Trump attacks immigrants using racist language during State of the Union

WASHINGTON — President Donald Trump repeated his hardline stance on immigration during his record-long State of the Union on Tuesday, previewing a potential midterm campaign message as his party faces an uphill battle to keep a majority in the House.

“The first duty of the American government is to protect American citizens, not illegal aliens,” Trump said.

His nearly two-hour speech before Congress came on the 11th day of a partial government shutdown affecting the Department of Homeland Security. He called on Democrats to immediately fund the agency. 

Democrats have refused to approve new funding for DHS unless changes are made to enforcement tactics following the deaths of two U.S. citizens in Minneapolis at the hands of federal immigration officers. 

Another vote to move forward on approving funding for DHS failed, 50-45, Tuesday mere hours before the president’s address to Congress.

Immigration enforcement has continued during the shutdown because the department has a separate funding stream Congress provided last year through the massive tax cuts and spending package. 

Rhetoric remains

Despite the controversy the months-long immigration operation in Minneapolis has created, Trump defended the operation and his views on immigration more generally, possibly signalling he does not plan to tone down his rhetoric in an election year.

He made racist remarks about the Somali refugee population in Minneapolis, referring to them as “Somali pirates” and accusing them of widespread fraud

He blamed the Biden administration for “importing these cultures through unrestricted immigration and open borders.” 

“We will take care of this problem,” he said.  

Trump also made another racist remark that immigrants “don’t speak English,” and called on Congress to pass legislation to bar immigrants in the country without legal authorization from obtaining commercial drivers licenses.

He also called for Congress to end so-called sanctuary cities, local jurisdictions that have policies to bar cooperation with the federal government’s immigration enforcement. 

Trump also called for Congress to pass a national voter ID requirement law to require proof of citizenship to register to vote in federal elections. 

The president did give a passing endorsement of legal immigration, saying early in the speech he would “always allow people to come in legally, people that will love our country and will work hard to maintain our country.”

Many of the groups he has targeted as president, though, including Minnesota’s Somali population, have legal authorization to be in the country.

Padilla blasts Trump approach

Democrats have seized on the unpopularity of the Trump administration’s immigration crackdown, where residential areas have experienced masked immigration agents and roving patrols. 

In a rebuke to Trump’s Speech, California Sen. Alex Padilla gave the Democratic response that aired across Spanish networks. 

“This country has always been shaped by people who were told they did not belong, but who persevered and kept moving forward,” he said in Spanish.

Last summer, federal law enforcement officials forcibly removed and handcuffed Padilla at a press conference by Homeland Security Secretary Kristi Noem in Los Angeles during protests against the Trump administration’s immigration crackdown in the city.

The incident represented a stark escalation of tensions between Democrats and the Trump administration after the president ordered 4,000 National Guard troops and 700 Marines to quell the protests in Los Angeles. 

After Padilla, California’s first Latino senator, was released, he gave an emotional speech on the Senate floor that accused the president of using his home state as a testing ground for deploying the U.S. military domestically. 

In his response Tuesday, he addressed the incident at the Noem press conference.   

“They may have knocked me down for a moment, but I got right back up,” Padilla said. “As our parents taught us, if you fall seven times, get up eight. I am still here. Standing. Still fighting. And I know you are still standing and still fighting too.”

Updated: EPA Seeks to Expand Fuel Scope of Clean School Bus Program

The U.S. Environmental Protection Agency is issuing a request for information from school bus industry stakeholders as it seeks to add biodiesel, renewable diesel (RD) and liquefied natural gas (LNG) as funding options to a revised Clean School Bus Program.

EPA also said it will not be awarding funds for the 2024 CSB Rebate Program. “EPA thanks applicants for their interest and encourages them to apply for the new grant program,” EPA said in a press release Thursday. “The agency will provide more details on the 2026 grants and eligibility requirements in the near future through a Notice of Funding Opportunity.”

In a follow-up email sent by School Transportation News asking for clarification on foregoing the 2024 rebate awards and if those same applications would be recycled, EPA referred to its original statement.

Meanwhile, Thursday’s RFI also mentions hydrogen as an eligible fuel listed by the Investing in Infrastructure and Jobs Act, which created the five-year, $5 billion fund. But there are currently no hydrogen school buses in production. The same goes for liquefied natural gas, which differs from propane. The IIJA also mentions CNG, which won a handful of awards, but manufacturers don’t currently produce that fuel option, either.

Diesel-powered school buses do exist in large numbers nationwide, estimated at about 80 percent of the national fleet of approximately 450,000 vehicles. Many operate with biodiesel blended with regular diesel. The RFI specifically states EPA seeks information on B20, or 20 percent biofuel blend with diesel.

Renewable diesel, or RD, is different from biodiesel as the former is produced by a hydrotreating process, making it a hydrocarbon fuel. Because it is otherwise nearly identical to petroleum diesel, RD is a drop-in fuel alternative that diesel engine manufacturers certify for use in their engines without voiding warranties. But RD is more expensive than petroleum diesel except in California, Oregon, New Mexico and Washington, where Low Carbon Fuel Standard credits are at play.

Electric school buses are not a focus of the RFI because EPA said it has sufficient information on its infrastructure, availability and performance.

EPA added electric school buses have accounted for 90 percent of Clean School Bus Program awards to date, and the next funding round should target other allowed alternative fuels “to allow for the maximum number of affordable bus choices to fit school districts’ specific needs.”

What’s in the RFI?

EPA is asking the current availability and anticipated purchasing within the next year to five years of biodiesel, RD, E85 flex fuel, CNG, LNG, propane or any other biofuel and if those school buses are fueled at the school district facility, an offsite private fueling station, or an offsite public station. EPA also wants to know about fuel supplier arrangements.
Specifically for biodiesel and RD, EPA is asking for details on how the blends or drop-in fuels are used.

It requests information on fueling system components, pricing, construction and installation requirements, performance, domestic content, and other practical considerations.

The RFI also states EPA wants information on how it can further safeguard taxpayer dollars. The agency completed an internal review to assess financial management practices and said it uncovered inconsistent documentation, incomplete adherence to reporting an award conditions, improper or premature drawdowns of funds, and insufficient internal controls by certain awardees, including for profit recipients.

EPA said it is “evaluating additional safeguards and conditions for for-profit entities,” which includes audits of financial statements and conflict of interest policies. It is also considering verification tools or documentation to ensure appropriate bus usage and routes before funds are disbursed; milestone-based payment structures, reimbursement-only models, or phased disbursement mechanisms tied to verified delivery to reduce risk and improve accountability; and enforcement mechanisms such as repayment obligations or clawback provisions in cases of nonperformance, noncompliance, or misuse of funds.

The Clean School Bus Program is set to expire at the end of the current fiscal year, which would require the remaining $2 billion that has yet to be awarded needing to rollout over the next six months.

Public comments are due within 45 days of EPA publishing the RFI in the Federal Register. A webinar is scheduled for March 3.

Temporary legal status allowed for now for 350,000 Haitians as judge blasts Kristi Noem

WASHINGTON — A federal judge late Monday blocked the termination of temporary protections for roughly 350,000 Haitians from taking effect, a move that prevents the Trump administration from acting to deport them as litigation continues. 

In a searing 83-page order, District of Columbia federal Judge Ana C. Reyes found that Homeland Security Secretary Kristi Noem does not have “unbounded discretion” to terminate Temporary Protected Status for Haiti and rejected the Trump administration’s arguments that ending the status is  in the public interest. 

“Secretary Noem complains of strains unlawful immigrants place on our immigration-enforcement system. Her answer? Turn 352,959 lawful immigrants into unlawful immigrants overnight,” Reyes wrote. “She complains of strains to our economy. Her answer? Turn employed lawful immigrants who contribute billions in taxes into the legally unemployable. This approach is many things—in the public interest is not one of them.”

The decision came the day before hundreds of thousands of Haitians were at risk of losing their work permits and deportation protections, opening them up to removal. 

The Trump administration has moved to strip the legal status of immigrants, as many as 1.5 million, by ending the TPS designation and revoking humanitarian protections initially granted under the Biden administration. So far, Noem has ended TPS for 12 countries.  

Other judges found Noem overreached

Reyes said the Trump administration would face no harm by allowing TPS recipients from Haiti to keep their legal status while they challenge Noem’s move to end their status. 

Last year, Noem initially tried to remove extended protections for TPS holders from Haiti granted under the Biden administration, which meant protections would end by August. But several judges found that move from Noem an overreach of her authority. 

TPS is usually granted for 18 months to nationals who hail from a country deemed too dangerous to return to due to violence and instability. 

In her order, Reyes cited contradictions by the Trump administration in its attempts to end TPS for Haiti. She pointed to Noem’s argument that conditions in Haiti have improved, but at the same time the State Department has a “do not travel” advisory for Haiti because of violence. 

There has been escalating gang violence in Haiti since the assassination of the country’s president in 2021. 

“There is an old adage among lawyers. If you have the facts on your side, pound the facts. If you have the law on your side, pound the law. If you have neither, pound the table,” Reyes wrote. “Secretary Noem, the record to-date shows, does not have the facts on her side—or at least has ignored them. Does not have the law on her side—or at least has ignored it. Having neither and bringing the adage into the 21st century, she pounds X (f/k/a Twitter).”

Reyes was nominated by former President Joe Biden.

‘Hostility to nonwhite immigrants’

Reyes added that one of the arguments from the plaintiffs – Haitian TPS recipients – that Noem “preordained her termination decision and did so because of hostility to nonwhite immigrants,” is likely substantial.   

Reyes also pointed to the 2024 presidential campaign, where President Donald Trump and Vice President JD Vance spread false rumors claiming Haitians in Springfield, Ohio, ate residents’ pets. 

In her order, she said Trump referred to those Haitians with TPS as being in the country without legal authorization, despite their legal status, and recalled how the president vowed to revoke “Haiti’s TPS designation and send ‘them back to their country.’”

There are five Haitian TPS recipients who are plaintiffs in the case. They argued that Noem violated the Administrative Procedure Act, the process of how agencies issue regulations, by ending TPS for Haiti. 

Those recipients include Fritz Emmanuel Lesly Miot, who is a neuroscientist researching Alzheimer’s disease who has had TPS since 2011; Rudolph Civil, a software engineer at a national bank who was granted TPS in 2010; Marlene Gail Noble, a laboratory assistant in a toxicology department who’s been a TPS recipient since 2024; Marica Merline Laguerre, an economics major at Hunter College and a TPS holder since 2010; and Vilbrun Dorsainvil, a full-time registered nurse and TPS holder since 2021.

A reprieve

This is not the first time the Trump administration has tried to end the TPS designation for Haiti, but the courts blocked those attempts in 2018.

Monday’s decision came as a brief relief for immigrants and advocates in Springfield, Ohio. 

“This 11th hour reprieve is, of course, welcome,” Ohio Immigrant Alliance Executive Director Lynn Tramonte said in a statement. “But people can’t live their lives like this, pegging their families’ futures to a court case. The least this country can do is honor their strength and contributions by giving them a permanent home.” 

EPA ‘Revamping’ Clean School Bus Program

The U.S. Environmental Protection Agency (EPA) updated its website with a statement that a “revamped and modernized Clean School Bus Program” is coming soon.

The five-year, $5-billion fund has been on hiatus since President Donald Trump returned to the Oval Office last January, days after the application period for the 2024 Clean School Bus Rebates closed.

But funding ground to a halt, leaving hundreds of school districts waiting to see if their electric and propane school bus projects could continue.

EPA said last summer it has been working with school districts to award rebate and grant awards for fiscal years 2022 and 2023, while holding off on providing details for new funding, pending a program review. The new website statement, reiterated to School Transportation News by the EPA press office, indicates an update on the Clean School Bus Program is in the works.

“EPA is actively reviewing and revamping the Clean School Bus Program in accordance with President Trump’s Executive Order Unleashing American Energy to ensure hard-earned American tax dollars are being put to the best use possible and not frivolously wasted as was often the case under the previous administration,” the statement reads. “Under Administrator [Lee] Zeldin’s leadership, EPA is committed to being exceptional stewards of taxpayer dollars and delivering measured results for American families, while still fulfilling Congressional intent. Administrator Zeldin has cancelled roughly $30 billion in wasteful grants and contracts since being confirmed as EPA Administrator. EPA anticipates providing additional information about the revamped and modernized Clean School Bus Program in the near future.”

The EPA website says 1,152 school districts have received 888 awards valued at over $2.62 billion to replace 8,236 school buses. The World Resource Institute’s Electric School Bus Initiative indicates via its Electric School Bus Data Dashboard that over 2,000 of those are electric school buses in operation or on order. Electric school buses have accounted for about 95 percent of Clean School Bus Program awards to date.

Unauthorized immigrants are not eligible for federally or state-funded health coverage in Wisconsin. 

That includes Medicaid, Medicare and the Children’s Health Insurance Program (CHIP), and coverage purchased through the Affordable Care Act (Obamacare) marketplaces.

Unauthorized immigrants also are not eligible for Wisconsin Medicaid or BadgerCare Plus.

Fourteen states, including Illinois and Minnesota, use state Medicaid funds to cover unauthorized immigrants, but Wisconsin does not.

Democratic Gov. Tony Evers on Dec. 5 vetoed a Republican-backed bill that would have banned public money from going toward health care coverage for unauthorized immigrants.

Republicans said the bill was meant to be pre-emptive.

On Dec. 10, Republican U.S. Rep. Tom Tiffany, who is running for governor in 2026, incorrectly said Evers’ veto allowed unauthorized immigrants “to continue to get taxpayer-funded health care.”

When Evers vetoed the bill he criticized it for “trying to push polarizing political rhetoric.”

School Bus Wi-Fi Solution Now Available for Districts Left in E-Rate Cold

Mission Telecom threw a lifeline to school bus Wi-Fi when the nonprofit broadband provider announced it is honoring the cost share of E-Rate for lines of service.

Last week’s announcement comes after the Federal Communications Commission last month retroactively ended school bus Wi-Fi and external hotspot eligibility under the federal discount program for school districts, libraries and health providers.

School districts nationwide had already applied to and started procuring equipment and services for a school bus Wi-Fi under the assumption they would be receiving anywhere between 20- and 90 percent discounts based the proportion of disadvantage students the district serves or if it’s a rural location. With school districts essentially holding the bag following the 2-1 FCC decision on Sept. 30, Mission Telecom is reselling access to the T-Mobile 5G network.

“Equipment’s already installed. Some of these bus Wi-Fi programs [have] been running for years, and [school districts] were counting on their E-Rate discounts in their budgets. And then, all of a sudden, they were told you’re not going to get those discounts,” commented Michael Flood, a school broadband consultant and owner of Alpine Frog, which advises Mission Telecom.

Mark Colwell, director of broadband operations for Mission Telecom, explained to School Transportation News in an email that the company holds seven wireless spectrum licenses in large U.S. cities and leases them to a subsidiary of T-Mobile. In exchange, he continued, Mission Telecom access T-Mobile’s 5G network and resells the lines of service to education, libraries and social-good organizations at affordable rates.

Also, a grantmaking organization, Mission Telecom’s nonprofit status allows it to provide the data service at no more than $20 per month.

“We do not rely on traditional benefactors or individual donors, our nonprofit model and partnerships allow us to reinvest every surplus dollar into other digital-equity initiatives, cost savings for our partners, and grant making programs,” he added. “Every connection we make helps expand affordable access, close the digital divide, and empower organizations to thrive in an increasingly connected world.”

Colwell said Mission Telecom is offering the unlimited 4G/5G wireless service
at the applicant school district’s post-discount share of case based on the approved E-Rate Form 471.

“Thus, we are matching the lines of service, not the equipment,” he noted.

Colwell provided the example of a school district that previously paid $30 per month for school bus Wi-Fi connectivity and received an 80 percent E-Rate discount. He said Mission Telecom will provide unlimited service for $6 per month through June 30, 2026.

He continued that the process for school districts is “fast and transparent with no red tape or lengthy reviews,” with eligible schools and libraries needing only to submit their existing E-Rate Form 471.

Flood, who also formerly worked for Kajeet, said school districts using AT&T or Verizon, for example, could still apply for the Mission Telecom service if they already use Cradle Point routers and are released from their contracts or determine the savings is worth breaking them.

“You just pop a new SIM card in and they’re good to go,” he added.

He also noted that the new discounts come without the strings attached to E-Rate. For example, the federal discounts only applied to the number of counted, registered students who accessed the Wi-Fi on home-to-school routes and back home again. With Mission Telecom, a school district could also use the Wi-Fi for sports activity and to power GPS location, student ridership and bus video transfer.
