Republican ‘anti-SLAPP’ legislation, opposed by legislator who targeted local paper, fails

A bill that aimed to prevent the use of expensive lawsuits to silence journalists and other members of the public was blocked by the state Senate due to opposition from Sen. Cory Tomczyk (R-Mosinee), who previously imperiled a local Wausau paper. 

Strategic Lawsuits Against Public Participation — also known as SLAPP lawsuits — are a way of intimidating and quieting critics, including journalists and activists, by burdening them with the cost of expensive, baseless legal proceedings. Anti-SLAPP laws aim to provide a remedy.

Rep. Jim Piwowarczyk (R-Hubertus), who coauthored the bill, said in an email to the Wisconsin Examiner that he was “very disappointed that one or two Republican senators would block a bill that would protect everyone’s First Amendment rights.” He said he identified a few senators opposed to allowing the bill to make it to the Senate floor, and made several attempts to contact them and address potential concerns.

“The vast majority of Republicans AND Democrats in the state Legislature supported this bill,” Piwowarczyk said. 

Bill cosponsors included Reps. Elijah Behnke (R-Town of Chase), Lindee Brill (R-Sheboygan Falls), Barbara Dittrich (R-Oconomowoc), Randy Udell (D-Fitchburg) and Sylvia Ortiz-Velez (D-Milwaukee).

Piwowarczyk is the co-founder of Wisconsin Right Now, a conservative publication focused on state government issues. He was elected to his first term in the state Assembly in 2024, and the anti-SLAPP legislation became a top priority because he said he has “seen firsthand how ordinary citizens, citizen activists, influencers, concerned parents and small media outlets are systematically targeted with lawsuits by entities with large or unlimited resources in an attempt to silence them.” 

“These lawsuits weren’t about legitimate grievances; they are a form of legal warfare or lawfare. As the saying goes, ‘The punishment is the process,’” Piwowarczyk said. 

The bill passed on a voice vote in the Assembly in February, but never received a vote in the Senate. 

Wisconsin Right Now cofounder with Piwowarczyk, Jessica McBride, recently accused Tomczyk in a Facebook post of maneuvering behind the scenes to block the bill from a vote. 

Tomczyk has some history with the issue, having prompted the introduction of anti-SLAPP legislation by Democratic lawmakers in 2023. He placed the Wausau Pilot & Review, a small digital newspaper started and edited by Shereen Siewert, in a dire financial situation when he sued the paper for defamation in 2021 after the it published a report that Tomczyk called a young teen an anti-LGBTQ slur at a Marathon County board was meeting. The paper reported that Tomczyk was overheard using the slur as a resolution called “A Community for All,” an effort  to reinforce acceptance of diversity and inclusivity, was being debated. 

According to the New York Times, Tomczyk admitted in a deposition to having used the slur before “out of joking and out of spite” about his gay brother.

The case was dismissed in April 2023 after the judge found that Tomczyk had failed to meet the legal standard for defamation. His appeal of the judgement was dismissed in 2024. Tomczyk’s lawsuit prompted Democratic lawmakers to introduce anti-SLAPP legislation in 2023, although it never advanced in the Republican-led Legislature. 

This session, Piwowarczyk introduced his own proposal, the Uniform Public Expression Protection Act, to curb retaliatory lawsuits and gathered bipartisan support for it. 

Piwowarczyk’s bill would have created a process for courts to quickly dismiss lawsuits that target protected speech or participation in government proceedings, including by requiring a prompt hearing and halting constant discovery while the motion is pending. The bill would have also allowed for the parties that prevailed in court to recover attorney fees. The bill was based on model legislation developed by the nonprofit Uniform Law Commission. 

Piwowarczyk has cited other cases he said prompted the bill, including one in which Moms For Liberty activist Scarlett Johnson was sued for defamation for calling a former teacher in the Mequon-Thiensville School District a “bully,” “lunatic,” “woke” and “white savior” on social media. Johnson eventually got representation from the Wisconsin Institute for Law & Liberty, a conservative legal nonprofit, and her case was dismissed

Wisconsin Right Now is not the only conservative endorser of the legislation. Meg Ellefson, a conservative podcast host, wrote in a Facebook post that she was “very disappointed” and that Tomczyk has a “shallow and myopic view” of the issue.

“This was an opportunity to protect the free speech of conservatives in Wisconsin and likely won’t come around again due to predictions that Republicans will lose control of the state Senate in this next election,” she wrote. 

A coalition of Wisconsin local media stakeholders including Siewert, Freedom of Information Council president Bill Lueders and Wisconsin Watch managing editor Jim Malewitz, signed a letter urging lawmakers to pass the bill and protect journalists and members of the public earlier this month. 

“Amid the many threats facing our communities, it’s more clear than ever that our right to free speech is under attack,” the letter stated. “We firmly believe that this bill is a strong solution to threats against the First Amendment in Wisconsin. By advancing this piece of legislation, lawmakers would be making a wise nonpartisan investment in protecting the speech and civic health of the commonwealth while laying the groundwork for a sustainable, community-rooted local news ecosystem.” 

Wisconsin is one of 11 states in the U.S. that does not have Anti-SLAPP protections in place.

Tomczyk, however, has rejected the claim that he is the only reason did not advance.

“I have to respond to the ridiculous notion that I have somehow made an assault on free speech in our state,” Tomczyk wrote in a Facebook post on Sunday evening. “Most media is dominated by the left with only 2 or 3 right leaning outlets in the entire state. This bill provides more [protection] for the media and does little or nothing for the ordinary citizen.” 

Tomczyk said the bill was discussed during a Republican Senate caucus meeting where he was the only person to speak on the bill. 

“It is in caucus that the Senators who have proposed bills,,, have the opportunity to support and promote their bill if there is opposition to it.” he wrote on Facebook. “When appropriately numbered Senate Bill 666 came up for discussion, I simply told my colleagues to be very careful and make sure they understand what they are voting for,” Tomczyk said. “I was the only Senator to speak against the bill. No Senator spoke FOR the bill.”

In his post, Tomczyk also, again, denied that he ever said the slur at the meeting, noted that he wasn’t a state lawmaker at the time and questioned the effectiveness of the legislation. 

Language in the bill states that one of three criteria that would be used to determine whether a case can be dismissed through the process is if “the responding party fails to establish a prima facie case as to each element of the cause of action or the moving party establishes either that the responding party failed to state a cause of action or that there is no genuine issue as to any material fact and the moving party is entitled to judgment as a matter of law.”

“You got that?” Tomczyk wrote about the language. “Clear as mud right?” 

Piwowarczyk said, however, that many of his colleagues got on board with the legislation after he explained its purpose and some of the examples. 

Sen. Eric Wimberger (R-Gillett) was the lead Senate author. He was not available for an interview with the Examiner, but said in a statement that “we unfortunately didn’t have the votes on Senate Bill 666 in the Senate as we prepared for last week’s floor session.”

The state Senate and Assembly have both adjourned their final regular floor sessions of the year. Work in the Capitol will be minimal for the remainder of the year as lawmakers turn their attention to running for reelection. 

Free Press Action said it would also be advocating for the bill next year.

“SLAPP lawsuits are designed to punish and silence, not to win. Even when dismissed, they can cost defendants tens of thousands of dollars and years in court. When anti-SLAPP laws are enacted, targeted victims can defeat these speech-chilling attacks,” Arin Anderson, the Wisconsin civic media campaign manager for Free Press Action, said in a statement. “Passing this broadly supported bill would send a clear message: Wisconsin stands up for free speech, open debate and the right of people to hold the powerful accountable. 

When lawmakers return in January 2027, the makeup of both the state Assembly and Senate could be quite different, with Republican leaders and other incumbents retiring and Democratic lawmakers eyeing majorities. 

“I look forward to reintroducing the bill next session and working with my colleagues to protect Wisconsin residents from meritless, anti-speech lawsuits,” said Wimberger, who is not up for reelection. 

Piwowarczyk said reintroducing the bill at the start of the next legislative session will be one of his first actions should he be elected to another term in office. 

“This bill is bipartisan, so regardless of what happens in November, I expect to have wide support again,” he said.

Where Is the Bus?

At 6:42 a.m., a parent refreshes an app on their phone for the third time in two minutes,
watching a small bus icon inch—or not—across a digital map. In school districts across the
country, that moment has become part of the daily routine.

When they work, they build trust. When they don’t, the breakdown is immediate, public and loud. School bus tracking apps, once marketed as a simple way to reduce anxiety and improve communication, continue as a high-visibility link between transportation departments and families.

Growing Pains
While many schools across the country are quite satisfied, some have had problems.
Osceola School District in Florida launched an app at the start of the school year. By January, the district was forced to notify families that the app was not functioning properly. The school district is still trying to work out its glitches.

Prince George’s County Public Schools, which operates roughly 1,000 bus routes daily in Maryland outside of the nation’s capital, adopted a mobile app to give parents real-time tracking and schedule alerts. Persistent reliability issues and mounting parent complaints
prompted the district to abandon the platform and migrate to a new app instead.

Tech Hiccups Aside, Bus Tracking Apps Experience Growing Use and User Satisfaction

Despite technical hiccups, data-integration challenges and the pressure of public scrutiny, school bus tracking apps have become common implementations in pupil transportation.

The Houston County School District in Perry, Georgia has used CalAmp technology for its school bus fleet since 2019 to much satisfaction. The district has 265 school buses that transport approximately 16,000 students twice a day on 180 bus routes. Houston County
initially partnered with CalAmp to utilize the core technology of GPS fleet tracking, comparative analysis, time and attendance, navigation, and engine diagnostics. After its initial installation, the school district added the Here Comes the Bus parent app.

“The fleet tracking system is a world above our previous product and gives us the ability to know instantly the location of a bus, its speed, its status on the route, as well as a history of the buses’ activity,” explained Tom Walmer, Houston County’s director of transportation.

“The tracking system as well as the dispatch monitor module allows staff to have real-time data available to ensure buses are on their routes which stops have been completed, which stops may have been missed, and enhances our ability to address emergency situations as they arise. The navigation capability makes the job of a bus driver much easier and safer. No more need for inexperienced drivers or substitute drivers to fumble with route sheets or printed directions because it is all on the tablet, giving them directions and stop location notifications. Comparative analysis and engine diagnostics are essential tools for supervisors and staff to monitor performance and eliminate issues that we may not have known about otherwise.”

Houston County Schools is not the only district in Georgia to have had success with CalAmp. Trey Stow, the director of transportation operations for Fulton County Schools serving the Atlanta metropolitan area, said over 89,000 users within the school district also use CalAmp Here Comes the Bus app. Stow says the app “works well and is heavily relied upon.”

The experiences of Houston County and Fulton Country are catching on for many other school districts as usage of bus tracking apps continues to grow.

“We are up to 1.7 million active users,” Adam Ortlieb, senior product marketing manager at CalAmp, said. “Parents expect this capability for improved student safety and more efficient use of their time. School districts are aligned on those priorities. Plus, both transportation staff and parents benefit heavily from efficiency gains.”

Integration is Key
Lam Nguyen-Bull is the chief experience officer at Edulog and leads the company’s advisory services team. Edulog claims it is the original school bus routing software company and has been providing routing and planning software solutions to districts across North America since 1977. Nguyen-Bull said a key attribute to success is integration with other software and applications such as routing and GPS systems as well as scanning systems that register students boarding the bus.

“The reality is that many parents currently track their kids via their cell phones,” she said. “The key is that a useful student ridership application has to be completely integrated with the routing system to provide information that is specific to the student’s trips to and from school. The app needs to let parents know when the bus is planned to arrive at the stop and then give the parents a heads up when the bus is nearby. Then, as the student boards the bus, the ridership piece kicks in. The student scans on with an RFID card, maybe a bar code, or the driver “boards” the student on a mobile data terminal (tablet) application. Parents are notified in the app that the student has boarded the bus. Similarly, the parents are notified when the student exits the bus. This might happen a couple of times each morning if the student transfers buses during their trip to school.”

Once implemented and adopted, it’s important for schools to monitor the utility of new apps and features, as well as their effectiveness.

Houston County School District pays attention to the data metrics readily available as subscribers to the CalAmp applications.

“We currently have approximately 15,536 stakeholders utilizing the HCTB app notifications,” said Walmer. “That number is an indication of the success of the roll out. When my staff takes parent calls about bus stop locations and times, it is our practice to ask if the parent utilizes the app. The majority of the time, the answer is yes and includes positive comments. If they do not use the app, it is our practice to bring it to their attention and encourage them to download the app. A testament to the popularity of the app is away from work while in the community. Whether at church, the grocery store or such, when a person finds out that we work at the school district transportation department, people give unsolicited feedback about how much they love the app.”

Stow with Fulton County Schools said app usage indicates when there might be an issue like a school bus driver forgetting to log into a route.

“The phone calls tend to increase in measure and expose an issue,” he said. “CalAmp provides excellent customer service with their team and always resolves any issues quickly which helps us provide the best service possible.”

App Features ‘Wish List’ Continues to Grow

While bus tracking apps are progressing along a curve of early integration, there are many features that users and app producers wish to see.

“We are currently in the process of implementing an existing feature of the Cal-Amp technology and Here Comes the Bus: Student ridership scans,” said Walmer. “We piloted the ridership scans in May of 2025 and had new hardware installed on all of our buses over the summer. We did a soft roll out of the scans at the beginning of this school year and will have full implementation later this month. This is another excellent feature that enhances student safety. Transportation department and school staff have the ability to see from their computers what students are on any given bus in real time, or search for an individual student to see what bus a student is on. It also allows us to see where and when a student boarded or exited a bus. This enhances our drivers’ ability to be successful by notifying them when a student scans whether they are an eligible rider or not, and whether they are the assigned bus or not. It will also notify the driver when a student scans to exit the bus at a stop other than their assigned one.”

Transfinder is another producer of apps for pupil transportation. “Based on what Transfinder is hearing from our clients as well as from the industry at large, a common wish list of items include predictive ETA adjustments [and] not just real-time location, but responsive to outside forces such as traffic, localized emergency alerts, notifications specific to route disruptions due to weather, accidents, or school closures with recommended alternatives,” said spokesman Rick D’Errico.

He continued, “If alerts are tailored to just those impacted, the likelihood of parents not silencing their alerts is increased, and language [translation] for multilingual support.”

Edulog’s Nguyen-Bull said gaps are in daily operations. “Try as we might, we have not come up with a card that can’t be lost or misplaced,” she said. “That’s why it is so beneficial to have a Plan B, for example, an interface that allows a bus driver to mark that a student has boarded the vehicle. Districts find out that this becomes an onerous task for drivers if it gets out of hand. That is, if Plan B is invoked too much. Some districts charge families for replacement cards, but that approach has its shortcomings, too.”

Ortlieb of CalAmp added the company is releasing more advanced safety, security and efficiency features. “For example,” he explained, “giving districts the option to prevent bus location details from appearing on a map until the vehicle enters the radius specified by the district. Single sign-on for the parent app is a very well-received new enhancement. It offers simplified, secure parent access, and allows districts to systematically manage passwords and deprovision users who should no longer have access.”

Bus Tracking Apps Are Becoming Standard

As school transportation continues its steady adoption of digital technologies, bus tracking apps are no longer experimental add-ons. They are now core service expectations. The experiences of districts highlighted show both sides of that reality: Early frustrations when systems falter, and measurable gains in efficiency, safety, and parent confidence
when technology is implemented thoughtfully and supported consistently.

The most successful deployments share common traits—tight integration with routing and dispatch systems, strong vendor support, clear communication with families, and ongoing measurement of adoption and performance.

Just as important, districts are learning that technology alone is not enough. Daily operational discipline, driver training, and contingency planning remain critical to success.

As features evolve from basic location tracking to predictive ETAs, ridership verification, and targeted alerts, the value proposition will only grow. For transportation leaders,
the takeaway is clear: Bus tracking apps, when executed well, reduce uncertainty, strengthen trust, and transform how districts connect with the families they serve turning a once anxious morning ritual into a more predictable, transparent start to the school day.

Wisconsin Assembly passes anti-SLAPP legislation

The Wisconsin Assembly passed a bill to protect against lawsuits intended to discourage news coverage and quiet speech, as well as measures requiring schools to adopt policies on appropriate communications between staff and students and establishing a definition of antisemitism during a Tuesday floor session.

Assembly lawmakers plan to meet again on Wednesday and Thursday to vote on legislation with the intention of wrapping their work up this legislative session by the end of the week. Lawmakers did not complete votes on every bill they had scheduled before recessing for the State of the State address in the evening. 

Anti-SLAPP legislation passes

AB 701, to protect people from Strategic Lawsuits Against Public Participation (SLAPP), passed on a voice vote. It now goes to the Senate for consideration. 

Rep. Jim Piwowarczyk (R-Hubertus), who is the co-founder of the right-wing publication Wisconsin Right Now, said the bill would strengthen protections for free speech and civic participation and ensure that citizens aren’t silenced through “abusive litigation.” 

“The bill creates a clear, efficient process for courts to quickly dismiss lawsuits that target protected speech or participation in government proceedings. It requires a prompt hearing and stays constant discovery while the motion is pending. It also allows prevailing parties to recover attorney fees,” Piwowarczyk said. “These protections help prevent the chilling effect prolonged and expensive litigation can have on free expression.”

The bill is based on model legislation developed by the nonprofit Uniform Law Commission. 

“It’s a legal tactic … designed to punish someone through stressful, time consuming and expensive litigation,” Rep. Andrew Hysell (D-Sun Prairie) said about SLAPP legislation on the floor, adding that these types of lawsuits target people “simply because they choose to exercise their First Amendment rights to speak.” 

“It’s overdue that an anti-SLAPP statute be added to Wisconsin laws. We need to protect our citizens’ First Amendment rights and protect those rights from legal retribution,” Hysell said. 

School communication policies

Lawmakers concurred in SB 673 in a 92-7 vote. It would require public school districts and private schools to adopt policies related to appropriate communications between staff and students. The bill will now go to Gov. Tony Evers for consideration. 

Schools would need to adopt new policies by Sept. 1, 2026 under the bill. 

The bill is one of several that lawmakers introduced in reaction to a November report from the CapTimes that found over 200 investigations into teacher licenses due to allegations of sexual misconduct or grooming from 2018 to 2023.

Rep. Amanda Nedweski (R-Pleasant Prairie) said the bill would protect staff and students. The bill includes requirements that the policies include standards for appropriate content and appropriate methods of communication as well as training in identifying, preventing and reporting grooming and professional boundary violations.

The bill, Nedweski said, will protect students from “potentially predatory behavior with clear proactive protections, while also protecting well-intentioned employees who work every day with integrity and professionalism — protecting them from finding themselves in compromising situations where a misunderstanding or a false allegation could cause serious reputational harm.” 

The bill also requires that policies include consequences for employees or volunteers who violate the rules.

Private schools were included through an amendment to the bill. 

“As a parent of two public school kids, we should be doing whatever we can to make sure that our kids are safe in schools,” Rep. Mike Bare (D-Verona). said. “One of the most troubling things we heard in the series of legislative hearings on this topic is that kids who were in private schools are less safe than those who are in public schools. That’s because educators in private schools are not required to be licensed.” 

Antisemitism definition

AB 446 passed 66-33 with 11 Democrats joining Republicans in favor. The controversial bill would codify the definition for antisemitism adopted by the International Holocaust Remembrance Alliance in 2016. It states that antisemitism is “a certain perception of Jews, which may be expressed as hatred toward Jews. Rhetorical and physical manifestations of antisemitism are directed toward Jewish or non-Jewish individuals and/or their property, toward Jewish community institutions and religious facilities.”

The bill would require local and state governmental agencies to consider the IHRA definition and its examples when investigating allegations of racial, religious or ethnic discrimination.

Rep. Supreme Moore Omokunde (D-Milwaukee) said he was concerned that the bill would infringe on people’s First Amendment rights. 

“Many Jewish and Muslim work groups have come together to use this definition to establish a framework to help understand what antisemitism is,” Moore Omokunde said. But, he added, the intention was not for the definition to be codified into law.

Moore Omokunde said he is worried that the bill could be used to punish people for speaking out against  the actions of the Israeli government.

Rep. Lisa Subeck (D-Madison), who is Jewish, said she was frustrated with the opposition to the bill. 

“Antisemitism is real. We hear again and again, particularly since October 7th, that when acts of antisemitism occur, they’re not really antisemitic,” Subeck said. “I don’t spend a lot of time when somebody tells me about an act of homophobia, I don’t debate whether it was really homophobic. When somebody who has been a victim of bias, discrimination and worse, tells me what happens to them, I believe it.”

Subeck said the bill is the Legislature’s opportunity to take a “firm stand” against antisemitism.

The bill is now in the Senate.

The Assembly also passed a bill that would prohibit people from serving as a state Supreme Court justice or as a judge of a court of record after the age of 75; AB 640 passed on a 54-45 vote along party lines.

The four icons at the top of the home screen allow quick access to information on Schedules, Speakers, Exhibitors and the Activity Feed. The home screen includes shortcuts to the Scavenger Hunt, Trade Show Floor Plan, list of Attendees, and Event Information.

Use the Schedule tab to see all the available sessions and select the star button next to your chosen ones to create personalized schedules for the week.

From the app homepage, access lists of Attendees and Trade Show Exhibitors. Send connection requests to other attendees and mark the star next to vendors you connect with to keep the conversations flowing even after the conference.

Share your thoughts! After each session, complete a three-question survey to provide feedback. Near the end of the conference, an overall evaluation will be available for your general impressions. Your input is greatly appreciated!

The Race to the Finish Challenge Scavenger Hunt starts on Sunday evening’s Technology Demonstrations and Ride & Drive + Reception. Complete all sponsor demos and scan QR codes on the app to earn a spin at the prize wheel.

The fun continues with the Pit Stop Challenge on Monday, March 30, the day of the Trade Show. Visit vendor booths to scan QR codes and unlock questions to answer. The more booths you visit and correct answers you give, the faster you climb the leaderboard toward some end zone prizes!
