance pending further order of the court.” Conservative justices were critical of the majority allowing original action in the case and separating the issues from each other at the time.

Justice Annette Zeigler wrote in her dissenting opinion in the case that taking all of the issues at once could have produced consistency. 

“Selecting an issue that only impacts the Republican-controlled legislature and the longstanding Knowles-Nelson Stewardship Program should raise eyebrows,” Zeigler wrote. “Determining all issues at the same time could serve to hold my colleagues to application of the same principles in the same way, even when it comes to a Democratic-controlled branch of government. Unfortunately, we will wait to see if that consistency will be forthcoming, as the majority handpicked and now limits only the legislative branch’s longstanding, statutorily authorized practice.”

The Court dismissed the compensation and Joint Committee on Employment Relations issue in October 2024 when it decided to take up the conversion therapy and Joint Committee for Review of Administrative Rules issue. The Court issued a ruling in July limiting the committee’s ability to block administrative rules.

The University of Wisconsin system will also be implementing the general wage raises. 

“We are grateful to Governor Tony Evers and the Wisconsin State Legislature for their continued support of our workforce and recognition of the vital role our faculty and staff play in education, research, and public service,” UW President Jay Rothman wrote in a memo to employees on Monday. 

The implementation of the raises is not the first time the administration has moved ahead with releasing funds following the ruling. The administration announced funding for 12 Department of Natural Resources projects under the Knowles-Nelson Stewardship Program in October of 2024.

Wisconsin’s surplus is waning. Next budget will mean ‘coming back to Earth.’

Wisconsin could be facing a more difficult budget than it has seen in recent years with recently approved spending and tax cuts consuming most of the state’s historic surplus, according to the nonpartisan Wisconsin Policy Forum.

The research organization described the state’s most recent budget as an “all of the above” plan in its recent report. Mark Sommerhauser, communications director and policy researcher at the Wisconsin Policy Forum, said the previous budgets showed more restraint from policymakers when it came to spending and tax cuts. 

“There were some tax cuts, there were some spending increases, but certainly not of the magnitude that could have occurred,” Sommerhauser told the Wisconsin Examiner in an interview. “In this budget, we saw a lot more of both.”

Sommerhauser said it was “clearly a budget that was much more focused on the here and now than on where the state’s finances would be in two or four years.”

“There’s an argument that ‘hey, this money should be returned, either back to taxpayers or spent on programs that benefit our state’s residents, rather than just sitting in the general fund,” Sommerhauser added. “That’s what policymakers opted to do with this budget.”

The $111 billion state budget passed by the state Legislature and signed into law by Gov. Tony Evers in early July increased spending by 7.7% — an increase of $3.3 billion — allocating $46 billion to fund a number of priorities.

The budget also included more than $1 billion in tax cuts over the next two years. 

One major cut comes from a change to Wisconsin’s income tax brackets. The new budget expands the state’s second tax bracket, with a 4.4% tax rate, and shrinks the third bracket, which has a 5.3% rate. Wisconsin residents on average will see a $188 cut per filer — affecting more than 1.5 million tax returns. Sommerhauser described the change as a “modest but still notable income tax cut for almost everybody that has some degree of income tax liability, except those folks that have very, very little.” The change will cost the state about $320 million in each year of the budget.

The second major cut created an exemption from income taxes for the first $24,000 for single filers over 67 and $48,000 in retirement income for married filers over 67.

The new state spending in the budget covers an array of priorities including over $500 million for special education, over $80 million in state general purpose revenue for the University of Wisconsin system, over $380 million for wage increases for state employees and additional funding for child care.

Most Republican lawmakers voted for the budget apart from four Senate Republicans and one GOP Assembly member, celebrating the tax cuts as well as some of the investments in the budget and hailing it as a compromise. Most Democrats voted against the final proposal, saying it inadequately invested in education, child care and other priorities, though five Senate and seven Assembly Democrats joined Republicans in support.

With this budget, the state has now used most of the surplus that has formed the backdrop for the last few budgets. The surplus, Sommerhauser said, was mostly the result of federal pandemic aid and was also created in part by an increase in tax revenue, especially through the sales tax, as a result of inflation. At one point the surplus had grown to over $6 billion. 

“[A large surplus is] not business as usual in Wisconsin,” Sommerhauser said. “More often you see the opposite. You see shortfalls that lawmakers are having to scramble to figure out a way to bridge.”

Sommerhauser said that with the smaller reserves, the next budget is likely “going to be kind of coming back to Earth.”

By July 1 2027, Wisconsin’s general fund balance is projected to be $770.5 million — a drop of about $3.6 billion and the lowest balance since 2018. The state will also have $2.1 billion in its rainy day fund.

This leaves Wisconsin with a projected $2.8 billion in its reserves — about 11% of Wisconsin’s net general fund appropriations in fiscal year 2027, Sommerhauser said.

“That’s certainly not disastrous. It’s not cataclysmic at all. It is more than the state has had in reserve for many years prior to the pandemic,” Sommerhauser said. “Of course, it’s a lot less than the last couple of budgets here.”

Wisconsin isn’t the only state to be on this trajectory. At its annual summit in early August, the National Conference of State Legislatures (NCSL) gave an overview of state budgets and asked whether it is time for states to “tighten the belt.”

Erica MacKellar, program principal of NCSL’s Fiscal Affairs Program, said during the presentation that, overall, states ended fiscal year 2025 in a “fairly strong position.” Looking back to the pandemic, she said state revenues didn’t take as big a hit as they were initially expecting. 

“As states recovered, they unexpectedly saw these big revenue surpluses, and that was due to a number of factors, including the large amount of aid that the federal government sent to states,” MacKeller said. “Revenue growth jumped to around 15%, but states always knew that that level of growth was really unsustainable, and have been really planning for a return to normal of state revenue growth and a revenue slowdown that I think we’re seeing now.” 

MacKeller said that prior to the pandemic, state year-end balances as a percentage of state spending were about 10% on average — an increase from the low of about 4% during the Great Recession.

“In fiscal year 2023, after we saw those record surpluses, that percentage soared to over 30%, and now that number has started to come back down,” MacKeller said. “The preliminary average from our survey shows about 16[%] for fiscal year 2025, so that’s putting most states on pretty firm footing at this point.” 

Sommerhauser said the bigger issue now is that Wisconsin is spending more than it brings in through taxes — creating a projected structural deficit. He said it’s something policymakers will have to grapple with in the coming years.

Under the new budget, the state’s general fund will spend about $24.4 billion and bring in $23.1 billion in tax revenues in 2027. The projected gap “would be one of the largest of the past generation,” according to the Wisconsin Policy Forum.

The state could use the reserves for the additional spending, but it wouldn’t be a long-term solution, Sommerhauser said. 

“The state can do that on a one-time basis if it’s got a bunch of money in the bank, which it does right now,” Sommerhauser said. “The issue with that is that you can only spend that money in the bank one time.”

If spending and revenue remain the same, Wisconsin would have an imbalance of -$727 million and an imbalance of -$1.4 billion by the end of 2028-29, according to the Legislative Fiscal Bureau. 

Sommerhauser noted that unlike the federal government, Wisconsin can’t run a huge deficit year after year. The state constitution requires lawmakers pass and the governor sign a balanced budget.

“The state can do these things, whether it’s drawing money out of reserves or sometimes there are other little tricks that the state can kind of pull out of its hat on a one-time basis,” Sommerhauser said. But, he added, “if your ongoing revenues are significantly out of alignment with your ongoing tax revenues, you’re gonna have a headache to deal with every two years, and you’re setting yourself up to have some really challenging budgets that could eventually make you have to do something really, really painful — whether it’s a big tax increase or some sort of big spending cut.”

Sommerhauser said the Great Recession was the point in recent memory when the state dealt with the greatest budget shortfalls.

“There were some significant tax increases that were put into place in 2009, when we had Democratic controlled state government,” Sommerhauser said. During the 2009-2010 budget (the last time there was a Democratic trifecta), former Gov. Jim Doyle and the Legislature created a new tax bracket of 7.75% on married couples filing jointly with taxable income above $300,000 to help close the budget gap the state was facing. The state’s highest bracket is currently 7.65%.

“You had the big election in 2010 where everything flipped, and then you have Gov. [Scott] Walker and Act 10, and everything happening in 2011 which brought about some really large spending cuts in the state,” Sommerhauser said. At the time, Walker’s administration was projecting the state would have a $3.6 billion deficit and the Republican trifecta took the route of drastically cutting public employee benefits to address it.

“We obviously are hopeful that we’re not going to see a recession again anytime soon… but this is our best sort of attempt to give a sense of what the Legislature might be needing to grapple with in two years,” Sommerhauser said.

The partisan composition of Wisconsin’s state government could also look quite different by the next budget. 

Evers announced that he won’t be running for reelection just a few weeks after wrapping up the 2025-27 state budget, making the 2026 election the first open race since 2010.

The Republican and Democratic fields of candidates are still shaping up. Some of the announced candidates have made comments signaling what they would like to see from a budget. 

Lt. Gov. Sara Rodriguez, the first Democratic candidate in the race, has said she would invest additional state funding in Wisconsin’s schools. Republican Washington Co. Executive Josh Schoemann has said the recent budget spends too much and is taxing people too much. Republican U.S. Rep. Tom Tiffany, who is still considering a run, noted the potential deficit on social media when he said that Wisconsin “must change course before we end up like MN and IL.” 

The state Senate and Assembly will also be up for grabs in 2026.

Sommerhauser said it’s likely the next governor and state Legislature could be dealing with a challenging state budget, though it’s still unclear how challenging.  

“If economic growth is really strong for the next two years, we could be in a position where we have a projected shortfall, but it’s quite manageable… That’s kind of the best case scenario,” Sommerhauser said. “Worst case scenario is if we would see a recession in the next couple of years, that could be setting us up for a very challenging budget.”

Milwaukee picking up the pieces as experts warn flooding could become more frequent

Milwaukee County continues to process the aftermath of a historic flooding that swept through the area  last weekend. Although much of the flood water, which exceeded 10 inches in some areas, has receded, emergency shelters are still  providing services to people displaced by the extreme weather, and community clean-up efforts continue. 

At a press conference Wednesday, Mayor Cavalier Johnson said residents should call 211 to report property damage, which he called an important  step towards achieving an official disaster declaration, which in turn could provide additional resources. Johnson said local officials continue to work with state and federal partners to access resources from the Federal Emergency Management Agency (FEMA), and noted a recent visit to the city by Gov. Tony Evers.

“We’re asking for the federal government to do their part and issue some relief to the folks here in Milwaukee with some assistance from FEMA,” Johnson said. The city continues to wait for President Donald Trump’s administration to respond to Milwaukee’s calls for support. Johnson encouraged residents to report downed trees, abandoned vehicles, standing water and to check on neighbors or loved ones. 

The mayor praised Milwaukeeans for “stepping up,” helping senior citizens to clear out basements and  clearing out storm drains. “We really appreciate the efforts of people all across our city who are stepping up to make this a safer place for everybody as we work to get through the aftermath of the storm,”  he said. “We’re a resilient city, we always have been, we always will be, and we will get through this together.”

Johnson was joined by Mike Totoraitis, commissioner of the Milwaukee Health Department. Totoraitis said that calling 211 “is your best connection to resources at this point,” noting that “there are some large wait times on 211 during those peak hours.” Like the mayor, Totoraitis said that calling 211 is also one of the best ways to essentially convince the federal government to send assistance. “We know that many people have lost water heaters, furnaces, furniture, personal effects, there is a lot of damage that has happened,” he said. “Drive through neighborhoods across the city and see just debris and items out on someone’s driveway. So this is a critical moment to get those damage reports in, and then we’re also using that to help prioritize where we’re going to bring additional resources.”

Working with the Red Cross and other partners, Totoraitis said that the city is deploying hundreds of cleaning kits and other supplies. Meanwhile, the health department is monitoring signs of disease. Totoraitis said residents should assume any standing water in the streets or in homes is contaminated with sewage and avoid it.

The Red Cross has established two shelters, one on the near North Side and another on the South Side, to help people displaced by the flood. Dozens of people sought assistance from the shelters, a Red Cross worker told Wisconsin Examiner. The two locations have recently been consolidated into one shelter now operating out of Marshall High School, according to a Red Cross worker.

On Monday, Milwaukee County Executive David Crowley thanked first responders, Evers, and the National Guard for assisting. “I know this is an incredibly challenging and devastating time for many of our residents, but I’m inspired seeing neighbors helping neighbors, businesses stepping up to support those in need, and the tireless dedication of our first responders and emergency management personnel,” said Crowley. “Milwaukee County is a strong and resilient community, and I know that by coming together, we will persevere.” On Tuesday, Crowley walked through storm-damaged neighborhoods near Brown Deer with officials from the county’s Office of Emergency Management.

On Wednesday, Wisconsin Policy Forum released a report warning that severe flooding could become more frequent. “Over the past 45 years Wisconsin has seen a dramatic increase in damage caused by flooding, as the climate has warmed, extreme rains have become more common, and urban development has continued,” the report states. “Increased flooding in turn has resulted in larger payouts on flood insurance claims, as well as increased federal and state payments for disaster recovery. With projections suggesting that continued climate change will further increase the likelihood of extreme rains, federal, state, and local governments will need to deal with the consequences.”

The report shows that during the 1990s, 2000s, and 2010s, flood insurance damage claims for property in Wisconsin exceeded $40 million. Severe floods that struck Milwaukee in 2008 caused nearly $50 million in flood insurance damage claims. “Current projections show that the frequency of heavy rain events and the potential for devastating floods will continue to grow over the coming decades,” the report states. “Property owners, along with state and local governments, will be on the hook for the costs of cleaning up and rebuilding after these floods occur. As costs grow, they may begin to stress state and local budgets, especially if state leaders decide to cover a growing share of the rebuilding costs. In addition, there are some questions about the federal government’s long-term commitment to covering these costs, which may push additional costs onto the state.” 

Taking care of each other

Many people are continuing to wrap their minds around the scale of the flood damage. When Evers visited Milwaukee County, he was joined by Rep. Robyn Vining (D-Wauwatosa) on a tour of  the area Vining represents. Wauwatosa produced some of the most dramatic images of flood damage, with most of Hart Park seemingly underwater and overflowing wetlands in the County Grounds natural area. 

Vining said in a statement that “the damage is serious, and the pain across the community is real. Let’s be good neighbors and take care of each other during this difficult time.” 

Anne Tuchelski, a 29-year-old lifelong resident of Milwaukee in the Bay View neighborhood, saw people stepping up to help one another as a summer’s-worth of rain fell in the middle of the night last weekend across Milwaukee. Tuchelski realized something was wrong after her neighborhood’s main intersection was completely flooded. “I’ve never seen it like this,” she told Wisconsin Examiner. “My gutters were just pouring out and just slamming on the pavement…I’ve never seen this before.”

Tuchelski’s 85-year-old grandmother, who has also lived in Milwaukee for her whole life, had never seen such a storm before either. Tuchelski drove to her grandmother’s house in the middle of the night to check on her. The water was rising dramatically. 

“That was really the kicker, was that it was happening in the middle of the night,” she said. Driving down the darkened, flooded roadways, Tuchelski saw people stranded in their cars. From 2 a.m. to 6 a.m. she used her SUV to offer people rides and to push stalled vehicles out of the water, “helping wherever I could.”

Tuchelski recalled one woman whose car was stranded in floodwater near the freeway. She’d left home to pick up her son, and needed her car to go to work in the morning. Tuchelski tried to get her to understand that her vehicle was flooded, and that the tow truck she’d decided to wait for likely wouldn’t come because of the scale of the disaster. 

“It was just really heartbreaking to see her try to come to terms with the fact that the next day is going to change greatly,” Tuchelski said. She offered her a ride, but the woman refused. “It’s like she wasn’t grasping that nobody can come right now. Everybody’s overwhelmed, everybody’s doing their best, and the car’s gone. And you’re standing in the middle of the intersection at 3 o’clock in the morning. She just couldn’t grasp it, and I ran into multiple people like that who just could not grasp it.”

Another person Tuchelski encountered was in a U-Haul truck attempting to move their things, and seemingly unable to accept that it was all already gone or ruined. “I kept saying to her, ‘You have to leave it,’ and she’s like, ‘My stuff, my stuff,’ and I was like, ‘We can’t. It’s underwater.’ So it was just a repeated thing with people, where they just could not come to terms with leaving their belongings behind for their own survival, and their own well-being.” 

Tuchelski herself lost many family tapes, pictures and dresses in the flood. Tuchelski’s family has lived in Milwaukee for over a century. Her grandmother’s basement is still flooded, and so is Tuchelski’s aunt’s basement. “My grandmother’s home has raised five generations of family,” said Tuckelski. “And just to see things float by and be damaged, it was really heartbreaking … Things that make our family, and have recorded these moments, and have become important to us, just floating by.”

Evers vetoes bill that would have made unpaid court fees a barrier to voting

Gov. Tony Evers recently vetoed a Republican-sponsored bill, AB87/SB95, that would have suspended the right to vote for Wisconsinites convicted of a felony who have served their sentence until they fulfill outstanding court-order obligations, such as fines, costs, restitution or community service.

The Wisconsin Examiner’s Criminal Justice Reporting Project shines a light on incarceration, law enforcement and criminal justice issues with support from the Public Welfare Foundation.

In Wisconsin, people who have served their criminal sentence for a felony, including incarceration and community service, parole, probation and extended supervision, are eligible to vote.

But the proposed legislation would have required any outstanding requirements – “fines, costs, fees, surcharges, and restitution [and] any court-ordered community service, imposed in connection with the crime” – to be addressed in full before voting rights were fully restored.

State Rep. Shae Sortwell, (R-Two Rivers) a sponsor of the bill, offered support in writing at the March 4, 2025 Assembly public hearing, saying the bill would “ensure justice is entirely served and full accountability is given to those that still owe a debt to their victims, especially those that are trafficked.” (The legislation also required restitution for victims of human trafficking as a condition.)

State Sen. Dan Feyen, (R- Fond Du Lac), a co-sponsor of the bill, said he supported the legislation “to make sure crime victims are justly compensated and the perpetrators of these crimes are held accountable for their action.”

However, in vetoing the proposed legislation, Evers said, “This bill would create additional barriers to make it harder for individuals who have completed their sentences to have their right to vote restored. My promise to Wisconsinites has always been that I will not sign legislation that makes it harder for eligible Wisconsinites to cast their ballot. I will continue to keep that promise.”

Mark Rice, Wisconsin transformational justice campaign coordinator at WISDOM, a faith-based organization that works to advance the rights of immigrants and formerly incarcerated people, said the issue is personal to him because he had his voting rights removed when he was sentenced for a felony.

“I couldn’t vote for several years after serving my prison sentence,” he said.

For those coming out of prison, said Rice, it is often difficult to secure employment and have the funds to pay off outstanding fees and restitution, and he doesn’t believe those struggling to integrate into society should face yet another obstacle to participate in civic life.

“We here at WISDOM have been organizing to expand voting rights for formerly incarcerated people for many years, and we thank Gov. Evers for vetoing a bill that would have amounted to voter suppression,” said Rice.

Marianne Oleson, operations director for Ex-incarcerated People Organizing (EXPO) of Wisconsin, also celebrated Evers’ veto.

“Governor Evers’ veto is a tremendous victory for EXPO, for the people we serve, and for democracy in Wisconsin,” Oleson said in a statement. “This bill would have imposed a modern-day poll tax, silencing thousands of Wisconsinites who have already completed their sentences simply because they could not afford to pay court costs or restitution.”

She added, “At EXPO, we believe the right to vote should never depend on the size of your bank account. Justice means restoring full citizenship and dignity to those who have paid their debt to society — not creating new barriers that keep them from participating in our democracy.”

The ACLU of Wisconsin has opposed the legislation since the March 4, 2025 public hearing.

“This proposal would create a modern-day poll tax in Wisconsin,” said the ACLU, and compared  the proposed legislation to a controversial Florida bill, SB 7066, that passed in 2019, which required “outstanding legal obligations” to be met before even allowing ex-felons the ability to register to vote.

The ACLU also warned that the state does not have a “centralized database” to accurately identify all outstanding obligations that would have to be met before voting is regained.

“This would make it nearly impossible for some individuals to determine what they owe, if anything, and whether they would be eligible to vote,” an  ACLU spokesperson said..

Jay Heck, executive director of Common Cause of Wisconsin, an organization supporting open and responsive government, also supported Evers’ veto.

“This measure had as its goal to make it more difficult for long marginalized communities in Wisconsin who are disproportionately Black, Indigenous, and other people of color, as well as people living in poverty and those with disabilities, to be able to exercise their right to vote,” Heck said in a statement.

He added, “This legislation didn’t make whole people who have survived crime; it just would have weakened democracy and put the right to vote out of reach through a poll tax – an outrageous and deeply unfair price tag on the freedom to vote.”

Milwaukee continues recovering from historic flood event

A line of cars filled with mattresses, downed tree limbs, chairs, dressers, and rugs could be seen outside a Milwaukee Department of Public Works (DPW) drop-off center on Lincoln Avenue Monday morning. Inside, long dumpsters were being filled with the ruined remains cleared out of roadways and people’s homes after flood waters blanketed swaths of Milwaukee County on Aug. 9 and 10. 

Mayor Cavalier Johnson joined DPW Commissioner Jerrell Kruschke at the dump site to provide updates about the flood response Monday. “Some of these stories that we’re hearing are truly, remarkably sad,” said Johnson, recalling that the first message he received was from his uncle, whose basement was filled with water. From the North Side to the South Side, west towards Wauwatosa and east towards Lake Michigan, the flood quickly engulfed roadways and homes. 

“So my thoughts are with everybody, everybody who is dealing with issues trying to clear out a basement, folks that are enduring power outages, trying to sort out, figure out what to do with the car that has been flooded through,” said Johnson. “We’re working through the process of obtaining some disaster declarations so we can bring the appropriate aid to those citizens who have been affected by the downpour.”

Gov. Tony Evers has activated the Wisconsin National Guard to assist efforts in Milwaukee County. It’s unclear at this time what role, if any, the Federal Emergency Management Agency (FEMA) will have in Milwaukee, as the level of damage needs to meet a certain threshold in order for the agency to be activated. The agency has also been threatened with funding cuts and possible shutdown by the Trump administration. 

Johnson stressed that the weekend storm, which dropped over 10 inches of rain in some areas, was extremely rare. Timmerman Airfield recorded over 14 inches of rainfall. “I think I said the other day that last time something like this happened was about a decade or so ago,” the mayor said. “I certainly hope that a storm like this is not visited upon this city for at least another millennium,” he continued, referring to the weekend storm being called a “thousand year flood.” Kruschke echoed the mayor’s comments about the rarity of the massive flooding over the weekend. Johnson said he’d heard on the news that it dropped essentially “a summer’s-worth of rain” in a single storm. 

Yet research on climate change has long-predicted that Wisconsin would experience increased rain, more intense storms, and greater risks of flooding. In late 2020, a report from UW-Madison and state health workers warned that climate change in Wisconsin would mean more rainfall over fewer days, which would likely cause flooding. The report noted that the weather changes could have a cascade of health effects including heat stroke from increased heat (which also fuels more powerful storms), asthma and insect-borne diseases. In 2021, severe storms downed hundreds of trees in Milwaukee County. The following summer, communities across Wisconsin experienced heat waves, heavy rainfall, high winds and tornadoes over a couple of days, during which time people died from heat stroke, or after being swept away in flood waters during heavy rainfall. By 2022, global CO2 levels exceeded 400 parts per million, a red line which scientists warned would spur even worse effects.

Answering a question from Wisconsin Examiner about the climate trends, Kruschke said that heavy rainfalls have been documented for a long time, and that DPW is relying on historical data. Kruschke said that the city was not prepared for the volume of rain that fell so quickly. As for whether the city can adapt to future weather patterns, Mayor Johnson said, “I’ve been thinking about this since this storm happened.” 

Johnson praised the DPW’s work with the Milwaukee Metro Sewerage District (MMSD) to create infrastructure to capture rainfall when it hits the ground. “So when you look at our construction projects in the city of Milwaukee, when you see bioswales in the street, that’s to make sure that we keep rain out of sewers. That’s to make sure that we keep rain out of people’s basements. When you see MMSD working to make improvements at the parks in order to capture more rainwater there, that’s in order to make sure that we plan for events like this. When folks are going out to install rain barrels in their neighborhood, that’s in order to make sure that we stop things like this. When you have folks out in the city, like they were during this flood event, making sure that the sewer grates are clear so that water is better able to get into the sewers and not in people’s basements, all of these things play a role, and all of these things make a difference.” 

Johnson said the city will continue investing in “green infrastructure” from roadway design to the creation of outdoor classrooms that, in addition to providing experiential learning to K-12 students, also capture rain. “There’s a lot of work that’s going into this,” said Johnson. “I just imagine what this would’ve turned out if we hadn’t done that work over the past number of years. I mean, who knows how many hundreds of thousands or perhaps even millions of gallons of storm water that we were able to capture that didn’t end up in the streets, that didn’t end up in people’s basements.”

The city and county are continuing to assess the full scale of the damage, including how many homes have been affected and people displaced. Monday morning, the Milwaukee County Medical Examiner’s Office stated in response to an inquiry from  the Wisconsin Examiner that there had been no deaths directly linked to the flooding. However, the Milwaukee Police Department’s Harbor Patrol did find a 49-year-old Native American man, identified as Juan Carlos Sierra Campos, who drowned in Lake Michigan on Sunday morning. An investigation is ongoing. 

Kruschke said the public works department  will continue working normal hours (7 a.m. to 3 p.m.), and operate special trash disposal procedures for people clearing out damaged or ruined property. Fees will be waived for city drop-off centers, with the centers operating free of charge until Aug. 17. Drop-off centers will also be open Mondays, when they would normally be closed. The drop-off centers are located at 3878 W. Lincoln Ave. and 6600 N. Industrial Road. 

A small number of street sweepers are out on the roadways, and some communities  are deploying dump trucks and other vehicles to assist. DPW is also offering special pick-ups for storm-damaged material. Among the items that will not be accepted are  explosive or flammable products, propane tanks, large gas appliances, fluorescent light bulbs, wet or oil-based paint and material or vehicles from contractors or businesses.

Libraries, including the West Allis Library, are offering WiFi and computers for people unable to use their own. Cars that were swept away or abandoned during the floods may have been towed to alternate locations so as to not overwhelm the city’s usual tow yards. The city does not have a count of the number of cars towed or abandoned. Overnight parking enforcement will be suspended Monday, Tuesday and Wednesday nights.

Residents are encouraged to avoid wading through flooded areas or standing water. The possibility of contaminated water or hidden debris makes wading unsafe. The Red Cross has also opened two shelters for people who have been displaced by the flooding. The shelters are located at the Washington Park Senior Center (4420 W Vliet St.) and at Holler Park (5151 S. 6th St.). 

Evers signs bill that enables nurses with advanced credentials to practice independently

As expected, Gov. Tony Evers signed legislation Friday that clears the way for nurses with advanced training to practice independently.

“Nurses play a critical role in our healthcare workforce, and I’m proud of our work to expand opportunities for nurses to not only grow their career but create a system that allows for more advanced practitioners here in Wisconsin,” Evers said in a statement released Friday announcing his plans to sign AB 257, the advanced practice registered nurses (APRN) legislation, now Wisconsin Act 17.

The bill creates a new license category and a professional pathway for nurses who qualify to practice independently.

Evers vetoed two other closely watched bills — one that would have carved out app-based drivers from protections under state employment laws and one that would require the state Department of Corrections to recommend sending back to prison people charged with a crime while they are on probation, parole or extended supervision.

Altogether the governor signed 16 of the 21 bills that the Legislature formally presented to him on Thursday and vetoed five.

Advanced practice nursing bill wins approval

The Wisconsin state nursing board will oversee the credentialing of advanced practice nurses, a group that includes certified nurse-midwives, certified registered nurse anesthetists, clinical nurse specialists and nurse practitioners.

Advocates said the measure will increase the availability of health care providers, particularly in parts of Wisconsin where doctors are scarce.

Evers vetoed previous versions of the bill in 2022 and 2024. Both times he expressed support for the concept but insisted nurses should meet tighter qualifications before they can practice on their own.

The bill he signed Friday adds those requirements — increasing the amount of supervision that an APRN must have under a physician to 3,840 hours before practicing independently; adding additional supervision requirements for certified registered nurse anesthetists who specialize in pain management; and including language to restrict the titles APRN practitioners use so patients aren’t confused about their credentials.

The Wisconsin Medical Society cited those issues in opposing APRN bills in previous legislative sessions, and with the 2025 revision shifted its stance to neutral.  

In floor votes in June, lawmakers from both parties stressed the bipartisan compromise reflected in the measure that was presented to Evers this week.

In his announcement, Evers thanked lawmakers for their work on the measure, including Republican state Sens. Patrick Testin and Rachael Cabral-Guevara, Republican state Rep. Tony Kurtz and Democratic state Rep. Lisa Subeck.

He also thanked “the many nursing and physician groups that we worked with to get this bipartisan bill across the finish line to help bring more folks into the healthcare profession and ensure that Wisconsinites get the high-quality care they need when they need it while setting our nurses up for success.”

Bill classifying gig drivers vetoed

Evers vetoed AB 269, legislation that would have blocked drivers from app-based rideshare and delivery businesses from being declared employees.  

The legislation would have automatically classified drivers for Uber, Lyft, DoorDash and similar businesses as independent contractors, bypassing current Wisconsin laws that differentiate independent contractors from direct employees. 

It would have categorically excluded app-based drivers from coverage under the state’s unemployment insurance, workers compensation and minimum wage laws. 

“I object to the bill’s definition of independent contractor status in the absence of any guaranteed benefit for workers,” Evers wrote in his veto message.

In a campaign pushed most prominently by DoorDash and other app-based businesses that enlist drivers, advocates focused  on the bill’s provisions that would permit — but not require — those businesses to establish portable benefits for drivers.

Evers acknowledged in his veto message that app-based drivers “are a growing segment of Wisconsin’s workforce.” But he said changing the state’s independent contractor definitions “demands substantive conversations among several parties,” with management and  workers both at the table. 

Evers wrote that while the bill was moving through the Legislature, his staff asked lawmakers and groups with an interest in the measure to allow time for “robust dialogue and engagement to reach consensus and compromise” over the legislation. 

“Unfortunately the Legislature declined to meaningfully provide that opportunity, choosing instead to send this bill to my desk anyway,” he wrote. “My veto today will allow time for these important conversations to occur so Wisconsin can find a path forward.”

The Wisconsin AFL-CIO praised the veto. “Legislation that makes the loss of important worker rights a certainty while holding out the possibility of flexible benefits if and when the employer chooses to provide them is a bad deal for workers,” President Stephanie Bloomingdale said. 

Bill pushing revocation for offenders rejected

Evers vetoed AB 85, legislation that would require the Department of Corrections to recommend automatically returning a person to prison who is charged with a crime while on extended supervision, parole or probation. Evers vetoed a similar bill in 2019.

Evers wrote in his veto message that the legislation was “an unfunded mandate” likely to cost the state more than $330 million in the first two years, according to the fiscal estimate, “and hundreds of millions in unknown, ongoing costs.” 

In addition, he wrote, it would likely require building more prison facilities and would be expected to impose new costs on local governments, while he blamed lawmakers for “significantly underfunding existing operations at the Department of Corrections in the most recent state budget.”

The bill “would move Wisconsin in the wrong direction on criminal justice reform without improving public safety,” Evers wrote. 

Instead, he urged lawmakers, “Wisconsin should be investing in data-driven, evidence-based programming that addresses barriers to reentry, enhances educational and vocational opportunities for individuals who will be released after completing their sentence, and provides treatment for mental health and substance use issues, which will help to reduce recidivism and save taxpayer money while improving public safety.”

In a message posted on Facebook the bill’s author, state Rep. Brent Jacobson (R Mosinee), criticized the veto. “It is unacceptable to give repeat criminals the opportunity to continue to put our families and neighbors at risk again and again without facing consequences,” he wrote.

The bill was opposed by criminal justice reform organizations, including the national prison reform group Dream.Org and Wisconsin-based Ex-incarcerated People Organizing (EXPO).

“This harmful bill would have led to more people being revoked from community supervision and incarcerated, making it harder to build safe and thriving communities in Wisconsin,” Dream.Org posted on Facebook. The organization credited campaigning by advocates and community groups with persuading Evers to veto the measure. 

Primary care medicine measure falls 

Evers vetoed SB 4, legislation that would specify that subscription-based direct primary medical care arrangements are not subject to the state’s insurance laws.

While the legislation had some bipartisan support in concept, it foundered at the governor’s desk on the issue of anti-discrimination language.

Evers listed in his veto message a number of provisions in the legislation that forbid primary care providers from refusing to treat patients. 

Nevertheless, he wrote that he objected to “the Legislature failing to provide sufficient protections for patients receiving care under direct primary care agreements from being discriminated against and potentially losing access to their healthcare.”

Evers did not specify what additional protections he believed the measure should include. “I previously raised similar concerns when I vetoed earlier iterations of this legislation five years ago — concerns the Legislature has declined to satisfactorily address in the bill that is now before me and despite having ample opportunity,” he wrote.

In 2020, when Evers vetoed the version of the legislation on his desk at the time, he wrote that he objected to an amendment in which lawmakers had removed language protecting patients from being refused treatment on the grounds of “genetics, national origin, gender identity, citizenship status, or whether the patient is LGBTQ.”

In his veto message Friday, Evers wrote, “Every Wisconsinite should be able to get the healthcare they need when and where they need it — and without fear of discrimination. I welcome the Legislature revisiting this legislation and the opportunity to enact a version of this bill that sufficiently addresses my concerns.”

The announcement issued by the governor’s office Friday includes a complete list of bills that the governor signed and vetoed, with links to the enacted measures and to Evers’ veto statements.

Evers calls on EPA chief to back off from canceling homeowner solar program

Gov. Tony Evers wrote to the federal Environmental Protection Agency on Thursday, urging the Trump administration not to cancel Wisconsin’s $62.4 million grant to install solar energy systems for low- and moderate-income households.

Evers’ letter to EPA administrator Lee Zeldin followed a New York Times report earlier this week that the agency was preparing to cancel the $7 billion federal “Solar for All” grant program. “Solar for All” was part of the 2022 Inflation Reduction Act passed by congressional Democrats and signed by then-president Joe Biden.

“To be clear, attempting to terminate Solar for All grants has no legitimate purpose or justification,” Evers wrote. “Beyond that, doing so will also negatively impact Wisconsinites and our state, causing increased energy bills for Wisconsinites and hurting efforts to improve air quality, boost resilience, and create good-paying jobs.”

The Wisconsin Economic Development Corp. has put out a request for proposal seeking an implementer for the state’s program, called “PowerUp Wisconsin.” Bidders were to submit a notice of their intent to bid by this past Monday, Aug. 4, and final proposals are due on Friday, Aug. 29.

According to the WEDC’s work plan for the project, Wisconsin’s grant would add rooftop solar power systems to 1,038 households in single-family homes and 2,200 more households in 24 multifamily homes. The plan also calls for 10 community solar projects that could serve an additional 4,239 households.

Evers told Zeldin in the letter that since Wisconsin’s $62.4 million grant was awarded in April 2024, the WEDC has worked with local governments, solar installers, utilities and housing developers to draw up the state’s program guidelines. The program would reduce Wisconsin’s reliance on out-of-state energy and save households up to $500 a year on their energy bills, Evers wrote.

The governor wrote that lowering costs has been “a top priority” for his administration.

“While the Trump Administration claims to share this priority, terminating Wisconsin’s Solar for All grant would have the exact opposite effect, preventing Wisconsin families and households from seeing the direct savings offered through PowerUp Wisconsin,” Evers wrote.

The Evers administration and the Wisconsin Department of Justice have joined a number of lawsuits to block Trump administration executive orders and unilateral actions to cut funding approved by Congress.

Evers’ letter appeared to leave open the prospect for more litigation. “At a time when energy demand continues to increase, it is unfathomable for the Trump Administration to unnecessarily — and potentially illegally — terminate funding for a program designed to deploy affordable, renewable energy systems,” Evers wrote.

Former Wisconsin governors stir conversation on whether they’ll run for the office again

While Wisconsin’s incumbent governor is opting out of seeking a third term, the open and growing field has led a couple of former governors to stir conversation about whether they will run again in 2026 or beyond.

Democratic Gov. Tony Evers’ decision not to run makes 2026 the first open race for governor since 2010, when Scott Walker, then the Milwaukee County executive, defeated Milwaukee Mayor Tom Barrett. Former Gov. Jim Doyle, who served from 2003 to 2011, had declined to run for a third term. 

Evers said he chose not to run again next year because he wants to spend more time with his family.

Former Gov. Tommy Thompson did not rule out a run for governor in 2026 while speaking with 620 WTMJ on Monday afternoon. 

“Why not?” Thompson said in response to the question about whether he would run for governor. “I haven’t said no. There’s a lot of good candidates and I have no desire to get in the race, but the truth of the matter is, I’ll wait and see what’s out there.” 

There are two declared Republican candidates in the race so far: Washington County Josh Schoemann and Whitefish Bay manufacturer Bill Berrien. U.S. Rep. Tom Tiffany has also been teasing a run for the last several weeks.  

Only one Democratic candidate, Lt. Gov. Sara Rodriguez, has officially launched her campaign since Evers’ announcement on July 24. Other potential candidates include Milwaukee County Executive David Crowley, Attorney General Josh Kaul, state Sen. Kelda Roys (D-Madison) and former Lt. Gov. Mandela Barnes. 

Thompson is the only governor in Wisconsin to have been elected to four terms, serving from 1987 to 2001. Wisconsin is one of 13 states in the U.S. without term limits on governors, according to Ballotpedia.

Thompson left the office to serve as President George W. Bush’s Health and Human Services secretary. He also previously served as University of Wisconsin system president. This is not the first time that he has floated seeking a potential fifth term, having mentioned it in 2022.

Thompson said Monday that his wife and children would be opposed to him running for another term, but he signaled that he feels he would be up to the task. By the time the next term starts, Thompson would be 85.  

“I’m in great physical health. My mind is sharp as hell. I’ve got things that I’d like to accomplish, but it’s way too early for me to make that decision, way too early,” Thompson said.

Walker, who served two terms as governor, recently said he wouldn’t be running for governor in 2026 after making cryptic posts on social media that pointed to potential nonconsecutive terms. He lost the office to Evers in a close election in 2018. 

“I’m not going to be a candidate, at least not next year. It doesn’t mean I’ll never run again,” he said in a video posted to social media. Walker, who is 57, added that he is a “quarter century” younger than former President Joe Biden. 

“Looking ahead, though, Tonette [Walker] and I will do everything we can at our home here in Wisconsin to ensure that we elect a common sense conservative as governor in next year’s election,” he said. 

Walker said he would be continuing his work as president of Young America’s Foundation, a conservative nonprofit focused on youth, and emphasized that Republicans need to do better outreach to young voters.

Wisconsin has only had one governor serve nonconsecutive terms.

Prior to Wisconsin adopting four-year terms for its governors, former Gov. Philip La Follette served his first term as governor from 1931 to 1933 as a Republican. 

According to the National Governors Association, La Follette, the son of former U.S. Sen. “Fighting Bob” La Follette, spent a significant portion of his time in office seeking the expansion of public works, including highway construction, increased government control over the electric power and banking industries and helped set up an unemployment insurance program, which became a model for similar legislation in other states. 

La Follette ran for another term in 1932 but was defeated by Democratic Gov. Albert G. Schmedeman. 

After one term out of office, La Follette ran for governor again in 1934, this time as a third party candidate for the newly formed Progressive Party. He went on to serve a second and third term from 1935 to 1939.

Democratic governors endorse mid-decade redistricting in response to GOP efforts

MADISON — Wisconsin Gov. Tony Evers, Kansas Gov. Laura Kelly and other Democratic governors said responding “in kind” to Republican mid-decade redistricting is necessary at a Friday Democratic Governors Association press conference.

Kelly said she thinks courts would rule that redrawn maps from Republicans and Democrats are unconstitutional. If Republicans take this path, however, Democratic governors must also pursue mid-decade redistricting to “protect the American people,” she said.

“It’s incumbent upon Democratic governors, if they have the opportunity, to respond in-kind,” Kelly said. “Things are bad enough in Washington right now. What it would look like if there’s even a greater majority that this President controls — God help the United States of America.”

Kelly and other Democratic governors were in Madison for the DGA’s summer policy conference. 

Discussion over redistricting ahead of midterm elections started in Texas, where President Donald Trump’s political team pressured state leaders to redraw its map to gain more seats in the U.S. House and help Republicans maintain their congressional majority in 2026. Trump said a “very simple redrawing” of the state’s maps could help pick up five seats. 

Redistricting, the process of redrawing state legislative and congressional district boundaries, typically happens every ten years after the U.S. Census. 

Other Republican-led states, including Florida and Ohio, also said they would look at redrawing their maps mid-decade.

California Gov. Gavin Newsom, who was not at the press conference, was the first Democrat to float the idea of gerrymandering the Democratic state to have fewer Republican seats in response. Democrats in New York and Maryland have also been looking for a path to gain additional seats in their states as well. 

None of the governors at the press conference said they would pursue that route but said they supported those that had a path to use it. Kelly joked that she “could” do mid-decade redistricting. “But what would I do? I’d just give them another Republican.” 

Evers said the blatant direction from Trump to pursue redistricting is a “constant threat to our democracy.” 

“I’m really pissed frankly, and we’re going to do whatever we can do to stop this,” Evers said, adding that Wisconsin would not be changing its maps. He said the state has already worked hard to “get fair maps.”

The Republican-led Legislature and Evers adopted new maps for the state Legislature in 2024 following a state Supreme Court ruling. Some have been calling for new Congressional maps, though those efforts have so far been rejected by the state Supreme Court. 

Wisconsin’s current congressional maps were drawn in 2022 by Evers and selected by the state Supreme Court with a conservative majority at the time. Democrats and their allies filed a new challenge to the maps in Dane County Circuit Court in July, arguing they are unconstitutional because they’re anti-competitive. Republicans currently represent six of Wisconsin’s eight congressional districts. 

“Because of those fair [state legislative] maps that we had, we were able to pass a relatively bipartisan budget, and it was a good budget, and so, in my heart of hearts, this is where we have to be, but… when you have a gun up against your head, you gotta do something,” Evers said.

“This move is unconstitutional. It’s again breaking the system. It’s, again, meant to game the system,” Minnesota Gov. Tim Walz said. “Democrats are expected to have the decorum — we’re expected to protect the institutions, we’re expected to follow the rules on this.”

The times call for a different approach, however, he argued. 

“We’re not playing with a normal administration,” Walz said. “We’re playing with one that has thrown all the rules out of there… I think it is incumbent upon states that have the capacity or the ability to make sure that we are responding in kind.”

Governors criticize GOP over effects of the Republican megabill 

The Democratic governors also warned about the potential effects of Republicans’ federal reconciliation package. Kelly, who chairs the Democratic Governors Association, said government systems and programs being cut are not set up for states to operate on their own. 

“They were set up with the federal government as a very robust partner, and without them being a partner, there is no way that any of our states will be able to pick up the tail,” Kelly said. “The best we could do is perhaps mitigate the pain, but even that will be difficult.” 

The legislation, ” signed by President Donald Trump on July 4, made major changes to the federal Medicaid and the Supplemental Nutrition Assistance Program (SNAP).

Trump and Republicans in Congress are “trying to gut programs that Wisconsin families count on,” Evers said. “They’re willing to break our constitutional system to make that happen.” 

The megabill is just one tool, he suggested. “Whether it’s the Republican budget or the continued illegal action to fire Wisconsin workers, strip funds away from our state, damage public education, we have to fight.” 

A memo released this week by the nonpartisan Wisconsin Legislative Fiscal Bureau found that the exact effects of the federal reconciliation law on Medicaid and FoodShare in Wisconsin are uncertain, but will likely result in fewer enrollees.

Currently, about one in five Wisconsin residents rely on Medicaid for health care coverage. 

“The full impact of the Act’s Medicaid provisions on the state’s MA enrollment and costs remains uncertain,” the fiscal bureau memo states. “This is partly because some of the details of implementation requirements will depend upon forthcoming federal guidance, but also because the eligibility and enrollment requirements are new for the program and so little is known about their actual effects.” 

Starting in January 2027, childless adults will be required to complete 80 hours per month of paid work, school, employment training or community service per month to maintain their Medicaid eligibility. There are about 184,000 childless adults currently enrolled in Wisconsin. DHS estimates that 63,000 Wisconsinites will be at high risk of losing their coverage.

The LFB memo said that enrollment will likely drop due to the work requirement provisions. 

“Enrollment reductions could occur either because of the additional complexity of the application process or because the work requirements cause some individuals to increase their earnings to above the eligibility threshold. The magnitude of the program disenrollment, and associated reduction in [Medicaid] benefits costs, is uncertain,” the memo states. 

The governors warned that hospitals still face a difficult environment under the federal law. 

“Our rural hospitals in particular are extremely at risk,” Kelly of Kansas said. “We’ve already closed 10 of them in those 10 years and many more are on the brink, and this reconciliation bill is going to throw them over the edge.”

“Donald Trump’s big ugly bill is the single worst, most devastating piece of legislation that I have seen in my lifetime. It is a direct attack on rural America,” Beshear said. 

Three hospitals in Wisconsin have been identified as at risk of closure. 

Costs for the SNAP program will increase in Wisconsin as the law reduces the federal share of the program — known as FoodShare in Wisconsin — from 50% to 25%. This will leave states responsible for 75% of the costs, a change that the Wisconsin Department of Health Services estimates will require an additional $51 million annually from the state. 

The FoodShare program currently helps nearly 700,000 Wisconsinites access food, and nearly 90,000 Wisconsinites will be at risk of losing their benefits due to the new federal provisions, according to the Wisconsin Department of Health Services

Rhode Island Gov. Dan McKee echoed concerns over the ability of the state  to pick up the gaps left by federal cuts in social programs.

“We’re not going to be able to absorb in funding what’s coming our way,” McKee said. “The taxpayers are going to pay for it in our states or the benefits are going to get reduced.” 

The law extends work requirements for SNAP recipients from the current top age of 54 to age 64. It narrows the work requirement exemption for caregivers and parents by changing the definition of “dependent child” from under 18 years of age to under 14, meaning that parents of 15- to 17-year-olds could now be required to have employment in return for their SNAP benefits. 

It provides an exception from work requirements for a married person responsible for a child under age 14 and residing with someone who complies with the work requirements. It also exempts individuals who are eligible for the Indian Health Services. 

“While Wisconsin just passed a Wisconsin budget that invests in our kids, cuts taxes for working families and supports our rural hospitals, Trump and Congressional Republicans are moving in just the opposite way,” Evers said. “Democratic governors aren’t going to just sit idly and watch it happen. When Trump tried to strip hospital funding, we moved real quickly to protect $1.5 billion dollars in health care funding for Wisconsin. When they threaten our schools, we stand up and fight back. When they attack programs that matter to working families, we find ways to fill the gaps.”

“Republican governors fall in line behind Trump’s agenda. Democratic governors are standing up for the people that we serve,” Evers said before mentioning 2026 elections. He said Wisconsinites will “make a choice about the future of our state when they elect our next governor. They’re going to choose a leader who will work together and expand health care, support working families and build an economy that works for everybody.”

Evers announced on July 24 that he would not be running for a third term in office, setting up the first open race for governor in Wisconsin since 2010.

“I know that [Evers’] leadership is not going to end just because the title might, and that he is going to be out there fighting for what he believes in moving into the future,” said Kentucky Gov Andy Beshear, who won’t be able to run for another term in 2027 due to term limits.

So far, Wisconsin Lt. Gov. Sara Rodriguez has announced her campaign, Milwaukee County Executive David Crowley is planning on entering the race and other Democrats are still mulling a decision. There will likely be a crowded Democratic primary. Two Republicans have officially launched their campaigns for governor, while U.S. Rep. Tom Tiffany has been teasing a run.

Child care needs support to survive

I have owned and operated a child care center for the past 19 years. Not only do I make sure staff and the bills are paid, I clean toilets, clean windows and change diapers.  I have devoted my life to educating and caring for young children. I didn’t go into this profession to line my pockets with money. But everyone in my field deserves a living wage and to know they are supported in their community. My goal is to create a safe and nurturing learning environment for the children who enter my center.  My belief is that their parents have decided to partner with us to make sure their children are getting the best possible environment to learn and grow.  

Creating  this high-quality environment for children has become increasingly hard over the years for child care providers in Wisconsin. Parents can’t pay more and providers need to keep qualified staff and pay them a liveable wage. For my center, wages for employees went up by $4 an hour recently  to keep up with the other businesses in my community.  

I started advocating and organizing around child care and early education right before the latest state  budget cycle. I found  there were some pretty big hurdles to jump over to get our legislators to listen to child care providers.

 I’ve heard legislators tell providers “all you want is money.” I’ve heard them say   “these women just need to learn how to run their business.”  My favorite observation is: “We don’t need child care.  Women should just stay home and take care of their children.”  It wasn’t easy to get anyone at the Capitol to take providers seriously. In the last state budget child care received no funding.  Wisconsin was  one of six states that did not put any state money into child care or early education. Gov. Evers did find a way to support providers with direct payments using federal money, which  helped keep many providers’ doors open throughout the state.  

Meanwhile, advocates and early educators kept coming to hearings,  talking about what we do on a daily basis and how that is important to our communities and the state.

Providers across Wisconsin held Community Conversations and Day Without Childcare events. Many elected officials from both sides of the aisle received tours of centers.  Providers also sent letters to the editor and talked with every type of news outlet that would listen. I am so proud of all the providers who stepped up and continued to push this message that what we do is important and we deserve support. As a result,  ideas at the Capitol started to shift.  

I spoke to legislators from both sides of the aisle. I heard legislators starting to talk about the “child care crisis” and realize that it wasn’t happening just because we didn’t know how to run our businesses. They started to say out loud that parents shouldn’t have to pay 25% of their income for  child care. Legislators who previously wouldn’t have said they supported child care investment said they would try and get something done.

In the end, the new state budget  wasn’t ideal but it did do two things: Direct payments will continue to go to providers for the next year and early education is finally funded with state dollars in the Wisconsin budget.

Does this budget solve everything? No. Does it provide the $330 million Evers sought in direct payments  to providers? No. Did Wisconsin for the first time  put state money into  early education? Yes — including $110 million in direct payments to providers Does it deregulate child care, increasing the number of  infants and toddlers one staff person can care for and allowing 16-year-olds to count as full-time assistants? Yes.

I absolutely do not think deregulation is the answer to the child care crisis. I believe it is harmful to children. I will not be participating in the deregulated infant/toddler program outlined in this budget.  I know I cannot get staff in my center to continue work when I ask them to take care of three more toddlers on their own. A single teacher in this proposed program would take care of seven toddlers ages 18 months and up. Right now that same teacher is expected to care for four toddlers that age. Even though some states have this ratio,  the National Association for the Education of Young Children clearly states best practice is 1:4 for this age group.

I would also not hire a 16-year-old as an assistant teacher to add to my staff. I don’t believe 16-year-olds are ready to handle large groups of small  children and provide the  quality time and interaction they need; 16-year-olds are still children themselves. And since they are in school themselves, they are not that much help with the labor  shortages centers experience all day long.

I’m grateful that Gov. Evers made child care a priority, and that our state finally joined the majority of other states in providing some support for this essential resource in the state budget.

Advocating for policy changes is a constant back and forth. Much of the time you don’t get  what you want. This means that we must go back in two years, to make Wisconsin’s child care support better and  more durable.  Child care advocates have created a strong network and we are not done advocating for the change needed for providers to keep their doors open and for educators to earn a living wage. I believe child care is infrastructure and a public good.  Together with other child care providers, I will continue to advocate and educate our leaders about how a well supported child care system is essential to  our community and our economy.

Lawmaker pushes again for Wisconsin task force on missing and murdered Black women and girls

For the third session in a row, State Rep. Shelia Stubbs (D-Madison) is calling on Wisconsin lawmakers to create a task force to examine the violence African American women and girls face and develop policy solutions to prevent others from going missing and being murdered.

The bill would establish a 17-member task force to produce a report on the issue. Members would include two Senators, two Assembly representatives and other stakeholders, along with law enforcement representatives and representatives from advocacy or legal organizations, including those that focus on Black women and girls. 

“This is my third time to try and get a critical piece of legislation passed into law,” Stubbs said at a press conference Friday. 

Stubbs, inspired by a similar task force in Minnesota and one focused on Indigenous women in Wisconsin, first introduced the proposal during the 2021-2023 legislative session, but it failed to gain traction. The second iteration of the bill, during the 2023-25 session, passed the Assembly but stalled in the Senate as former Sen. Duey Stroebel initially refused to allow the bill to move forward. It eventually received a public hearing and was approved by a committee but never advanced to a vote on the Senate floor. 

“Can anyone tell me why this critical legislation could not get scheduled? Can you tell these families why their loved one was not important enough to at least get a hearing?” Stubbs asked at the press conference. “It is not fair to these victims and their families that they have to continue to wait for this Legislature to do something.” 

Stubbs said Wisconsin has the “worst disparity in the nation” when it comes to Black women and girls being killed. A 2022 investigation by the Guardian found five Black women and girls were killed each day in the U.S. in 2020. Wisconsin was the worst in the country, with the rate doubling that year. 

Coauthors on the new bill include Rep. Pat Snyder (R-Weston), Sen. Jesse James (R-Thorp) and LaTonya Johnson (D-Milwaukee). 

“I’m demanding that we get an answer,” Stubbs said. “I am demanding that we get justice. How many more victims do we need in this state before we do something?”

Stubbs was joined at the press conference by Sheena Scarborough, mother of 19-year-old Sade Robinson, who was murdered last year.

“The things that we have gone through as a family,” Scarborough said. “They stand behind me knowing exactly what it’s like being a victim of a severe traumatic crime in the worst possible way… We are still dealing with ongoing trauma daily.” 

A jury found Maxwell Anderson guilty last month of murdering and dismembering Robinson, who had gone on a first date with him in 2024. Anderson’s sentencing is this week

Scarborough said there wasn’t enough support as she dealt with law enforcement and navigated the criminal justice system for the first time following her daughter’s murder. The lack of support  pushed her to start the Sade’s Voice Foundation, she said. The nonprofit was formed to advocate and provide  support for the families of missing Black women and girls.

“There weren’t many other supports through this time…. It doesn’t matter if you are Republican or Democrat. These are our babies. This was my daughter. She was a granddaughter. She was a sister. She had her whole life ahead of her,” Scarborough said. “The task force is definitely needed.”

The task force would examine several related issues. They include systemic causes of the violence Black women and girls experience, the appropriate methods for tracking and collecting data on violence against Black women and girls, government practices including policing related to investigating and prosecuting crimes against Black women and girls, measures that could reduce violence against them and ways to support victims and their families.

The final report, which would be due by 2027, would need to recommend policies and practices that would be effective in reducing gender violence and increasing the safety of Black women and girls and help victims and communities to heal from violence.

Angela Arrington, the social action coordinator for Delta Sigma Theta Sorority, Inc., said that  the task force could help address the persistent violence that Black women and girls face. 

“They are more likely to experience homicide, sexual assault and other forms of violence than their white counterparts, and these cases often go unsolved or receive less attention,” Arrington said. “The epidemic of violence is a complex issue with deep-rooted historical and systemic causes requiring comprehensive and coordinated action to address.” 

Attorney General Josh Kaul said lawmakers are needed to establish a task force and that a state investment must be included.

Kaul and Gov. Tony Evers included creating a task force in their budget proposals, but the Republican-led Joint Finance Committee did not include it in the final proposal. 

“People are ready to step up,” Kaul said. “The problem now is not whether there is interest among folks in collaborating and working to identify solutions. What we need is legislative will. We need the legislators and the Senate and the Assembly to pass legislation that will help ensure we have this task force… It’s clear that there is a need not just for action, but for there to be an investment so that we can seriously consider these issues.” 

He alluded to the new budget approved earlier this month that was celebrated as a bipartisan compromise by legislative leaders and Gov. Tony Evers.

“The Legislature was so close to passing legislation that would help us move forward on this issue, but we’ve seen there’s an opportunity for some compromise in this legislative session,” Kaul said. 

The bill includes one position supported with state funding of $80,200 in 2025-26 and $99,500 in 2026-27. 

Kaul said the additional Department of Justice employee would be essential to coordinate the work of the task force, including gathering data that may be needed. 

A similar task force focused on Indigenous women and girls was formed in 2020 by Kaul after legislation failed. Kaul started that task force without state funding by using federal funding from the Violence Against Women Act. He said at the press conference that the agency doesn’t have funding  for a similar pathway for the proposed new task force. 

The 2023 version of the bill did not include funding when it passed the Assembly. 

“This is a really significant issue that takes the investment of time and resources, and I don’t want to see a group come together without having the resources they need to be successful,” Kaul told reporters. “I want to see this done properly and right and that’s what this bill would do.”

Lt. Gov. Sara Rodriguez enters 2026 Democratic primary race for governor, others still considering

Less than 24 hours after Gov. Tony Evers announced he wouldn’t run for another term in office, the field for the Democratic primary for governor is beginning to take shape as Lt. Gov. Sara Rodriguez launched  her campaign Friday morning while other potential candidates are still considering. 

Evers’ video announcing that he would retire because of his family ended months of speculation about a potential third term and triggered the start of the first open race for governor in Wisconsin since 2010. 

The Republican field is still shaping up, with Washington County Executive Josh Schoemann and Whitefish Bay manufacturer Bill Berrien have officially announced. Other potential candidates include U.S. Rep. Tom Tiffany and businessmen Eric Hovde and Tim Michels, both of whom have recently lost statewide campaigns. 

The first Democrat in the race, Rodriguez in her campaign launch video took aim both at Republicans in Washington and at the GOP majority in the Legislature. 

“We’ve got a maniac in the White House. His tariffs are killing our farmers and his policies are hurting our kids,” Rodriguez said of President Donald Trump. “Our [state] Legislature refuses to expand Medicaid, even though 41 other states have done it. I mean Arkansas expanded Medicaid. Arkansas, but not Wisconsin. I’ll get it done.” 

Rodriguez was elected lieutenant governor in 2022, when Evers won his second term. She succeeded former Lt. Gov. Mandela Barnes, who ran an unsuccessful campaign for the U.S. Senate against Republican Sen. Ron Johnson that year. 

“I’ve been an ER nurse, a public health expert and a small business owner. I’m used to being on my feet and getting right to the point,” Rodriguez said in her video. “I have an announcement: I’m running for governor.” 

“I know what you’re thinking, you don’t have the time for the rest of this video,” Rodriguez said. “Look, I get it I’m a busy parent too, so here’s what you should know: I’ve got two kids that are way too embarrassed to be in this video, a dog named Chico and I met my husband salsa dancing – all true. My parents were Wisconsin dairy farmers. My dad served during Vietnam and fixed telephones at Wisconsin Bell. Mom was a union member who helped kids with special needs.”

Rodriguez got degrees in neuroscience and nursing before working as a nurse in an emergency room in Baltimore. She has also worked for the Centers for Disease Control and has served as vice president for several health care-related businesses, including at Advocate Aurora Health from 2017-2020.

Rodriguez said in the video that entering politics wasn’t part of her plan, but seeing “a broken system” she decided to run for the Assembly. She flipped a Republican seat that covered parts of Milwaukee and Waukesha in 2020 by 735 votes, and served for one term before making her run for lieutenant governor in 2021. After winning the Democratic primary, she joined Evers on the ticket. 

The Democratic Lieutenant Governors Association quickly endorsed Rodriguez Friday.

Rodriguez noted that control of the state Legislature is also at stake in 2026, with Democrats having the chance under new, fairer maps adopted in 2024 to win control. The last time there was a Democratic trifecta in Wisconsin was in the 2009-2010 session. 

“Look, we’ve got a real shot at flipping the state Legislature, and with a Democratic governor we can finally expand Medicaid and boost our health care workforce. We can strengthen our farms and unions and small businesses, fund our public schools and give teachers the raise they’ve earned. That’s the right path, and it’s what you and your family deserve,” Rodriguez said. “I can’t wait to earn your vote.”

Other Democrats on whether they’ll run

Milwaukee County Executive David Crowley said in a statement Friday morning that he cares about the future direction of Wisconsin and that “I will be taking steps toward entering the race for Governor,” in the coming weeks. 

“The stakes are simply too high to sit on the sidelines,” Crowley said. “Governor Evers has laid a strong foundation. I believe it’s our responsibility to build on that progress — and I look forward to engaging in that conversation with the people of Wisconsin.” 

Crowley, 33, was elected to the county’s top office in 2020, the first African American and the youngest person to serve in the position. During his time in the job, Crowley has been a staunch  advocate for the state’s largest county, including helping secure a sales tax increase for Milwaukee. He also previously served for two terms in the state Assembly.

Asked whether she plans to run, state Sen. Kelda Roys (D-Madison) told the Wisconsin Examiner Friday she is “giving it really serious consideration.” Roys came in third in the 2018 primary that nominated Evers.

“This is going to be a wide open primary,” Roys said. “I don’t think anybody has a strong advantage in it, and I think the stakes are incredibly high.” 

Roys said she thought Evers has “given more than anyone could ask to this state” and has earned the right to do whatever he wants. She said, however, that Democrats shouldn’t rely on old tactics in 2026 and that people want a candidate who will inspire them.

“Tony Evers has been a beloved governor of this state, and so I think he would have certainly been able to win a third term if that’s what he wanted to do,” Roys said. “At the same time, I think that there is a real hunger in the party and in the country generally, to see the next generation of leaders getting a chance, and we have a very strong bench in Wisconsin.”

Roys also ran for the U.S. House in 2012, losing in the primary for the 2nd District to U.S. Rep. Mark Pocan. 

Roys said that there is a lot at stake in the 2026 race. The country is at an “incredibly dangerous moment” with the Republican control in Washington, D.C., she said, and Wisconsin Democrats could have a “incredible opportunity” to deliver on an array of issues at the state level, including funding public education, supporting Wisconsin’s public universities and technical colleges, expanding access to health care, addressing the high cost of housing and child care, and protecting peoples’ rights and freedoms. 

For the last five years, Roys has served in the state Senate, including as a member of the Joint Finance Committee, and has been a strong advocate for funding child care and reproductive rights. 

Recalling her time in the Assembly from 2009-2013, including the last session when Democrats held a trifecta, Roys said Democrats didn’t accomplish enough.

“I’m determined to make sure that we do not blow this opportunity,” Roys said. “I think we need strong leadership from our next Democratic governor to make sure that we deliver for people in this state.” 

Roys said she is considering many factors in deciding whether to join the race, including whether she would be the right person for the position, her recent experience and her family, including their security.

Whether she runs or not, Roys said she will work across the state to help Democrats flip both houses. She isn’t up for reelection this year and Democrats have set a goal of winning control of the Senate and Assembly for the first time in over 15 years. 

“My hope is that all the candidates who are considering a run for governor are prioritizing flipping the Legislature,” Roys said. During Evers’ two terms with a Republican majority in both houses, “He wrote great budgets. They threw them in the garbage,” she said. “He wanted to pass a lot of great legislation that Democrats offered in the Legislature, and he could hardly sign many into law, because he was busy with that veto pen.” 

Attorney General Josh Kaul, who would likely be a top candidate if he runs, declined to tell reporters about his plans Friday, saying that it is important to reflect on Evers’ service and “the significance of where we’ve come in the last six and a half years.” 

“I don’t have any announcement today,” Kaul said. “I think in the next several weeks, you’ll hear from a number of people as to where they stand.” 

Kaul was first elected to the statewide position in 2018 and won a second term in 2022 in a close race against Eric Toney, a Republican prosecutor from Fond du Lac County. Since Trump took office for his second term, Kaul has joined several multistate lawsuits to push back on some of the federal government’s actions, including the withholding of funding

Other potential candidates include Milwaukee Mayor Cavalier Johnson and former Lt. Gov. Mandela Barnes.

Democrats and Republicans react to Evers not running for reelection

Gov. Tony Evers announced in a two-minute video Thursday that he would not be running for reelection — launching the first open race for governor in Wisconsin since 2010. 

The decision came after months of waiting as Evers said he wouldn’t make a decision until the 2025-27 state budget was completed. After he signed the budget in early July, anticipation of his decision increased along with debate over whether he would be the best candidate among Democrats. 

Evers said there was “no question” he could win another term, but said that “whether I’d win or not has never been part of my calculus about running again.” He said he won’t run in order to spend time with  his family.

“Wisconsin, the only thing I love more than being your governor is being a husband, a dad, and a grandpa,” Evers said. “For five decades, my family has sacrificed to give me the gift of service. They’re my world. And I owe it to them to focus on doing all the things we enjoy and love doing together.” 

Evers was elected to the office in 2018 — ousting Gov. Scott Walker in a close election. Previously he  served as state superintendent of public instruction from 2009-2019 and was known for his advocacy for public education. 

During his time in office, Evers has worked with Republican and Democratic lawmakers to write four state budgets, using  his partial veto power extensively at times, and signed new, fairer legislative maps into law.

Democrats on Evers not running

Democrats expressed appreciation for Evers’ service and are now considering the future, including who might run for the office.

U.S. Sen. Tammy Baldwin said Evers’ “commitment to every kid’s education, our teachers, and public schools will undoubtedly shape our future for the better and be a cornerstone of his legacy” and that his “steady hand led us through a once-in-a-generation pandemic, and Wisconsin came out the other side with a strong economy, record low unemployment, and a strong sense of community that bonds us all.” 

Assembly Minority Leader Greta Neubauer (D-Racine) said Evers’ election in 2019 “signaled the end of an era of right-wing governance and a new path forward for Wisconsin” and commended him for vetoing Republican bills that would have “harmed Wisconsinites” and working under split government to get “get things done where possible.” She said she respects his decision to do what’s right for him and his family. 

“Making the decision to step away from public office is not easy,” Neubauer said. “As Democrats, we will continue the work of ensuring the will of the people is the law of the land.”

Senate Minority Leader Dianne Hesselbein (D-Middleton) said Evers’ career has been built on “hard work, compassion, service to others, and family.” 

“He has sought and found practical solutions to tough problems, worked across the aisle when he could, and, when that was not possible, he has fought hard for Democratic principles in the face of Republican extremism,” Hesselbein said. 

Sen. Chris Larson (D-Milwaukee) told the Wisconsin Examiner that Evers has been a great “goalkeeper” during his time in office, but said Democrats need someone that will try to make goals. He expressed immense disappointment in the budget deal that Evers and Senate Democrats came to with Republican lawmakers and recently penned a letter, which has received over 40 signatures, laying out expectations for a potential 2026 candidate.

“I for one am glad that the governor is reading the room and ready to pass the torch to the next generation to step forward and to lead in this fight,” Larson said. “Now that he is moving on and not running, I’m excited to see who steps forward and what kind of platforms they are going to have to basically meet the moment, not just on K-12 education, but higher ed, on tackling climate change… [and] talking about health care.” 

Larson said he thinks the decision to step down could help build enthusiasm among the party’s base, which could bode well as Senate Democrats work to flip the Senate to a Democratic majority for the first time in 16 years. 

“It builds an energy, and it builds an excitement,” Larson said.

Larson said he isn’t worried about how a new candidate will match up with a Republican candidate. 

“The Republicans, [who are] all lining up behind a right-wing zealot who demands loyalty and has supporters who have driven themselves to be irrational and violent…,” Larson said, referencing Trump, “they’re all going down with the ship.”

This will be the first open election for Wisconsin governor since 2010. Some of the Democrats who have been mentioned as potential candidates include Attorney General Josh Kaul, Lt. Gov. Sara Rodriguez, Milwaukee County Executive David Crowley, Milwaukee Mayor Cavalier Johnson, state Sen. Kelda Roys, former Democratic Party of Wisconsin Chair Ben Wikler and former Lt. Gov. Mandela Barnes.

Rodriguez thanked Evers for his work in a statement, saying he has led the state with “integrity, compassion, and a deep belief in doing what’s right – even when it’s hard.”  

“There’s still work to do to make sure every family in Wisconsin has a fair shot at a better life – and I’m ready to roll up my sleeves and get to work,” Rodriguez said. 

Crowley told WISN-12 just before the announcement that he needs to speak with his family as he considers whether to run. In a statement, he praised Evers for his work that has supported Milwaukee County, including the passage of Act 12, which reworked local government funding in Wisconsin and gave Milwaukee the ability to levy a new sales tax.

“I’m especially grateful for Governor Evers’ partnership in passing Wisconsin Act 12 and securing new revenues and resources for Milwaukee County, putting us on a path to long-term fiscal stability for generations to come,” Crowley said. “Simply put, Milwaukee County is stronger, healthier, and better off because of the leadership and partnership of Governor Evers.”

According to the Associated Press, Barnes, who lost the 2022 U.S. Senate race against Republican Sen. Ron Johnson, said he is “considering” running. 

Republicans pan Evers’ record  

Two Republican candidates, Washington Co. Executive Josh Schoemann and Whitefish Bay businessman Bill Berrien, have already launched their campaigns. Other Republicans are still considering whether to run, including U.S. Rep. Tom Tiffany

Schoemann said in a statement that he wouldn’t be “outworked” while running for governor and said any Democratic candidate that runs “will be more of the same status quo but even more extreme than Gov. Evers.” 

“I look forward to contrasting my record of cutting taxes, reducing government and innovative reforms with their woke, radical agenda,” Schoemann said. 

Berrien told reporters on a Zoom call that Evers stepping down would not change his approach to the race. He jumped into the race earlier this month, declaring that he is similar to President Donald Trump, as an “outsider” and businessman. He is the CEO and owner of Pindel Global Precision Inc. and Liberty Precision New Berlin, which are contract manufacturers that make machined parts.

“We have a vision and a mission of where we need to take Wisconsin,” Berrien said. “Now that it’s not going to be Gov. Evers that I’m running against, it’s going to be someone probably sharply like him, so, you know, we’ve got our plan. We are aggressively getting around the state, listening and crafting a vision and a strategy.” 

Tiffany fell short of saying whether he would run for the office in a social media post, but said Evers “leaves behind a legacy of decline” and said the state needs to change course before “we end up like MN and IL.” 

Former Gov. Scott Walker also made a cryptic post on social media following the announcement, saying “interesting” with a photo of a red hat with the slogan “Make Wisconsin Great Again” and the numbers 45 and 47, referencing nonconsecutive terms served by President Donald Trump.

Assembly Speaker Robin Vos (R-Rochester) took a more cordial tone, wishing Evers and his wife well.

“No matter what side of the aisle we stand on, the decision to run for statewide office comes with many personal sacrifices that are worthy of recognition,” Vos said. “I want to thank Governor Evers for his service to the state of Wisconsin.”

Republicans have struggled to win statewide elections in Wisconsin in recent years, with the candidates the party supported losing  the last three state Supreme Court races, the last two governor’s races, the last two state superintendent races and the last U.S. Senate race.

Republican Party of Wisconsin Chair Brian Schimming said in a statement on  Evers’ decision to step aside that he  “saw the writing on the wall: Wisconsinites are fed up with far-left policies.” 

“While Wisconsin Democrats continue to lose the approval of voters, Republicans are already working on winning up and down the ballot,” Schimming said.

Wisconsin Democratic Gov. Tony Evers announced he will not seek a third term in office Thursday — triggering a competitive Democratic primary ahead of the 2026 general election to fill the office.

In a two-minute video posted to social media, Evers said that he wouldn’t be running for reelection despite being sure he could win a third term, because he wants to spend more time with his family.

“I began my run for governor as a proud Plymouth Progressive, and that’s still who I am today. I’m a science teacher at heart who ended up running for office and winning five straight statewide elections,” Evers said. “So, would I win if I ran a sixth time? Of course. No question about that. But whether I’d win or not has never been part of my calculus about running again.”

“Here’s the truth: Wisconsin, the only thing I love more than being your governor is being a husband, a dad, and a grandpa. I’ve spent 50 years in public service. I’m damn proud I devoted my entire career — and most of my life — to working for you. And from Plymouth to Baraboo, Tomah to Oshkosh, Verona to Madison, and everywhere in between, Kathy and my family supported me all the way,” Evers said. “For five decades, my family has sacrificed to give me the gift of service. They’re my world. And I owe it to them to focus on doing all the things we enjoy and love doing together. It’s why, Wisconsin, I’m announcing that I will not be running for a third term.”

Evers had said he would make a decision following the end of the budget cycle, and after he signed the new budget in early July, public debate about whether Evers should run began picking up steam. Some Democrats, including Rep. Mark Pocan and newly-elected Democratic Party of Wisconsin Chair Devin Remiker, expressed their hopes that Evers would run. Some Democratic state lawmakers expressed opposition to a third Evers term. .

Evers was first elected to the office in 2018, ousting Republican former Gov. Scott Walker in a close election and placing a Democrat in office for the first time in eight years. Weeks before he entered office Republican lawmakers sought to strip him of some of his executive powers before he even took office.

Prior to his governorship, Evers served as the Superintendent of Public Instruction from 2009-2019 and was known for his advocacy for public education.

Democratic Wisconsin Gov. Tony Evers won’t seek third term

Wisconsin’s Democratic governor, Tony Evers, announced Thursday that he will not seek a third term in 2026, creating the first open race for governor in the battleground state in 16 years.

It will be Wisconsin’s highest-profile race next year as Democrats also angle to take control of the Legislature thanks to redrawn election maps that are friendlier to the party. They are also targeting two congressional districts as Democrats nationwide try to retake the House.

The Legislature has been under Republican control since 2011, and some Democrats had hoped that Evers, 73, would run for a third term to give him a chance to potentially work with a Democratic-controlled one.

In a video announcing his decision, Evers said he was “damn proud” of working 50 years in public service. But he said it was time to focus on his family.

“For five decades, my family has sacrificed to give me the gift of service,” Evers said. “They’re my world and I owe it to them to focus on doing all the things we enjoy and love doing together.”

Possible candidates

The open race is sure to attract several Democratic and Republican candidates. Democrats mentioned as potential candidates include Attorney General Josh Kaul, Lt. Gov. Sara Rodriguez, former Lt. Gov. Mandela Barnes, state Sen. Kelda Roys, Secretary of State Sarah Godlewski, Milwaukee Mayor Cavalier Johnson and Milwaukee County Executive David Crowley.

Washington County Executive Josh Schoemann and suburban Milwaukee businessman Bill Berrien are running as Republicans. Others, including U.S. Rep. Tom Tiffany and state Senate President Mary Felzkowski, are considering it.

Berrien, in a statement reacting to Evers’ decision, said the governor was “too scared to run” on a “record of failure.”

“I’m going to spend the next 15 months making sure whoever the Madison liberals pick from their bench of radical career politicians learns the same lesson,” Berrien said.

Tiffany said in a statement that Evers “leaves behind a legacy of decline” and “it’s time we change course.” But he stopped short of saying whether he would run.

Kansas Gov. Laura Kelly, chair of the Democratic Governors Association, said whichever Republican wins the primary will be “too extreme for Wisconsin,” and she pledged to keep the office under Democratic control.

The last open race for governor was in 2010, when Democratic incumbent Jim Doyle, similar to Evers, opted not to seek a third term. Republican Scott Walker won that year and served two terms before Evers defeated him in 2018.

The only Wisconsin governor to be elected to a third four-year term was Republican Tommy Thompson, who served from 1987 to 2001. He resigned midway through his fourth term.

Evers won his first race by just over 1 percentage point in 2018. He won reelection by just over 3 points in 2022.

Before being elected governor, Evers worked for 10 years as state superintendent of public instruction after a career as a teacher and school administrator.

Evers often clashes with Republicans

Evers has drawn the ire of President Donald Trump’s administration, and his tenure has been marked by his often contentious relationship with the Legislature.

Before Evers even took office, Republicans convened a lame-duck session to pass a package of laws to weaken his power.

Evers angered Republicans during the COVID-19 pandemic in 2020 when he ordered schools and nonessential businesses to close, issued a statewide mask mandate and tried, unsuccessfully, to delay the state’s April presidential primary.

Republicans broke with tradition to reject 21 Evers appointees. They also blocked many of his proposals, including expanding Medicaid, legalizing marijuana and spending more on child care, K-12 schools and higher education.

Evers used his broad veto powers to stop Republicans from enacting a wide range of conservative priorities, including making voting requirements more strict, expanding gun rights, growing the private school voucher program and making abortions more difficult to obtain.

But Evers did work with Republicans to pass the most recent state budget, which included $1.5 billion in tax cuts prioritized by the GOP and more funding for both K-12 special education and the Universities of Wisconsin. Evers also worked with Republicans to keep the Brewers in Milwaukee and funnel more money to local governments.

Evers pushed for the redrawing of Wisconsin’s legislative boundary lines, which the state Supreme Court ordered after liberal justices gained a majority in 2023.

The maps drawn by Republicans, which had been in place for more than a decade, were widely regarded as among the most gerrymandered in the country. The new maps drawn by Evers are more favorable to Democrats and helped them pick up seats in last November’s election. Democrats are optimistic that they can win control of at least one legislative chamber next year.

Evers waited until after he signed the state budget before making his retirement announcement.

Evers positioned himself as a folksy governor who would sprinkle the occasional mild swear word into his comments and other Midwestern colloquialisms such as “holy mackerel” and “folks.” His mild-mannered demeanor stood in stark contrast to Trump and other political firebrands.

“I think he is the most quintessential Wisconsin politician I’ve ever seen,” said Democratic U.S. Rep. Mark Pocan, who has been in elected office since 1991.

After winning reelection in 2022, Evers noted that he is frequently described as boring, but said: “As it turns out, boring wins.”

Lawmakers again seek to reverse Gov. Evers’ veto allowing school revenue cap increases for 400 years

A handful of Republican lawmakers are seeking, again, to take away schools’ authority to raise their school revenue limits by $325 per pupil annually for the next four centuries, given to them through a partial veto by Gov. Tony Evers. 

Reps. Dave Maxey (R-New Berlin) and Jim Piwowarczyk (R-Hubertus) alongside Sens. Chris Kapenga (R-Delafield) and Steve Nass (R-Whitewater) said in a memo that the bill would put “property tax decisions back into the hands of local voters and taxpayers where they belong.” 

“The pilgrims landed at Plymouth Rock 402 years before this veto,” the lawmakers said. “It is hard to justify locking in a funding increase for just as long into the future.” 

In the 2023-25 state budget bill, lawmakers included a $325 increase to schools’ revenue limits for only two years, 2023-24 and 2024-25. When the bill made it to Evers, he exercised his partial veto power, striking two digits and a dash from the years to extend the annual increases through 2425 — an additional 400 years. 

In the last state budget, the Legislature allocated money to school general aid to support the revenue limit increase. The new state budget approved earlier this month did not include any general aid increase meaning that if school districts decide to use the $325 per pupil revenue increase, it will come solely from property taxes. The increase is not automatic and would need to be approved by individual school boards.

The partial veto was controversial at the time with Republican lawmakers complaining that property taxpayers would be burdened by the veto and Evers had broken the deal with lawmakers. Evers defended it, saying he was giving schools a reliable annual funding increase. Republicans sued, attempting to get the veto declared unconstitutional, but the state Supreme Court upheld it in April, saying it was within Evers’ constitutional powers.

Evers celebrated that decision, saying at the time that schools deserve “sustainable, dependable, and spendable state support and investment.” 

“For over a decade, the Legislature has failed to meet that important obligation,” Evers said in April. “Importantly, this decision does not mean our work is done — far from it.” 

The bill faces a difficult path to becoming law as it would need to pass the Assembly and Senate and not be vetoed by Evers.

The bill authors also complained about the governor’s vast veto power, which is one of the broadest in the nation. 

“This use of that power has gone way too far,” the lawmakers said. They referenced the dissent from Justice Brian Hagedorn in the lawsuit, saying that the veto gives the governor “monarchical” powers.

The power has been curtailed in the past through state Supreme Court rulings, including recently when the Court unanimously ruled in another case that one of Evers’ partial vetoes was unconstitutional. Wisconsin governors have also lost some of their considerable partial veto authority through constitutional amendments. 

Evers’ 400-year veto led Republican lawmakers to introduce constitutional amendment proposals that would limit the power further. A constitutional amendment would need to pass the Senate and Assembly twice in consecutive legislative sessions and get approval from voters before it would become law.
