In bid for voter data, Trump’s DOJ lays groundwork to undermine confidence in midterms

The U.S. Department of Justice has begun connecting its push to obtain sensitive personal data on millions of voters to whether the upcoming midterm elections will be fair and secure, laying the groundwork for the Trump administration to potentially cast doubt on the results.

The Justice Department has sued 29 states and the District of Columbia over their refusal to provide unredacted voter rolls that include the driver’s license and partial Social Security numbers of voters. The department has lost three of those lawsuits so far this year.

But as the Justice Department begins appealing the losses, it has filed emergency motions warning the “security and sanctity of elections” would be questioned in those states — California, Michigan and Oregon — without immediate rulings.

Election experts told Stateline that federal appellate courts are unlikely to move quickly for the Justice Department. Instead, the department’s court filings suggest that without the data, the Trump administration may question the validity of the midterm elections in November.

“Absent a final Court determination on this matter there is no other process to ensure a fair election in 2026,” the Trump administration’s motions say.

President Donald Trump has made identifying noncitizen voting, an extremely rare occurrence, a priority of his administration, and the Justice Department has said the detailed personal data is necessary to ensure states are properly maintaining their voter rolls. At least a dozen Republican-led states have provided the information.

Democratic election officials, and some Republicans, have condemned the demands as an invasion of voters’ privacy and have voiced concerns the Trump administration plans to use the information to target political opponents or create a national voter list. Other Republican election officials and the Trump administration and have downplayed privacy concerns and said the data will help ensure only eligible voters cast ballots.

The DOJ’s sense of urgency comes after the department spent months sending letters to state officials demanding voter data, followed by successive rounds of lawsuits against states that refused to comply — all in what department officials said was the pursuit of noncitizen voters.

“We know this isn’t a big problem nationwide,” said David Becker, executive director of the nonpartisan Center for Election Innovation & Research and a former senior trial attorney in the Justice Department’s Voting Section during the Clinton and George W. Bush administrations.

“We know the states have adequate safeguards,” Becker said. “We see Republicans — Republicans — coming out and saying this repeatedly. So there is no problem that urgently needs to be solved in advance of the election.”

But the Trump administration has increased its attention on elections in recent weeks. In early February, Trump voiced a desire to “nationalize” elections. He demanded Congress pass a proof of citizenship voter registration requirement and strict voter ID rules. The U.S. Senate is expected to debate the bill next week, but it is unlikely to have enough votes to advance.

The FBI has also seized ballots from the 2020 election in Fulton County, Georgia, and the Arizona Senate complied with a federal grand jury subpoena for records related to its 2020 audit of that year’s election results in Maricopa County, Arizona.

Michigan responded to the Justice Department in a March 6 court filing by asserting that its case involves no emergency. Lawyers representing Michigan Secretary of State Jocelyn Benson, a Democrat, wrote that the appeal doesn’t challenge any state election law or rule and that the outcome of the case would have little to no effect on the 2026 election.

In response to an interview request, Benson’s office referred Stateline to a news release that quoted the secretary as urging election officials across the country “to stand up to the federal government’s overreach and to safeguard citizens’ private voting information we’ve been entrusted to protect.”

Oregon Democratic Secretary of State Tobias Read said in an emailed statement to Stateline that he’s “confident in our case, and trust the courts will continue to uphold the Constitution and the privacy rights of all Oregonians.”

California Democratic Secretary of State Shirley Weber didn’t respond to an interview request.

Race against time

Federal judges have so far ruled that even though states must perform maintenance on their voter rolls, federal law doesn’t give the Justice Department authority to obtain full voter lists.

While the Justice Department now claims the security and sanctity of upcoming elections necessitates the need for speed, the department hasn’t alleged any states are violating federal voter list maintenance requirements, said Derek Clinger, senior counsel and director of partnerships at the State Democracy Research Initiative at the University of Wisconsin Law School.

“This is the first time in all the litigation that DOJ has claimed that there’s an urgent need to resolve the cases,” said Clinger, who is tracking the voter data lawsuits.

Even if courts ultimately determine that states must provide the voter data, it’s not clear that the Justice Department could make effective use of it before the midterms.

Federal law generally prohibits states from conducting significant purges of registered voters less than 90 days before primary and general elections. For example, that period will begin in Michigan on May 6 ahead of the state’s Aug. 4 primary election.

The Justice Department has asked for all court documents in its Michigan appeal to be filed by April 1. Even if the appellate court immediately ruled in the department’s favor, only 35 days would be left until the pre-primary blackout period.

Lawyers for Michigan wrote in its court filing that it is “dubious” that any serious assessment of the state’s 7.3 million voters could occur in that time frame.

Still, Rosario Palacios, a naturalized U.S. citizen who leads the good-government group Common Cause Georgia, said she’s worried the federal government could wrongly flag her or others like her as noncitizens if the Justice Department eventually obtains her state’s unredacted voter roll.

The U.S. Department of Homeland Security operates a powerful online program called SAVE (Systematic Alien Verification for Entitlements) that it uses to verify citizenship. It has previously invited states to run their voter rolls through the program, and the Trump administration in September confirmed the Justice Department is sharing state voter roll data with Homeland Security. But SAVE has faced criticism from some election officials for mistakenly flagging U.S. citizens for review.

After the department sued Georgia for refusing to turn over its data, Palacios and Common Cause intervened in the lawsuit to oppose the demand.

Palacios said in an interview she’s worried some may choose not to participate in the election. “The fear alone of this is going to make people withdraw.”

Some GOP states share voter data

The Justice Department has offered few details about how it intends to analyze the voter data it obtains. The agency didn’t answer questions from Stateline and declined to comment.

Idaho Republican Secretary of State Phil McGrane last month said he wouldn’t turn over voter data. McGrane declined an interview request, but in a Feb. 26 letter to the Justice Department he raised concerns about data security.

“While I appreciate the Department’s representations that Idaho’s data will be safeguarded, I cannot take that now-apparent risk in the absence of clear legal duty to do so,” McGrane wrote.

Some Republican election officials have decided to share their state’s data, however.

Eric Neff, the acting chief of the Justice Department’s Voting Section, wrote in a March 2 court filing that 18 states had either shared voter data or planned to do so soon. He didn’t name those states.

The Brennan Center for Justice at New York University, which tracks the voter data requests, has identified at least a dozen states that have provided the data: Alaska, Arkansas, Indiana, Kansas, Louisiana, Mississippi, Nebraska, Ohio, South Dakota, Tennessee, Texas and Wyoming.

Two of those states — Alaska and Texas — provided their voter rolls after signing a memorandum of understanding, or MOU, with the Justice Department.

The document, marked confidential, says that after the state provides its voter roll, the department agrees to test, analyze and assess the information. Each state agrees to “clean” its voter roll within 45 days by removing any ineligible voters. States would then resubmit their list.

Tennessee Elections Coordinator Mark Goins, who works under Tennessee Republican Secretary of State Tre Hargett, said in an interview that the state had shared its voter data after concluding that DOJ was entitled to it as part of its authority to enforce federal voting law. But Goins said Tennessee had decided against signing the memorandum of understanding because of concerns that the agreement conflicted with the National Voter Registration Act, which sets rules on when election officials can remove voters from their lists.

“When you’re dealing with this much data, and we have 4 million registered voters here, there could be a false flag and you certainly don’t remove anyone improperly,” Goins said.

In Texas, it’s unclear when the Justice Department will provide feedback on the state’s voter list. The state is currently in the preelection blackout period on sweeping changes to its voter registration list ahead of a May 26 primary runoff election, a spokesperson for Texas Republican Secretary of State Jane Nelson told Stateline.

Texas already ran its voter roll of more than 18 million voters through Homeland Security’s SAVE program last year, identifying 2,724 potential noncitizens registered to vote. County election officials were then left to investigate the flagged voters.

Christopher McGinn, executive director of the Texas Association of County Election Officials, said he’s unsure what would happen now, given that the state’s voter roll was recently examined by SAVE.

“Especially since those noncitizens were, in theory, cleaned up,” McGinn said.

In Alaska, the decision to share voter data has produced blowback from some state lawmakers. The state constitution guarantees a right to privacy that “shall not be infringed.”

Alaska Director of Elections Carol Beecher faced skeptical lawmakers during hearings last week that probed her refusal to waive attorney-client privilege to divulge the legal advice she received before providing the voter roll. In response to questions from Stateline, Beecher’s office referred back to her remarks to lawmakers.

“At this point, I am not willing to waive that privilege,” Beecher said at an Alaska Senate hearing.

Alaska state Sen. Bill Wielechowski, a Democrat who was among those who questioned Beecher, in an interview predicted the state will soon face lawsuits challenging the data sharing. He also said lawmakers are looking into pursuing legislation that would direct state officials to seek the return of the information from the Justice Department.

“I just think there’s a total lack of trust in what the federal government will do with this information,” Wielechowski said.

Homeland Security repair job awaits Trump’s next pick, Oklahoma’s Mullin

WASHINGTON — If Oklahoma GOP Sen. Markwayne Mullin is confirmed by the Senate to lead the Department of Homeland Security, he will take over an agency that has faced a weeks-long funding lapse, public blowback to its immigration enforcement strategy and a bottleneck of disaster relief awards left by his predecessor that drew bipartisan ire. 

Additionally, if the United States remains at war with Iran, he’d oversee monitoring for security threats. That is a task some lawmakers are skeptical the department can undertake during its shutdown. 

Mullin, who does not need any Democratic support to be confirmed to lead DHS, will have his nomination hearing March 18 before the Senate Committee on Homeland Security and Governmental Affairs. The committee will vote to move his nomination to the Senate floor the following day, committee Chair Rand Paul of Kentucky told reporters.

The Oklahoman would take over from Kristi Noem, whom President Donald Trump ousted after a disastrous two days of testimony on Capitol Hill that capped a controversial 14-month tenure as DHS secretary.

“She was tasked to do a very difficult job … and I think she has performed the best she can do under the circumstances,” Mullin said of Noem, shortly after the president announced his intention to nominate him. “Is there always lessons that can be learned? Every day there’s something you can do better.”

But Mullin would face the same challenges, if not more, once he takes over. 

In addition to heading Trump’s aggressive immigration push, which is at a low point in popular support after the fatal shootings of two U.S. citizens in Minneapolis in January, Mullin would also be tasked with restoring faith in the department’s spending decisions and repairing the pipeline for sending relief to disaster-stricken areas. 

Noem faced bipartisan scrutiny during hearings this month for her record on those issues, including awarding a $220 million no-bid contract for an ad campaign to a firm owned by a subordinate’s spouse and requiring that she personally approve almost all Federal Emergency Management Agency expenditures.

Noem often clashed with critics, especially Democrats. Mullin indicated he’d try to find more common ground.

“Yes, I’m a Republican. Yes, I’m conservative. But (the) Department of Homeland Security is to keep everybody (safe), regardless if you support me or not,” he told reporters. “My focus is to keep the homeland secure.” 

His time in Congress has not given Mullin a strong background in the subject matter. He’s never sat on any committees dealing with DHS policy. He is a member of the Senate Appropriations Committee, which writes funding bills for the entire federal government, but is not a member of the subcommittee that oversees the DHS funding bill.

If the Senate confirms Mullin, he would be the first Native American to lead DHS. He is an enrolled member of the Cherokee Nation. 

Mullin’s office referred questions for this story to the White House. In an email to States Newsroom, the White House said the Trump administration has “no DHS related policy announcements to make at this time.”

DHS funding

Mullin is a staunch Trump defender and supporter and will be tasked with carrying out his campaign promise of mass deportations of immigrants. To do that, DHS is flush with more than $175 billion for immigration enforcement and detention, through Republicans’ “One, Big Beautiful” law that Mullin voted for. 

“I look forward to earning the support of my colleagues in the Senate and carrying out President Trump’s mission alongside the department’s many capable agencies and the thousands of patriots who keep us safe every day,” Mullin wrote in a social media post shortly after the president’s announcement.

Polling has found many Americans have soured on the campaign platform that won Trump a second term in the White House as DHS has deployed officers to conduct aggressive immigration enforcement in the interior of the country. Majorities of Democrats and independents said the Minneapolis shootings were a sign of broader problems in immigration enforcement, though most Republicans remained supportive of the administration.

The approach has led to massive protests against U.S. Immigration and Customs Enforcement, especially after the deaths of Renee Good and Alex Pretti, both 37-year-old residents of Minneapolis. Another U.S. citizen, Ruben Martinez, was also killed by immigration agents in Texas last year.

Since Good and Pretti’s deaths last month, Democrats have blocked an appropriations bill for the department without significant changes in enforcement tactics. 

Mullin has argued that the appropriations bill provides an accountability measure in funding body cameras for immigration agents. He has pushed back on any restrictions on officers, such as barring them from covering their faces.

“We’re not going to handcuff law enforcement for a useless political exercise,” he wrote in a social media post.

Mullin’s reaction to Pretti video resembled Noem’s

One of the biggest criticisms from Noem was that she referred to Pretti and Good as domestic terrorists. Multiple videos contradicted those claims, and Noem refused to admit she made a mistake or apologize to their families when she was questioned by lawmakers.

While Mullin didn’t use that label, he made a similar claim, implying that Pretti’s actions were a felony. Mullin stressed his support for law enforcement.

“Obstructing federal law enforcement is a felony. Most Americans follow ICE instructions without thinking twice,” Mullin wrote on social media hours after the shooting. “These patriots are doing a difficult job under an 8,000% rise in death threats.”

Mullin was not the only Senate Republican to take that position, but some did take a different view.

Paul joined the top Democrat on the committee that oversees DHS, Gary Peters of Michigan, in grilling the heads of two immigration enforcement agencies within the department about Pretti’s death.

“He is retreating at every moment,” Paul said of Pretti. “He’s trying to get away, and he’s being sprayed in the face. I don’t think that’s de-escalatory. That’s an escalatory thing.”

Senators will get a chance to question where Mullin will lead the agency and whether he will continue some of Noem’s hardline immigration policies, such as the revocation of legal status for millions of immigrants who hail from countries initially granted protections because their home country is deemed too dangerous to return to. 

Mullin has often criticized local governments that have policies to not cooperate with or assist the federal government in immigration enforcement. 

In an interview with States Newsroom, Peters said he had not spoken with Mullin about leading DHS and looked forward to questioning him before the committee.

In addition to immigration-related agencies and FEMA, the department includes the Cybersecurity and Infrastructure Security Agency, the Secret Service and the Coast Guard. 

Additionally, the department will manage security for major events: the World Cup and the celebration for the 250th anniversary of the country’s founding that will occur blocks from the White House. 

FEMA bottleneck

Another Noem policy that drew bipartisan criticism was her requirement she give personal approval of any FEMA contracts or grants worth more than $100,000.

It effectively created a bottleneck of relief to disaster-stricken places, and lawmakers expressed their frustration to Noem that the policy meant delayed payments.

North Carolina GOP Sen. Thom Tillis berated Noem for his full 10 minutes of questioning when she appeared before the Senate Judiciary Committee about how her policy has slowed down recovery efforts in North Carolina, which was hit by the devastating Hurricane Helene in 2024. 

It’s unclear if Mullin will keep that policy in place.

“The Department of Homeland Security has a very broad jurisdiction and I think there’s a lot of work that we need to do,” Mullin told reporters. 

FEMA’s disaster relief fund is somewhat unique among federal programs since Congress has granted it the authority to deficit spend; it cannot run out of money, even during a shutdown. 

Trump has sought to downsize FEMA, firing part of its workforce and directing his officials to restructure the agency. There is currently no permanent FEMA administrator.

No DHS assignments in Congress

Mullin spent a decade in the House before being elected to the Senate in a special election in 2022.

In his time in the House from 2013 to 2023, Mullin sat on the Energy and Commerce, Transportation and Infrastructure and Natural Resources committees.

In the Senate, besides Appropriations, he sits on the Armed Services, Indian Affairs and Health, Education, Labor, and Pensions committees.

He chairs an appropriations subcommittee that handles funding for the legislative branch, and on the HELP Committee, he chairs the panel on Employment and Workplace Safety.  

Mullin, whose congressional staff totals nearly 40, based on records from the Legistorm data service, would oversee an agency with more than 272,000 employees and an annual budget of approximately $64 billion.

Former pro fighter’s Senate confrontations

During a 2023 HELP Committee hearing, Mullin challenged International Brotherhood of Teamsters President Sean O’Brien to a physical fight, after heated testimony. 

“You know where to find me,” Mullin, who is a former professional MMA fighter, said to O’Brien.

Mullin will also have to appear before Paul, who he’s referred to as a “freaking snake,” for his confirmation hearing. Mullin also expressed sympathy for a neighbor of Paul’s, who was charged with assaulting the senator on his front lawn, breaking several ribs.

When pressed by reporters, Paul did not address Mullin’s comments.

“We’ll see how the hearing goes,” he said. 

Long security lines start popping up at airports as TSA officers go without pay

Passengers at a handful of airports this week waited in hours-long security lines as the government shutdown of the Department of Homeland Security dragged on.

Though Transportation Security Administration officers are required by law to work during a lapse in funding, more than usual have been absent after receiving only a partial paycheck during the most recent pay period. TSA officers will miss an entire paycheck this weekend if the shutdown is still in effect then. 

No end to the shutdown appeared imminent Wednesday, as the U.S. Senate rejected a bill that would have funded TSA and other agencies in DHS that are not related to immigration enforcement.

In the meantime, TSA officers are not being paid. 

Most live paycheck-to-paycheck, said Johnny Jones, the secretary-treasurer of the American Federation of Government Employees Council 100, which represents TSA agents.

The lack of pay has contributed to absenteeism, Jones added. The union does not condone coordinated “sick-outs,” which are illegal. 

But individual officers miss work for one of three reasons during a shutdown, he said: pre-planned time off, legitimate illness or personal emergencies, and those calling in sick but seeking other work to pay bills.

“If you’re normally receiving a paycheck, you wouldn’t have that third group,” he said.

Some of those who are working are going without lunch or making other sacrifices, Jones added. And he said two colleagues were evicted during the most recent shutdown last fall, which lasted for 43 days.

The U.S. war against Iran, which has an estimated price in the billions of dollars in just its first two weeks, has also driven resentment among TSA workers, Jones said.

“One of the things that I’ve heard from the colleagues is that, man, we got plenty of money to go fight wars and bomb Iran, but we can’t pay our own employees,” he said.

Long lines

No exceptionally long wait times were reported Wednesday, but the previous few days saw several examples of snarled security lines.

Security lines topped three hours at Houston’s William P. Hobby International Airport on Monday and Tuesday. 

Lines at Louis Armstrong New Orleans International Airport were up to two hours Monday and the airport’s social media drew a direct line to the shutdown.

“Due to impacts from the federal government’s partial shutdown, there continues to be a shortage of TSA workers at the security checkpoint … which is causing longer-than-average lines,” the airport’s X account posted.

Atlanta’s Hartsfield-Jackson International Airport also urged passengers to leave extra time to account for factors including “TSA staffing constraints.”

CBS News reported Wednesday that more than 300 TSA agents have left their jobs since the shutdown began. TSA officials did not respond to messages seeking confirmation of that figure.

Senate gridlock

The top Democrat on the U.S. Senate Appropriations Committee, Washington’s Patty Murray, sought unanimous consent Wednesday for the Senate to approve a bill that would fund all of DHS other than Immigration and Customs Enforcement, Customs and Border Protection, and the secretary’s office.

Sen. Katie Britt, an Alabama Republican who chairs the subcommittee on Homeland Security funding, objected.

Murray’s bill “would effectively defund our law enforcement officers that are charged with keeping Americans safe,” Britt said.

Each party blamed the other for the impasse, which has been unbreachable since the department’s funding lapsed Feb. 14.

Following the January fatal shootings of two U.S. citizens by immigration officers in Minneapolis, Democrats are demanding changes to immigration agencies’ conduct as a condition of funding the department.

Republicans have said they are willing to negotiate the issue, but the parties disagree on what to do for the department, which also includes the Coast Guard and the Federal Emergency Management Agency, in the meantime.

Republican leaders sought to pass a short-term continuing resolution to fund the entire department, but Democrats rejected it, saying it would allow the operation of immigration agencies without adding accountability measures.

“Right now, TSA agents are going without pay because Republicans and the White House have decided they would rather shut down all of DHS than pass some very basic reforms to rein in ICE and Border Patrol,” Murray said. “We also want TSA and FEMA funded, but we are not going to be blackmailed into cutting a blank check for ICE to get it done.”

Politics cited

Senate Majority Leader John Thune, of South Dakota, said Democrats have stopped negotiating on DHS funding in a bid to keep the issue alive for the November midterm elections. 

“The American people are tired,” he said. “Lines get longer at the airports because TSA isn’t funded. The American people want us to do our jobs. Republicans are at the table. We’re ready to work toward a solution. Democrats have walked away.”

Jones, the AFGE member and TSA officer, declined to say which approach to short-term funding was preferable, but said it was Congress’ job to fund the federal government.

“We all swear the same oath to the same Constitution,” he said. “Now my job function is a little different than theirs, so they need to do theirs so I can do mine.”

School bus safety takes many forms and starts many conversations. Take illegal passing. Or lap/shoulder seatbelts. Proper securement of preschoolers and kindergartners on school buses compared to other vehicles. The required training to do so. Driver vetting, coaching and retention.

From the brightest, visibility of school buses to ensuring no student is sleeping on board—and forgotten—at a route’s conclusion, student transportation professionals fill their days planning and conjuring training topics. Emergency response and collaboration with fire, police and EMS departments. Timely, thorough evacuations. The list is endless.

But one of the most important school bus safety and security topics is the national debate on how to cure rising chronic absenteeism in our schools. Everywhere I turn is another headline on the topic.

Research has shown that the school bus ride is one of the best options to ensure students as young as kindergarten age attend classes and ultimately graduate high school. We’ve reported on a study conducted by the University of California, Santa Barbara that found 50,000 fewer kindergartners would miss school if they had access to school bus rides. And that was back in 2017. In the age of universal kindergarten and transitional kindergarten, what could those numbers be now? Put that question into the perspective of decreasing overall student ridership figures nationwide.

Last summer, I reached out to UC-Santa Barbara study author Michael Gottfried—he’s now a professor at the University of Pennsylvania—and asked if there are any new studies he’s working on or aware of. And why is there not so much of a mention of transportation options as a solution when state superintendents call together a committee on chronic absenteeism? Tongue service from a spokesperson after the fact doesn’t cut it.

“You’re absolutely correct that no one is talking about school transportation,” Gottfried told me.

He pointed out a lack of data that connects school transportation to student outcomes. Gottfried asked me to stay in touch and said he will let me know if his research strays back into the area. Fortunately, those in the best position to take up such research or at least strongly advocate for it are reading this column right now. Time and again, the student transportation industry has proactively developed guidelines and best practices when few, if any others were willing, in the position of or knowing how to help.

Certainly, school buses aren’t the only vehicle in town to help with chronic absenteeism. “Alternative vehicles” are trending but school busing has long been supplemented by other options. Transit for the older kids, Mom and Dad or the carpool for the younger. Dare I mention taxis? Even the other national pastime of walking or biking when living within a couple blocks of school.

The school bus traditionalists will argue, “Every child on a school bus.” The safety record is unflappable. Yet putting all children on school buses has never been attainable and is even less realistic today.

But just because a school bus isn’t being or can’t be used doesn’t mean student transporters should wash their hands. I had a recent conversation with a spokeswoman for the National Safe Routes to School Partnership, who told me the organization would welcome collaboration with transportation departments. NASDPTS worked with Safe Routes years ago to push for federal funding of sidewalks, which safe bus stops need just as much as kids walking and biking to and from class.

The bottom line is, student transportation leaders need to advocate for safety in all forms of transportation, not simply that on and around school buses. And student transporters should involve themselves in public policy debates centering on student outcomes as getting them to and from school by whatever means can be one of the biggest drivers—literally.

School buses can and should be the model of consistency for students in accessing educational services. They are iconic. They are highly visible. They are reliable. But when they are unavailable, those who manage school transportation still play an active role in ensuring options, those that are the safest possible, readily exist.

State, local policies on immigration enforcement targeted by US Senate Republicans

WASHINGTON — Senate Republicans during a Tuesday hearing laid the groundwork for legislation that would prevent state and local governments from making decisions on whether to limit cooperation with the federal government on immigration enforcement. 

Senate Budget Committee Chair Lindsey Graham of South Carolina argued that sanctuary cities — a term used by critics — undercut federal law, and local policies shielding immigrants without legal status should be banned. President Donald Trump has called on Republicans who control Congress to act.

“What’s the upside of ignoring federal law and keeping people like this out of federal custody?” Graham said. “It’s a political choice.”

As the Trump administration aims to carry out mass deportations, federal immigration officials have increased enforcement in the interior of the country, targeting cities with high immigrant populations that are led by Democrats such as Chicago, Los Angeles, Minneapolis and the District of Columbia. 

All those cities have policies that bar assistance to the federal government in immigration enforcement. 

“Our Democratic friends are accepting of a sanctuary policy. They don’t think it’s a problem. I do,” Graham said. “Let’s have a debate. Let’s have a vote. This will be good for the country going into 2026 as to who should be in charge of controlling our borders and enforcing law.” 

He did not cite specific legislation he favors, but last month he introduced a bill, S.3805, that would make it unlawful for states and local governments to pass laws that limit cooperation with federal immigration enforcement. 

One of the witnesses tapped by Republicans, former DHS Secretary Chad Wolf, who served in the first Trump administration, agreed.

“To restore the rule of law, the era of sanctuary cities needs to come to an end,” Wolf said. 

Immigration enforcement funds

The top Democrat on the committee, Jeff Merkley of Oregon, said the committee should instead be conducting oversight of the $170 billion Congress provided to the Department of Homeland Security through the 2025 tax cuts and spending package known as the “Big, Beautiful Bill.”

He argued that under that funding, U.S. Immigration and Customs Enforcement has conducted aggressive immigration enforcement, wearing masks and conducting warrantless arrests. 

“We now have a secret police called ICE,” Merkley said.

He noted that three U.S. citizens have been killed by federal immigration agents: Renee Good and Alex Pretti in Minnesota, and Ruben Martinez in Texas. 

Merkley also pushed back on the assumption that immigration enforcement does not occur in states and cities that are referred to by Republicans as sanctuary cities. 

“Sanctuary is a bit of a misnomer,” Merkley said. “It refers to the decision that local police will serve as local police and not be commandeered to be assisting ICE agents.”

Sen. Sheldon Whitehouse, Democrat of Rhode Island, said in his state, there is a legal precedent to not hold an immigrant for ICE to pick up because it would be regarded as an unlawful detainment.

“It is binding law that state and local officials who hold somebody under an ICE detainer, where ICE hasn’t bothered to get a warrant, can be held civilly liable,” Whitehouse said.

Graham took issue with the requirement for a judicial warrant and said the need for it to deport someone is “stupid.” 

“All of a sudden we’re Nazis,” Graham said.

Democrats are calling for ICE to use judicial warrants when making an arrest of a person in the country without legal authority, not for deportations. 

Budget Committee role

Democrats argued that the Budget Committee instead of immigration policy should be addressing fiscal issues, such as the spike in oil prices due to President Donald Trump’s decision to join Israel in its war with Iran. 

California Democratic Sen. Alex Padilla said Tuesday’s hearing was “off-base.”

“Gas prices are spiking because of an unauthorized war with Iran,” he said. 

Democratic Sen. Ben Ray Luján of New Mexico agreed, and said the hearing should focus on affordability and the rising cost of living. 

Graham said he would hold a future hearing on affordability. 

Blue states push to ban ICE at the polls amid federal voter intimidation fears

Several Democratic states are moving to bar federal immigration agents from being near polling places and other election sites, amid persistent worries that President Donald Trump will use federal law enforcement or the military to disrupt the midterm elections.

Measures to restrict federal agents from operating at or near election-related locations have been offered in more than half a dozen states, according to a Stateline count. While the proposals vary, they broadly seek to combat the prospect of chaotic confrontations between federal agents and voters this November.

A federal law dating to the end of the Civil War already bans sending the military or other “armed men” to polling places, except to repel armed enemies of the United States. The U.S. Constitution also gives states — not the president or federal government — the responsibility for running elections.

But Trump’s calls to nationalize elections, his promise to impose voting restrictions with or without Congress, and his history of working to overturn the 2020 presidential election is prompting some Democratic state lawmakers to act. Adding to lawmakers’ fears is the FBI’s January seizure of ballots from the 2020 election in Fulton County, Georgia, and U.S. Department of Justice lawsuits against dozens of states for copies of their voter rolls that include sensitive personal information.

The president’s party typically loses ground in Congress in midterm elections. Given that, Democrats fear Trump is laying the groundwork to block or cast doubt on a losing outcome.

“When the president says he’s going to break the law, I actually believe him,” said California state Sen. Tom Umberg, a Democrat who has introduced legislation that would prohibit federal immigration enforcement within 200 feet of polling places. He said Trump’s call to “nationalize” elections was the “triggering event” that prompted him to offer the bill.

Legislation to restrict immigration enforcement or the presence of federal forces near polling places and other election sites has been offered or announced in California, Connecticut, New Mexico, Pennsylvania, Rhode Island, Virginia and Washington. A bill has also been introduced in Kansas, which has a Democratic governor, but the measure is unlikely to pass in the Republican-controlled legislature.

The bills focus on immigration enforcement, but the New Mexico legislation would go further, prohibiting the military or any armed federal personnel from polling locations.

I think this is just prudent, wise policy to do what we all know is right, which is to protect polling places.

The Trump administration and its supporters have suggested that the president might order U.S. Immigration and Customs Enforcement, or ICE, to the polls. After former Trump adviser Steve Bannon in early February said ICE will surround polling places, White House press secretary Karolina Leavitt said she couldn’t guarantee an ICE agent wouldn’t be near a polling place

Trump allies have also circulated a draft executive order that Trump could sign declaring a national emergency and attempting to assert broad powers over elections, The Washington Post reported last week. Trump told reporters on Friday that he had never heard of the draft order.

But during a conference call last week for election officials from across the country, the Department of Homeland Security committed to not placing ICE agents at any polling places in 2026, according to both Republican and Democratic secretaries of state who were on the call.

Homeland Security told Stateline in a statement that ICE isn’t planning operations “targeting” polling places, but could arrest individuals if an active public safety threat endangered a polling location.

“There’s no reason for us to deploy to a polling facility,” ICE’s current leader, Todd Lyons, told Congress in February.

Democratic state lawmakers calling for election-related restrictions on ICE in state law say they don’t want to take any chances.

“I think this is just prudent, wise policy to do what we all know is right, which is to protect polling places,” said Virginia Democratic state Del. Katrina Callsen, the chief sponsor of a bill that would prohibit federal civil immigration enforcement within 40 feet of polling places and voting counting sites.

The New Mexico legislature in February passed a measure that largely mirrors restrictions in federal law against armed federal personnel at polling places. The bill is now before Democratic Gov. Michelle Lujan Grisham.

The bill says officials generally cannot order or bring troops or other armed federal agents to polling places or parking areas for polling places beginning 28 days before Election Day, when early in-person voting begins. It also would prohibit officials from changing who is qualified to vote contrary to New Mexico law or from imposing election rules that conflict with state law. Violators would be guilty of a felony.

New Mexico lawmakers offered the legislation the day after Trump’s initial remarks about wanting to nationalize elections. New Mexico Democratic state Sen. Katy Duhigg, the bill’s lead sponsor, said she wanted a measure that wouldn’t run into issues with the U.S. Constitution’s supremacy clause, which says federal law supersedes state law.

“I think a lot of states, frankly, are trying to figure out what to do right now,” Duhigg said, adding that courts will likely be asked to sort through new state-level limits on federal forces. “This seems like a reasonable approach to try.”

Republican lawmakers opposed

Some Republican state lawmakers are dismissive of the Democratic measures, casting them as unnecessary.

“I just cannot imagine the president, as much as you might dislike him, ordering federal troops to seize New Mexico elections by armed force,” New Mexico Republican state Sen. William Sharer, the minority leader, said during debate. Sharer didn’t respond to an interview request from Stateline.

In Washington state, one bill would require local election officials to block anyone from accessing areas where ballots are processed or counted for the purposes of immigration enforcement. Law enforcement could be allowed access with a judicial warrant or court order, however.

Washington state Rep. Jim Walsh, a Republican who also chairs the state party, characterized the proposal as “fearmongering” and a solution in search of a problem — unless its supporters acknowledge that people in the country illegally are voting. And he claims Washington doesn’t have the authority to legally bar ICE from areas of an election office.

Washington Democratic state Sen. Drew Hansen, the bill’s lead sponsor, said election workers counting ballots deserve to be able to perform their task without interference from federal immigration authorities. Hansen noted that ICE “does not have a perfect track record, to say the least, of only detaining extremely dangerous, violent noncitizens.”

More than 170 U.S. citizens have been held by immigration agents during Trump’s second term, ProPublica reported in October. A December report by Democrats on the U.S. Senate Permanent Subcommittee on Investigations identified at least seven U.S. citizens who were held for more than 24 hours.

In Arizona, some Republicans want to encourage an ICE presence at the polls. In February, Republican state Sen. Jake Hoffman offered a bill that would require counties to sign an agreement with ICE to provide a federal law enforcement presence at polling places.

Hoffman didn’t respond to an interview request from Stateline. A scheduled committee hearing on the measure was canceled in February, likely killing the bill. Still, the underlying proposal could be resurrected, Arizona Mirror reported.

“Arizonans deserve to know that election laws are not just written in statute but actually enforced in practice,” Hoffman said in a news release.

Existing federal laws against federal election interference are specific and straightforward, said Sean Morales-Doyle, director of the Voting Rights and Elections program at the left-leaning Brennan Center for Justice at New York University. States such as Arizona don’t get a “free pass” to violate federal law, either, he said.

Options exist to hold people accountable under federal law, Morales-Doyle said. If ICE agents deployed to polling places, federal prosecutors would have five years to bring charges against ICE personnel under the statute of limitations. While the Justice Department under the Trump administration would be unlikely to bring charges, he noted, the time limit extends into the next presidential administration.

Still, Morales-Doyle said he understands why people are skeptical, given how ICE and other elements of the Trump administration have behaved.

“So it is, I think, important to think about what state legal mechanisms there are for holding people accountable,” he said.

Local enforcement

Some of the state legislative proposals would place local election workers on the front lines of resisting federal interference.

The Washington state measure would instruct multiple election workers, when possible, to document incidents in which they deny permission to enter areas that are off limits to immigration enforcement. The New Mexico bill would allow county clerks and voters who experienced intimidation to sue over alleged violations, in addition to state officials.

The California legislation goes perhaps the furthest in empowering local election officials. It would allow county election officials to keep polls open if they determine that voting was disrupted because of violations of a ban on federal immigration enforcement nearby.

Some local election officials appear hesitant to discuss the proposals and whether they are preparing for the possibility of federal interference. The president of the California Association of County Clerks and Elected Officials and the clerks chair of New Mexico Counties, a statewide advocacy group for county officials, didn’t respond to requests for interviews. The Washington State Association of County Auditors declined to comment.

More broadly, other election officials have said the possibility of federal interference is informing their preparations for the midterm elections. Scott McDonell, the Democratic clerk of Dane County, Wisconsin, which includes Madison, told Stateline in February that while Trump’s desire to “nationalize” elections isn’t possible under the Constitution, he is paying attention to agencies that answer to Trump.

“What does the president actually control? The FBI, National Guard, ICE, DOJ in general. That’s far more concerning,” McDonell said. (State national guards can be federalized by the president.)

Barbara Richardson Crouch, the Republican registrar of voters in the Town of Sprague, Connecticut, said she prefers no law enforcement at polling places — whether local, state or federal.

In Connecticut, legislators plan to offer a measure to restrict federal immigration enforcement within 250 feet of a polling place or other election site. Crouch, who has been involved in election administration for nearly two decades, said she has long dealt with concerns surrounding law enforcement at voting sites, but that those fears in the past centered on state and local police.

Crouch said a state trooper typically comes through her polling place in the early morning as election workers are setting up, and then again when polls close. Law enforcement is on call, but Crouch said she believes that if someone sees law enforcement, it sends a message that the area isn’t safe.

“I personally have never liked police at election places, even local police,” Crouch said.

Kristi Noem out as DHS secretary; Trump to nominate Oklahoma Sen. Mullin

WASHINGTON — President Donald Trump Thursday said Homeland Security Secretary Kristi Noem will be leaving the post for a job as a special envoy, following an appearance before a U.S. Senate panel this week that provoked bipartisan criticism of her handling of the department that is tasked with fulfilling the administration’s mass deportation campaign. 

Oklahoma GOP Sen. Markwayne Mullin, a Trump loyalist who has championed the president’s war against Iran, will lead the Department of Homeland Security, the president wrote on his social media site, TruthSocial.

“I thank Kristi for her service at ‘Homeland,’” Trump wrote, adding that her role ends March 31.

In a social media post, Noem wrote she looked forward to her new role as a special envoy for a new “Security Initiative in the Western Hemisphere.”

In that role, she will work with Secretary of State Marco Rubio and Secretary of Defense Pete Hegseth, she said, adding that her new position will “build on the partnerships and national security expertise” that she made as DHS secretary, but did not go into detail. 

“I look forward to working with them closely to dismantle cartels that have poured drugs into our nation and killed our children and grandchildren,” she said, adding that the “Western Hemisphere is absolutely critical for U.S. security.” Trump said her title would be special envoy for the Shield of Americas, “our new Security Initiative in the Western Hemisphere” that will be announced at a conference in Doral, Florida, on Saturday.

As members of Congress and other officials reacted to the sudden news of Noem’s ouster Thursday, the outgoing secretary spoke at a previously scheduled event with local law enforcement leaders at a conference in Nashville. 

Noem took questions from the officials in the room, but was not asked about the shakeup and did not address it.

In a social media post, Mullin said he was grateful for the nomination and, if confirmed, would support Trump’s “mission to safeguard the American people and defend the homeland.”

“I look forward to earning the support of my colleagues in the Senate and carrying out President Trump’s mission alongside the department’s many capable agencies and the thousands of patriots who keep us safe every day,” he said. 

Senate hearing

In the heated hourslong oversight Tuesday hearing before senators, Republicans grilled Noem over handing no-bid contracts to close allies and her agency’s slow disaster relief response. 

North Carolina Republican Sen. Thom Tillis berated Noem for a full 10 minutes, criticizing her for a policy she instituted to require disaster relief funds over $100,000 to be approved by her, which he said created a bottleneck in approving funds to his state that is recovering from Hurricane Helene.

He slammed her leadership at DHS as a “disaster” and said it showed the same bad decisionmaking that led her to shoot and kill her 14-month-old dog named Cricket, which she detailed in her 2024 memoir. 

After the president announced Thursday that he would nominate Mullin to lead DHS, Tillis gave his support in a social media post.

“Senator Markwayne Mullin is a great guy and a great choice to lead DHS, restore competence, and refocus efforts on quickly distributing disaster aid, keeping the border secure, and targeting violent illegal immigrants for deportation,” Tillis said. “Another big positive: he likes dogs.”

Also cited were multiple video recordings that contradicted her statements that two U.S. citizens killed by her federal immigration officers in Minneapolis were “domestic terrorists.”

Senate Democrats have refused to approve funding for the Department of Homeland Security, now at day 19 of a shutdown, unless certain policy changes are made to immigration enforcement tactics. A vote in the Senate to move forward on approving a funding bill for the agency failed again on Thursday, in a 51-45 vote. Sixty votes are required.

Ad campaign 

The Wall Street Journal reported earlier Thursday that Trump was planning to fire Noem after she said during the Senate hearing that a special $220 million ad campaign that prominently featured her was personally signed off on by the president. 

Louisiana Sen. John Kennedy questioned Noem about her decision to award a no-bid contract for the ad campaign, in which she pressured immigrants in the country without legal authority to “self deport.” 

A ProPublica investigation found that Noem awarded the contract to the husband of former DHS spokesperson Tricia McLaughlin.

Kennedy asked Noem if the president was aware of the cost of the ad campaign. Noem said Trump knew about it and approved it. 

According to the Wall Street Journal’s Thursday story, the president had not agreed to the campaign, and he was frustrated with its self-promoting style. 

Kennedy had mused to Noem that the ad campaign was “effective in (boosting) your name recognition.”

Minneapolis killings

Democrats have called for Noem to step down following the deaths of U.S. citizens in Minnesota, Renee Good and Alex Pretti, both 37.

Noem had approved an aggressive immigration operation, sending more than 2,000 federal immigration agents to the city. The months-long operation in a city with a high Somali refugee population sparked massive protests and community pushback. 

Following Pretti’s death, the second, Trump directed White House border czar Tom Homan to take over the operations.

Cabinet departure

Noem is the first high-profile Cabinet official to leave her role, which she’s held for a little over a year. 

A similar inflection point with the Trump administration’s immigration policy occurred in the president’s first term in 2018, when huge controversy was generated when parents were separated from their children at the southern border. 

Then-DHS Secretary Kirstjen Nielsen was charged with implementing the policy, which was crafted by Stephen Miller, who is still a top architect of the Trump administration’s immigration policy. Nielsen eventually resigned from her role months later.  

Back to South Dakota?

While the president said Noem will move into another role, the former governor of South Dakota could still have a future in her home state with a potential primary race against Republican Sen. Mike Rounds.

To earn a spot on the June 2 primary ballot, Noem would have to gather nominating petition signatures from 2,171 registered South Dakota voters by March 31.

If that race were to materialize, it would pit two former governors against each other. Rounds was governor of South Dakota from 2003 to 2011, and Noem served from 2019 until last year, when she resigned to join Trump’s Cabinet.

However, such a race would be an uphill battle for her as Rounds already earned a reelection endorsement from Trump in July. 

Before she was governor, Noem served in the U.S. House as South Dakota’s lone representative. She could seek a return to that position, because Republican Rep. Dusty Johnson is running for governor. 

The leading candidate for the state’s Republican nomination for U.S. House is Attorney General Marty Jackley, who lost to Noem in the 2018 Republican gubernatorial primary.

Markwayne Mullin 

Mullin, if confirmed by the Senate, would be the first Native American to lead DHS. He is an enrolled member of the Cherokee Nation. 

Mullin appears to have little experience in homeland security. In the Senate, he does not sit on any committee that oversees or appropriates funds to the agency. 

He’ll be tasked with carrying out the president’s campaign promise of mass deportations, along with leading crucial agencies such as the Federal Emergency Management Agency, transportation security and cyber security, among other departments. 

He would also be taking over an agency that received a separate funding stream from Congress that provides more than $170 billion for immigration enforcement and detention, which he voted for last year. 

Mullin will have to leave the Senate in order to run the agency, if confirmed. Another former senator who serves in Trump’s cabinet, Rubio, resigned as Florida’s senator after the Senate confirmed him in a 99-0 vote. Rubio voted for himself before submitting his resignation.

In his time in the House from 2013 to 2023, Mullin sat on the Energy and Commerce, Transportation and Infrastructure and Natural Resources committees.

In the Senate, he sits on the Appropriations, Armed Services, Indian Affairs and Health, Education, Labor, and Pensions committees.

During a 2023 HELP Committee hearing, Mullin challenged International Brotherhood of Teamsters President Sean O’Brien to a physical fight.

On Appropriations, he chairs the panel that handles funding for the legislative branch, and on the HELP Committee, he chairs the panel on Employment and Workplace Safety.  

He would undergo a confirmation hearing before the Senate Committee on Homeland Security and Governmental Affairs, where he called the committee chair, Sen. Rand Paul of Kentucky, a “freaking snake,” and said he understood why Paul’s neighbor assaulted him, according to an Oklahoma journalist. 

Paul’s ribs were broken by his neighbor in the assault in 2017.

Day after grilling by GOP senators, Noem has easier time with US House panel

WASHINGTON — U.S. House Republicans spent a Wednesday oversight hearing with Homeland Security Secretary Kristi Noem blasting local governments for policies that limit immigration cooperation, while Democrats slammed her leadership of the department, saying it led to the deaths of two U.S. citizens in Minneapolis. 

House Republicans were more friendly to Noem than GOP senators who on Tuesday pressed, and at times yelled at, her for her quick judgment in labeling those killed in Minneapolis — Renee Good, a poet and mother of three, and Alex Pretti, an intensive care unit nurse — as domestic terrorists. Senators were also critical of slow responses from the Federal Emergency Management Agency.

At the House Judiciary Committee hearing, Chairman Jim Jordan of Ohio blamed the Biden administration for immigration policies Jordan said created a crisis and slammed local jurisdictions that decline to assist the federal government in immigration enforcement, often referred to as sanctuary cities. 

He referred to that as “the dumbest policy I have ever heard,” and vowed that Congress would ban it.

During the nearly six-hour hearing, Noem said she agreed, and supported Republicans’ efforts to move forward with legislation to prevent states and local governments from resisting immigration enforcement.

“Illegal aliens that come into this country know where they can go where elected officials will protect them,” she said.

Republicans also criticized Democrats for refusing to approve funding for the Department of Homeland Security for fiscal year 2026 unless there are changes to immigration enforcement tactics. Democrats took a hard line on the issue following Pretti’s death in late January. 

The House Wednesday voted 211-209 to advance a DHS funding bill. A final vote is expected Thursday. 

‘Blankie’ left on jet

The top Democrat on the panel, Jamie Raskin of Maryland, took up a litany of issues with Noem, starting with a report from the Wall Street Journal that detailed how special government employee and top Noem adviser Corey Lewandowski fired a U.S. Coast Guard pilot after Noem’s blanket was left behind on a prior flight. 

The pilot had to be rehired because no one else could fly the plane, according to the WSJ story. 

“Apparently when your special blanket, your blankie, was left on one of the government jets and not transported over to the new one, your special government employee, Corey Lewandowski, chivalrously stepped forward to fire the pilot — mid-air,” Raskin said. “But then he had to be rehired immediately because there was no one else who could fly the two of you on the rest of the journey home.”

Noem denied the story.

Florida Democratic Rep. Jared Moskowitz, pressed Noem about multiple media reports that she currently has a romantic relationship with Lewandowski and raised concerns about how much authority Lewandowski has at the agency.

“You go off and you attack conservative women, and you say that we’re either stupid or we’re sluts,” Noem said, but did not answer if she was having an affair. 

Moskowitz also said he got Noem a “new Coast Guard blankie” and held up a packaged blanket with the emblem of the Coast Guard.

FEMA problems

As in Tuesday’s Senate hearing, Noem was again grilled by a North Carolina lawmaker over delays in FEMA assistance, with Democratic Rep. Deborah K. Ross filling the role Wednesday.

Ross said that thousands of residents in western North Carolina are still waiting for Noem to approve additional FEMA funding that Congress provided in a separate disaster relief funding law after Hurricane Helene in 2024.  

“These delays in paying out this desperately needed recovery funds are simply unacceptable, and you heard that from my Republican senator, (Thom) Tillis, yesterday,” Ross said. 

Ross slammed Noem for instituting a policy to require any FEMA contract costing more than $100,000 to be approved by her first. 

Ross said that policy “has contributed to many of these delays, creating a bottleneck, blocking reimbursement for hundreds of millions of dollars of disaster funding that stand directly between North Carolinians and that relief.” 

Noem blamed former President Joe Biden for not sending disaster relief money to the state, saying he “failed North Carolina,” and that the state had received billions more under the Trump administration.

“Because we appropriated the money!” Ross shouted. 

In late December 2024, Congress passed a separate disaster relief package that Biden signed into law in the final month of his term.

Minneapolis questions

Noem was pressed by Raskin about referring to Good and Pretti, both 37 years old and shot and killed by federal immigration agents, as domestic terrorists. 

“I want to give you a chance before the entire country to correct your false and defamatory claim based on what you know today, Madam Secretary, were Renee Good and Alex Pretti domestic terrorists?” Raskin asked. 

Noem did not answer repeated questions from Raskin if she believed Good and Pretti were domestic terrorists, but said “what happened in Minnesota in those two incidents was an absolute tragedy.”

Dems push to revert to earlier immigration policy to rein in Trump’s crackdown

WASHINGTON — As they seek to curb President Donald Trump’s aggressive approach to immigration enforcement, congressional Democrats are looking to formalize some guidelines previous administrations used.

Of the 10 policy proposals Democratic leaders offered in negotiations to reopen the Department of Homeland Security, which has been in a funding lapse since Feb. 14 in the midst of widespread uproar over the fatal shootings of two U.S. citizens by immigration officers in Minneapolis last month, seven have been employed in at least some form by previous administrations.

Democrats are asking the Trump administration to reinstate policies it has rejected in its controversial push to carry out mass deportations. Prior policies Democrats want to formalize include use-of-force standards, allowing unannounced visits by members of Congress to facilities that detain immigrants and obtaining judicial warrants before entering private residences.

“Many of the things the Democrats are asking for are to revert to prior policies,” said Theresa Cardinal Brown, a senior DHS official during the George W. Bush and Barack Obama administrations. “Some of them are responding to the ways this administration is carrying out its operations that previous administrations did not.”

Formalizing the policies in law, as part of a deal to pass a fiscal 2026 funding bill for the department, would make them more permanent.

“Policies and guidance … apply as the current leadership applies them,” Cardinal Brown said. “They’re not absolutes, and they can be changed much more frequently.”

But an agreement between congressional Democrats and the White House on changes to immigration enforcement appears elusive. The White House’s response to the proposals was “incomplete and insufficient,” House Minority Leader Hakeem Jeffries and Senate Minority Leader Chuck Schumer said in a Feb. 9 statement. 

No recent movement on negotiations

Democrats late Monday sent over a counterproposal to Republicans and the White House, but did not make public what those changes were, according to a statement from party leaders.

While there is bipartisan support for some of the proposals, like requiring body-worn cameras, others, such as barring immigration agents from wearing face coverings and requiring judicial warrants to enter private property, have been rejected outright by the Trump administration.

A White House official said the “Trump Administration remains interested in having good faith conversations with the Democrats.” 

“President Trump has been clear – he wants the government open,” according to the White House official.

Even with the department shut down, immigration enforcement will continue, due to $170 billion in funding in the massive tax cuts and spending package Trump signed into law last year. 

Democrats’ proposals do not include consequences if DHS doesn’t comply, which raises an issue of effectiveness, said Heidi Altman, vice president of policy at the National Immigration Law Center, an advocacy group that aims to provide free or low-cost legal services for immigrants.

“When Congress is negotiating policy measures, are they also putting teeth to those policy measures, and are they yanking away the funds that we know ICE and CBP will use to violate guardrails to begin with?” Altman said.

Changes demanded after Minneapolis deaths

After Renee Good was shot and killed by immigration officer Jonathan Ross on Jan. 7, lawmakers amended the Homeland Security funding bill to add guardrails, such as appropriating $20 million for body cameras and adding a requirement for DHS to report how funds from the tax cuts and spending package are being spent.

But a second death in Minnesota, that of intensive care unit nurse Alex Pretti on Jan. 24, spurred Democrats to reject funding for DHS without stronger policy changes to the enforcement tactics used by immigration officers at U.S. Immigration and Customs Enforcement and Customs and Border Protection. 

Only three of the 10 proposals from Schumer and Jeffries, both of New York, would be entirely new. 

They are: prohibiting ICE and other immigration enforcement agents from wearing face coverings, barring racial profiling after the Supreme Court cleared the way for the practice last year, and standardizing uniforms of DHS agents.

The heads of ICE and CBP rejected Democrats’ request to have their immigration officers forgo face coverings when asked during an oversight hearing before the House Homeland Security Committee last week. 

Acting ICE Director Todd Lyons and CBP Commissioner Rodney Scott, along with congressional Republicans, have argued that masks and face coverings prevent their officers from being doxed. 

Local cooperation

Other proposals, including barring of immigration enforcement of so-called sensitive locations such as religious places, child care facilities, hospitals and schools, would expand previous DHS guidance that restricted enforcement in such places.

The Democratic proposal calls for enforcement to be prohibited at those sensitive locations. Prior guidance allowed for the practice on a limited basis.

Then-acting ICE Director Caleb Vitello rescinded the policy shortly after President Donald Trump took office in January last year. There are several lawsuits brought by religious groups challenging the move by the Trump administration.

A requirement that immigration officials gain permission from local and state governments before undertaking large enforcement operations like the one in Minneapolis would build on previous policies of federal-local cooperation.

But that measure would be a long shot, Cardinal Brown said.

“I think that’s going to be a hard one,” she said. “The federal government has the authority to enforce immigration law anywhere in the country it wishes.”

She said a more realistic option would be for the federal government to inform or coordinate with local authorities for large-scale immigration operations. 

Another proposed requirement that DHS officials present identification also builds on a previous policy.

Another proposal builds on DHS policy of targeted enforcement by ending “indiscriminate arrests,” without warrants.

Under current immigration law, if an officer encounters a person believed to be in the U.S. unlawfully and can escape before a warrant is obtained, a warrantless arrest is lawful.

Democrats want to increase standards on the forms ICE uses to authorize an arrest. These administrative forms are not signed by a judge but instead by an ICE employee.

Judicial warrants

The remaining proposals would revert DHS policies to those in place under prior administrations’ guidance. Those include use-of-force standardsuse of body cameras when interacting with the public, allowing members of Congress unannounced oversight visits at detention centers that hold immigrants and requiring a judicial warrant to enter private property.

An internal ICE memo, obtained by The Associated Press, showed that Lyons instructed ICE agents to enter private residences without a judicial warrant – a departure from longstanding DHS policy.

“This judicial warrant issue is so disturbing,” said Ben Johnson, executive director of the American Immigration Lawyers Association, or AILA.  

He said the question of whether a warrant is needed to enter private property was already decided under the Constitution’s Fourth Amendment. 

“The fact that it’s being discussed now is really frightening,” Johnson said.

Body cameras

Providing funds for DHS to acquire body cameras for immigration officers is one proposal Democrats and Republicans seem to have agreed on.

Earlier this month, DHS Secretary Kristi Noem announced that body cameras would be provided to all immigration agents in Minneapolis, and said that as “funding is available, the body camera program will be expanded nationwide.”

During an oversight hearing on Capitol Hill, Lyons said about 3,000 ICE officers currently have body cameras with another 6,000 cameras on the way. Scott said  roughly 10,000 Border Patrol agents, about half the total force, have body cameras.

But body cameras are not a guarantee against misconduct, Altman said.

CBP officials were wearing body cameras when Pretti was shot and killed. Scott said that footage would be released after the investigation is over.

“We see officers in the field right now wearing body-worn cameras engaging in abuse and violence on the daily,” Altman said. 

Oversight visits

One of the proposals would also end a DHS policy to require members of Congress to provide seven-day notice of oversight visits at facilities that hold immigrants, despite a 2019 appropriations law that allows for unannounced visits.

Since last summer, several lawmakers have been denied oversight visits at ICE facilities prompting them to sue in federal court. 

On the day funding for DHS lapsed, Feb. 14, the Department of Justice submitted a brief, noting that because of the shutdown, unannounced oversight visits by lawmakers can be denied. 

The administration argued that during the shutdown, immigration enforcement has been funded by the tax cuts and spending bill, which does not include language allowing unannounced visits, rather than regular appropriations. 

“There is no lawful basis for the Court to enjoin Defendants’ conduct so long as the restricted funds have lapsed,” according to the document.

WASHINGTON — The second partial government shutdown in 2026 began at 12:01 a.m. Saturday, after lawmakers left the nation’s capital without reaching a deal on changes to immigration enforcement tactics at the Department of Homeland Security. 

The department’s shutdown is also likely to go on for some time. With Congress out next week for the Presidents Day recess, lawmakers are not expected back on Capitol Hill for votes until Feb. 23. 

A procedural vote to approve funding for the Homeland Security bill for fiscal year 2026 failed Thursday to gain support from Senate Democrats because constraints to immigration enforcement were not included, such as an end to agents wearing face coverings. 

Even with the president’s border czar Tom Homan announcing Thursday  the withdrawal of the thousands of federal immigration officers from Minneapolis, Democrats argued it’s not enough. 

“Without legislation, what Tom Homan says today could be reversed tomorrow on a whim from (President) Donald Trump,” Senate Minority Leader Chuck Schumer, D-N.Y., said on the Senate floor Thursday.

Asked by the press pool Friday about cutting a deal on the shutdown,  Trump said, “We’ll see what happens. We always have to protect our law enforcement.”

After the Senate vote failed 52-47, members of Congress emptied out of Washington for the recess. Some were off to Munich, Germany for a major security conference. 

ICE still has cash at hand

While the agency Trump tasked with carrying out his mass deportation campaign of immigrants will shut down, enforcement will continue because Congress allocated a separate stream of money, about $75 billion for U.S. Immigration and Enforcement Services. 

During last fall’s government shutdown, which lasted a record-breaking 43 days, immigration enforcement continued.

The other agencies within DHS that will be shut down but continue to operate because they include essential workers include the Federal Emergency Management Agency, the Secret Service, the Coast Guard and the Transportation Security Administration, and Cybersecurity and Infrastructure Security Agency, among others.

In general, any employees who focus on national security issues or the protection of life and property would continue to work through a shutdown, while federal workers who don’t are supposed to be furloughed. 

Neither category of employees will receive their paychecks during the funding lapse, though federal law requires they receive back pay once Congress approves some sort of spending bill. 

Democratic mayors call for GOP to accept proposals

Democrats have pushed for policy changes after federal immigration officers killed two U.S. citizens in Minneapolis, where a deportation drive is set to wind down after the city faced more than two months of aggressive immigration enforcment. 

Renee Good was shot and killed by an immigration officer on Jan. 7, which prompted a bipartisan agreement to enact some guardrails, such as $20 million in funding for immigration agents to wear body cameras. 

But a second killing by federal immigration officers, that of Alex Pretti on Jan. 24, prompted the Senate to decouple the Homeland Security measure from a package of spending bills, as Democrats floated proposals meant to rein in enforcement tactics, and prompted a four-day partial shutdown. A two-week funding patch was set for negotiations and it expires at midnight Friday.

Democratic mayors hailing from the major cities of Baltimore, Boston, Chicago, Denver, Los Angeles, Minneapolis, New Orleans and Portland, Oregon, Friday issued a letter that called on the top Republicans in Congress, Senate Majority Leader John Thune of South Dakota and House Speaker Mike Johnson of Louisiana, to accept the proposals before DHS entered a shutdown. 

“When federal agents operate in our streets without identification, without warrants, and without accountability, that trust is shattered,” they wrote. “All of us agree that for so long as the agency exists, new funding for the Department of Homeland Security must be conditioned on the comprehensive 10-point framework released last week.”

Those policy suggestions include requiring immigration officers to not wear masks and identify themselves, which has drawn strong opposition from Republicans and the leaders of ICE and Customs and Border Protection who argue the face coverings prevent their agents from being doxxed. 

Schumer and House Minority Leader Hakeem Jeffries, D-N.Y., sent the proposals over to the White House, but said the Trump administration’s response was “incomplete and insufficient in terms of addressing the concerns Americans have about ICE’s lawless conduct.” 

According to the contingency plan for DHS, the agency expects about 20,000 employees out of 271,000 to be furloughed in the event of a government shutdown.

Members of Congress again challenge Noem policy limiting visits to immigration facilities

WASHINGTON — Members of Congress on Thursday sought a ruling from a federal judge to block yet another Department of Homeland Security policy that required a notice for lawmakers to conduct oversight visits to immigration detention facilities.

The policy is the third from DHS Secretary Kristi Noem on the subject, and it is nearly identical to the previous two. 

Noem’s policies put in place a new requirement that members of Congress must give DHS seven days notice before conducting an oversight visit at a facility that holds immigrants, despite a 2019 appropriations law that allows for unannounced visits by lawmakers. 

On Feb. 2, U.S. District Judge Jia Cobb blocked a seven-day notification policy ordered by Noem one day after the deadly shooting of Renee Good by a federal immigration officer in Minneapolis on Jan. 7. 

On the same day as Cobb’s ruling, Noem issued a nearly identical policy, after Democrats said they would refuse to approve new DHS funding unless changes in enforcement tactics were made following a second deadly shooting of Alex Pretti by two Customs and Border Protection officers.

With disagreement between both parties, and Thursday’s failed vote to move forward on funding the Homeland Security bill for fiscal year 2026, the agency will be shut down beginning early Saturday. 

However, even if DHS is shut down, Immigration and Customs Enforcement still has $75 billion in funding due to the tax cuts and spending package signed into law last year.

Agency shutting down

Department of Justice attorneys on Thursday argued because DHS will be shut down, the appropriations law will expire by the end of the week and therefore the unannounced oversight provision for members of Congress will no longer be in effect.

An attorney for the members of Congress, Christine L. Coogle, rejected that argument and said just because the funds expire does not mean the law, which is a rider in the Homeland Security funding bill, does as well. 

“The law itself does not expire,” she said. “And so the oversight rider remains on the books.” 

Cobb said she would extend her temporary restraining order until March 2, or until she rules, whichever comes first.

Visits denied

Under a 2019 appropriations law, any member of Congress can carry out an unannounced visit to a federal facility that holds immigrants, referred to as Section 527. But in June, multiple Democrats were denied visits to ICE facilities, so they sued. 

“What we’re really seeking here is a return to the status quo,” Coogle said in court Thursday. 

In December, Cobb granted the request to stay Noem’s policy, finding it violated the 2019 law. 

But in the second policy Noem issued on Jan. 8, she argued because the ICE facilities are using funds through the Republican spending and tax cuts law, known as the “One, Big Beautiful Bill,” and not the DHS appropriations bill, those facilities are therefore exempt from unannounced oversight visits by members of Congress. 

Cobb earlier this month, rejected that argument from the Trump administration and temporarily blocked the policy for the plaintiffs in the case. 

The House Democrats who sued include Joe Neguse of Colorado, Adriano Espaillat of New York, Kelly Morrison of Minnesota, Jamie Raskin of Maryland, Robert Garcia of California, J. Luis Correa of California, Jason Crow of Colorado, Veronica Escobar of Texas, Dan Goldman of New York, Jimmy Gomez of California, Raul Ruiz of California, Bennie Thompson of Mississippi and Norma Torres of California.

Sen. Baldwin says she won’t support current DHS funding bill

After White House officials announced Thursday they will be ending the federal immigration enforcement surge in the Twin Cities, U.S. Sen. Tammy Baldwin said she would not vote for a bill to fund the Department of Homeland Security, saying she hopes to prevent some other community from being victimized next.

On Thursday afternoon, Senate Democrats blocked the DHS funding measure. A procedural vote to advance the funding bill failed in the Senate, 52-47. Baldwin joined with all Senate Democrats except Sen. John Fetterman in voting against the measure. 

Baldwin said at a virtual news conference Thursday that her office has received more than 40,000 phone calls demanding that Immigration and Customs Enforcement be reined in. 

“The Trump administration claimed that they are winding down their invasion of Minneapolis, but I’ll believe it when I see it, and the truth is that is not even close to enough,” she said. “What is stopping them from just going to another American city and causing the same chaos? We need to put in law some serious guardrails and rein in ICE, and that’s exactly what I’m fighting for.”

Baldwin said she wants ICE to be held to the same standards as local police officers, which includes not wearing masks, carrying identification and wearing body cameras. She also said she wants to stop “chaotic, roving bands of federal agents” storming across communities as they have  done in the Twin Cities and to make sure the investigations into the shooting deaths of Renee Good and Alex Pretti, the two U.S. citizens killed by federal agents in Minneapolis, are conducted independently and transparently. 

But Baldwin said congressional Republicans and President Trump have been unwilling to work with Democrats to put up “common sense” guardrails for ICE operations.

“I am still hopeful that we can find compromise, but negotiations are a two-way street,” she said. “Democrats have put forward some common sense measures that Americans overwhelmingly support, and so it’s up to my Republican colleagues if they want to get serious about negotiating with us. I’ve been clear for weeks that unless serious measures are added to this legislation that serve to rein in ICE, I am not going to be a signatory to a blank check for this administration to wreak havoc on communities and endanger our neighbors.”

WASHINGTON — Leaders from several agencies within the Department of Homeland Security testified before a U.S. House panel Wednesday about how a shutdown would affect the programs they oversee, though Democrats argued the hearing was a “show” that wasn’t going to get lawmakers any closer to agreement on constraints to federal immigration enforcement. 

Congress has until Friday at midnight to pass a stopgap spending bill or reach bipartisan agreement on the department’s full-year funding bill, which was held up by Democrats after the killing of two U.S. citizens by immigration agents in Minneapolis. Otherwise, the department will begin a shutdown. 

House Appropriations Committee ranking member Rosa DeLauro, D-Conn., said it was unacceptable that neither Homeland Security Secretary Kristi Noem nor any leaders from Immigration and Customs Enforcement or Customs and Border Protection were at the hearing. 

“Democrats requested that they be present. Why are they not here?” DeLauro said. “That should tell you everything you need to know about what this hearing is really all about. It is not to address the real concerns of millions of Americans over the unchecked brutality of officers within those agencies, brutality that has left two Americans dead and countless others seriously injured.”

DeLauro countered that Republicans held the hearing to imply Democrats don’t care about consistent funding for the many agencies within DHS, including the Coast Guard, Federal Emergency Management Agency, Secret Service and Transportation Security Administration.

“In fact, it is the Republican leadership that has chosen to hold your agencies hostage to avoid implementing reforms that they know are necessary to keep our community safe from Immigration and Customs Enforcement and the Customs and Border Patrol,” DeLauro said. 

Nevada Republican Rep. Mark Amodei, chairman of the Homeland Security Appropriations Subcommittee, said he opted not to invite Noem because he wanted to “talk to the operational people” and that he decided not to invite leaders of ICE and CBP since they testified in front of a separate House committee Tuesday.  

Amodei said enacting a DHS funding bill before the Friday midnight deadline seemed “like a very tall order.” 

“A shutdown has gone from a distinct possibility to a probability,” Amodei said. “But not all components will equally share the pain during a Homeland shutdown.”

Amodei said that ICE and CBP’s “missions will be largely unaffected by a shutdown,” in part, because Republicans provided the two agencies with more than $150 billion in the party’s “big, beautiful” law. 

Most Homeland Security workers will stay on duty

A government shutdown this time around, unlike the one last year, would only affect the Department of Homeland Security, since Congress has approved the other 11 annual government funding bills. 

The other agencies housed within DHS would sustain varying ramifications. In general, any employees who focus on national security issues or the protection of life and property would continue to work through a shutdown, while federal workers who don’t are supposed to be furloughed. 

Neither category of employees will receive their paychecks during the funding lapse, though federal law requires they receive back pay once Congress approves some sort of spending bill. 

Texas Rep. Henry Cuellar, the top Democrat on the Homeland Security Appropriations Subcommittee, said the “reality is that nearly 90% of the department will continue operating, even if Congress fails to complete its work by the end of the week.”

Leaders urged to give up recess next week

House Appropriations Committee Chairman Tom Cole, R-Okla., urged GOP leaders to cancel the recess scheduled for next week, when many lawmakers plan to travel to Germany for the Munich Security Conference.

Cole argued that members should stay on Capitol Hill to negotiate an agreement on Homeland Security funding if a deal isn’t reached before the deadline. 

“I will tell you personally, I think it’s unconscionable if Congress leaves and does not solve the problem,” Cole said. “I’m sure Munich is a great place. I’ve been there many times. The beer is outstanding. But we don’t need to go to a defense conference someplace in Europe when we’re not taking care of the defense of the United States of America.”

Cole said he “would be embarrassed to walk past a TSA agent that wasn’t getting paid so I could go someplace else. And that’s my personal opinion.

“That’s not necessarily the opinion of my leadership or anybody else, but we should stay here and get this resolved. We should make sure that men and women that we have already put in a terrible position once for 43 days don’t have to go through it again.”

Missing paychecks for the Coast Guard

Admiral Thomas Allan, vice commandant for the U.S. Coast Guard, told lawmakers “a funding lapse has severe and lasting challenges for our workforce, operational readiness and long-term capabilities.”

“A lapse lasting more than a few days will halt pay for the Coast Guard’s 56,000 active duty, reserve and civilian personnel,” Allan said. “This is not a distant administrative issue. The uncertainty of missing paychecks negatively impacts readiness and creates a significant financial hardship for service members and their families.”

Shutdowns, he said, “cripple morale and directly harm our ability to recruit and retain the talented Americans we need to meet growing demands.”

Ha Nguyen McNeill, acting administrator at the Transportation Security Administration, said during the 43-day government shutdown that ended in November, she heard stories about “officers sleeping in their cars at airports to save money on gas, selling their blood and plasma and taking on second jobs to make ends meet.” 

“Many were subject to late fees from missed bill payments, eviction notices, loss of child care and more. All the while, expected to serve their country and perform at the highest level when in uniform,” McNeill said. “Twelve weeks later, some are just recovering from the financial impact.”

McNeill testified that “TSA’s critical national security mission does not stop during a shutdown; around 95% or 61,000 of TSA’s employees are deemed essential and continue to work to protect the traveling public during a shutdown, while not getting paid.”

Matthew Quinn, deputy director at the United States Secret Service, said agents will continue to report to work though he emphasized a shutdown would still have consequences. 

“To the casual observer, there will be no visible difference,” Quinn said. “However, gaps in funding have a profound impact on our agency today and into the future.” 

Gregg Phillips, associate administrator in the Office of Response and Recovery at FEMA, said a shutdown “would severely disrupt FEMA’s ability to reimburse states for disaster relief costs and to support our recovery from disasters.”

Security Expert to Share Indicators Violent Behavior at STN EXPO East

Top Dems in Congress list ICE constraints they want in funding bill

WASHINGTON — The top two Democrats in Congress on Wednesday outlined their proposal for restrictions on immigration enforcement, including body cameras and a ban on masks, though they had no details to share about when actual negotiations would begin.

Lawmakers from both political parties have less than two weeks to find a solution before the stopgap law funding the Department of Homeland Security expires Feb. 13, which could force all of its components, including the Coast Guard and Federal Emergency Management Agency, into a shutdown. However, Immigration and Customs Enforcement still has access to $75 billion in funding included in the massive tax cuts and spending package signed into law last year.

House Minority Leader Hakeem Jeffries, D-N.Y., said the offer that he and Senate Minority Leader Chuck Schumer, D-N.Y., were sending to Republicans was the result of “a very productive discussion.”

“Dramatic changes are necessary at the Department of Homeland Security with respect to its enforcement activities so that ICE and other agencies are conducting themselves like every other law enforcement agency in the country, not in so many instances in a rogue or lawless manner,” Jeffries said. 

Democrats will insist that federal immigration agents: 

  • Wear body cameras
  • Only wear masks to conceal their identities in “extraordinary and unusual circumstances”
  • Do not undertake roving patrols
  • Do not detain people in certain locations, like houses of worship, schools, or polling places
  • Do not engage in racial profiling
  • Do not detain or deport American citizens 

Jeffries said that judicial, as opposed to administrative, warrants should be required “before everyday Americans are ripped out of their homes or snatched out of cars violently.

“The Fourth Amendment is not an inconvenience, it’s a requirement embedded in our Constitution that everyone should follow.”

That amendment states the government shall not violate the “right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures” and that warrants can only be issued with probable cause.  

Administrative warrants are not signed by a judge, but approved by ICE officers themselves. Under U.S. immigration law, ICE also has some authority to conduct warrantless arrests if an immigration officer comes across a person suspected to be in the country unlawfully and believes that person will escape before a warrant can be obtained. 

Accountability measures

Democrats will also press Republicans to agree to what Schumer described as “real accountability.”

“There’s got to be outside, independent oversight by state and local governments, by individuals,” Schumer said. “And there’s got to be a right to sue, there’s got to be a right to go to court and stop this.” 

Schumer criticized Speaker Mike Johnson, R-La., for saying that immigration agents should be able to wear masks, referring to them as “secret police” who need “to be identified more than any other group.”

“I would bet when Speaker Johnson goes down to Louisiana, the sheriffs and the police deputies are well identified, as they are in almost every city,” he said. 

When pressed about Johnson saying Republicans wouldn’t agree to require judicial warrants, Jeffries said the speaker had “articulated unreasonable positions.”

“He’s actually supporting the notion that masked and lawless ICE agents should be deployed in communities throughout America,” Jeffries said. “Mike Johnson called the Fourth Amendment an inconvenience. It’s not an inconvenience. It’s part of the fabric and DNA of our country, just like the First Amendment, yes even the Second Amendment, the 10th Amendment, the Fourth Amendment.

“We’re standing up for all of these constitutional privileges that have been part of who we are since the very beginning.” 

Negotiation timeline

Schumer said during the press conference that Democrats from the House and Senate were prepared to begin negotiations with Republicans, but would insist on changes “to rein in ICE in very serious ways.”

“If they’re not serious and they don’t put in real reform, they shouldn’t expect our votes, plain and simple,” he said.

Schumer appeared somewhat skeptical that Alabama Republican Sen. Katie Britt, whom Senate Majority Leader John Thune, R-S.D., put forward as their top negotiator, was truly empowered to cut a deal on behalf of every GOP senator. 

Britt, chairwoman of the Homeland Security Appropriations Subcommittee, told reporters Wednesday that she expects lawmakers will need to approve another stopgap spending bill for the department, signaling she doesn’t expect a deal within the next two weeks. 

“We need a little more time, so hopefully (Democrats) see the good effort that we’ve made … and we’ll have another CR,” she said, referring to the technical name for a short-term funding bill, a continuing resolution. 

Britt did not say how long that temporary funding measure for the Department of Homeland Security would last.

Any spending bill, whether short or long, will need Democratic support to move through procedural votes in the Senate. 

Congress has approved 11 of the 12 annual funding bills, so DHS would be the only part of the federal government to shut down if lawmakers cannot approve its full-year bill or another stopgap measure before its funding expires.

Family of Renee Good, citizens hurt by DHS detail violence to Democratic panel

WASHINGTON — Renee Good’s family, distraught and in disbelief over her killing, took some comfort in the past few weeks thinking her death might prompt change in the country, her brother Luke Ganger said Tuesday. 

“It has not,” Ganger told congressional Democrats at a forum on the disproportionate use of force by U.S. Department of Homeland Security agents. “The deep distress our family feels because of (Renee’s) loss in such a violent and unnecessary way is complicated by feelings of disbelief, distress and desperation for change.”

Brent Ganger, another brother of Good, also appeared at the forum, saying Good “had a way of showing up in the world that made you believe things were going to be okay.”

Good, a 37-year-old U.S. citizen, was fatally shot by a federal agent Jan. 7 in Minneapolis. 

Her death prompted widespread outcry over the immigration enforcement tactics of President Donald Trump’s administration. 

“The completely surreal scenes taking place on the streets of Minneapolis are beyond explanation,” Luke Ganger said. “This is not just a bad day or a rough week or isolated incidents — these encounters with federal agents are changing the community and changing many lives, including ours, forever.” 

Backlash over the administration’s immigration efforts grew even louder after federal agents fatally shot 37-year-old Alex Pretti, also a U.S. citizen, in Minneapolis on Jan. 24. 

Administration officials have defended the immigration crackdown, including the aggressive tactics used in Minneapolis and other cities.

“The president is never going to waver in enforcing our nation’s immigration laws and protecting the public safety of the American people in his ardent support of” Immigration and Customs Enforcement and Customs and Border Protection, White House press secretary Karoline Leavitt said Tuesday.

First-hand accounts

Sen. Richard Blumenthal of Connecticut and Rep. Robert Garcia of California hosted the forum. More than 20 Democrats in the House and Senate joined them.

The unofficial forum is one of several events put on by congressional Democrats, who are in the minority in both chambers, over the past year to protest a host of actions from the administration. 

Three witnesses across Illinois, Minnesota and California — all U.S. citizens — offered harrowing accounts of their encounters with immigration agents in recent months, detailing the trauma, fear and mental distress as a result. 

Marimar Martinez was shot five times by an immigration agent in Chicago. Aliya Rahman, a Minneapolis resident with autism and a traumatic brain injury, was dragged out of her car by agents while on her way to a doctor’s appointment and said she was later refused medical care in DHS detention. And Martin Daniel Rascon was shot at by agents while traveling in a car with family members. 

“Why do we continue to wait for more public executions when we have already seen the evidence in our TVs and computer screens?” Martinez asked the panel. “We have heard the testimonies, we have watched the pain unfold in real time — how many more lives must be lost before meaningful action is taken?”

The meeting came the same day the House passed, and Trump later signed, a funding package that includes a two-week stopgap measure for DHS, as Congress and the administration try to iron out a solution to Democrats’ demands for additional restraints on immigration enforcement following Pretti’s death. 

Many Democrats in Congress have vowed not to support a Department of Homeland Security funding bill that does not include such restraints. Blumenthal, the top Democrat on the Investigations Subcommittee of the Senate committee that oversees the Department of Homeland Security, made that explicit Tuesday.

“Some day we should have a truth and justice commission to investigate the systematic failing,” he said. “But for right now, I can promise that I will not support another dime for the Department of Homeland Security unless there is this fundamental, far-reaching reform and restraint in effect — a rebuilding of the agency.” 

Report blames DHS tactics for fatalities

Garcia, the top Democrat on the House Committee on Oversight and Government Reform, releasedreport ahead of the hearing Tuesday on Democrats’ findings regarding the deaths of Good and Pretti.

The report claims that the administration’s “extreme policies, violent tactics, and culture of impunity led to the killings.”

The report also argues that “the available evidence suggests that the Trump Administration is attempting to cover up misconduct” and is also “continuing its cover-up by impeding thorough and impartial investigations into the shootings.” 

“We’re seeing ICE, CBP, other parts of DHS, all across our country, terrorize communities,” Garcia said at the forum, pointing to warrantless searches, arrests and detainments of individuals with no prior criminal history and people being sent to detention centers and released without explanation. 

“Now, American citizens — innocent people — have been brutalized … and to be clear, we’ve seen people dragged from cars, beaten, gassed, attacked with crowd-control weapons, blinded, like back in my home state of California, left with broken ribs, run off the road, beaten, injured, disfigured and shot,” he said.

As living costs soar, tax relief shrinks for low-income Wisconsin residents

Edith Butler is dealing with a real-world math problem: Her housing costs keep rising while a tax credit intended to help keeps shrinking. 

The widow and retired nurse, 68, lives by herself in a two-bedroom Eau Claire home. She paid $9,000 in rent over the course of last year, eating up more than 60% of her Social Security paycheck — her primary source of income. Her utility costs are also expected to hike next year.

She received $708 last year from claiming a homestead tax credit, which is meant to help lower-income homeowners and renters recoup some property tax costs. That was down from the $900 credit she received five years ago after paying just $6,600 in rent. 

In the past, the homestead credit has paid to fill her propane tank for about three months during winter and offset some other costs. But it’s dwindling each year because the state rarely updates eligibility guidelines and credit calculations for inflation. Butler’s credit shrinks whenever the federal government increases her Social Security payment to account for the rising costs of living

She’s not alone. Statewide homestead credit claims dropped from an average of $523 per recipient in 2013 to $486 in 2025, with thousands fewer claimants as fewer people remained eligible.

“These things have never adjusted. But we’ve paid into these programs all our lives. I paid taxes for 50 years, (and) my Social Security is my benefit that I paid in,” Butler said. “You work hard and you pay into programs, and then when you need them in your older years like this, they’re not there for you.”

The Legislature has not substantially updated the homestead credit for 25 years, causing its value to erode. Recent Democratic proposals to update program guidelines have failed to gain Republican support.  

A tax credit’s history

By the 1960s, many in Wisconsin acknowledged the regressive nature of property taxes — that lower-income residents pay higher shares of their income than richer households do,  John Stark, then-Assistant Chief Counsel in the Legislative Reference Bureau, wrote in a 1991 history of property tax relief in Wisconsin. But the state Constitution’s “uniformity clause” restricted what type of tax relief lawmakers can enact. 

Against that backdrop, a State Commission on Aging in 1962 held hearings around the state in which older adults expressed concerns about health care and property taxes. The Legislature responded in 1963 with the homestead credit. Residents 65 and older could claim up to $225 (the equivalent of $2,380 today), with the precise calculation based on income, property taxes paid through ownership or rent.

The Legislature expanded eligibility over the years, notably in 1973, when it lowered the age minimum to 18. That dramatically boosted total claimants and payouts. By 1988, more than 250,000 people received a collective $100 million (roughly $270 million today) in credits.

The trend has since reversed. 

Fewer than 67,000 residents claimed a collective $32.6 million in credits last year — a precipitous plunge, Department of Revenue data show.

The program’s income cap today — $24,680 — has barely budged since 2000. The nearly identical cap of $24,500 in 2000 is the equivalent of $45,812 today when adjusted for inflation.

Meanwhile, the program’s “phaseout income” of $8,060, under which homeowners or renters can recoup the maximum 80% of property taxes paid, has increased by only $60 since the 1989 tax year.

Today’s maximum credit a household can claim ($1,168) is just $8 higher than the 1990 level.

Diane Hanson, Butler’s tax agent, said her clients are receiving smaller credits each year or becoming ineligible as inflation pushes wages or Social Security payments above the static income limit. 

Still, Hanson suspects many who remain eligible don’t realize it.

The homestead credit helped Hanson through her most challenging times. After learning about it at her local library, she claimed the credit for several years while raising her two children during a divorce, one of them with disabilities. 

After becoming a tax agent in 2019, she began to educate clients facing similar circumstances. They include Renata Braatz, who raises her 12-year-old son and spends about 30% of her monthly income on rent through the Section 8 voucher program. She claimed about $600 through the homestead program last year. She spent it on groceries and other expenses for her son.

“I never knew about it. I lived here for six years, and I just started doing it two years ago,” Braatz said. 

But asking questions paid off. 

“Renata was proactive, reaching out, phoning us, and asking if there could be any credits for her. I think that is more than some folks know to do,” Hanson said. “Before I was a tax professional, I myself didn’t know how much the federal earned income credit can help out parents.”

Democrats call for credit’s expansion 

Senate and Assembly Democrats earlier this year introduced identical bills to expand the homestead credit — allowing households earning up to $35,000 to claim it and indexing the maximum annual income, phaseout income and maximum credit to inflation. The proposal would have reduced state revenue by an estimated $36.7 million, $43 million and $48.8 million over the next three fiscal years.

Democratic Gov. Tony Evers also proposed a homestead credit expansion in his last two-year budget. 

Neither  proposal advanced in the Republican-controlled Legislature. 

Sen. Mark Spreitzer, D-Beloit, authored the Senate version of the bill with colleagues. His district borders Illinois, which offers a range of more generous homestead tax incentives. Several constituents who previously lived in Illinois asked him why Wisconsin doesn’t offer what Illinois does, inspiring the legislation.

The Wisconsin Constitution’s uniformity clause prohibits lawmakers from enacting Illinois-like tax exemptions for older adults or other low-income residents, Spreitzer said, but the credit offers a legal work-around.

“There’s not really another credit that takes the place of this,” he said. “That’s why the homestead credit is so important.”

Spreitzer said he plans to reintroduce an expansion bill, and he encourages residents to share their perspectives with their representatives.

“If we want to do something about affordability, this is a very direct thing we can do,” Spreitzer said. “We’re not creating a new credit here. This already exists. We’re just talking about increasing who qualifies and how much money they would get back, and that’s money that they would directly be able to get back on their taxes and then spend to put food on the plate for their families.”

Hanson sees a path for bipartisan support for an update. 

“The alternative is to see it dwindle,” Hanson said. “It hurts the segment of people that actually need it, the people who just don’t get much help anywhere. They’re still working hard to be independent.”

You can claim it by filing online or through mail within 4 years and 3 ½ months after the fiscal taxable year to which the claim relates. That means you can still file for a 2021 credit before April 15, 2026.

Transforming Student Ridership

Hundreds of thousands of students are on new routes to and from school this month.
While some school districts may still be tracking these numbers manually, many
transportation departments are implementing new technology to take the guesswork out of student ridership.

Luisa Brown is wearing two hats at Zillah School District in Washington, that of an accounts payable supervisor and transportation manager. When she started in the latter role in March 2020, and without a long background in student transportation, she leaned heavily on technology for all the assistance she could get.

Brown said that despite working at a smaller school district that transports approximately 662 students daily, she realized that tracking routing via spreadsheets was not an ideal solution. That’s when she first started using the Tyler Technologies routing software, implemented in December 2020. The student ridership verification
technology via RFID student cards was added in 2023.

A phased approach to implementing new technology was necessary from a budgetary standpoint, she noted, which also was essential for ensuring the technology is utilized correctly and benefitting the student transportation staff.

Tim Ammon, a consultant in the student transportation industry since 2001, said the “Holy Grail” of this kind of technology is the amount of intervention required.
Ammon explained that in his experience as a consultant and working in the business management of school bus technology (he recently served as VP and GM of passenger services for Zonar Systems and remains a strategic advisor), he sees two main uses of student ridership verification.

“The first is, in the event that something goes wrong, we can track back to where the kid got on and off the bus and at least have a starting point. So, emergency district management applications.”

In Brown’s case, integration was smooth, since she said she was already using Tyler’s routing software and Tyler Drive to connect with the RFID cards. But in Colorado, Denver Public Schools (DPS) ran into challenges as transportation prepared to roll out student ridership technology last month for the first time.

“Samsara has been a very willing and helpful partner in making sure all the components of our project roll-out smoothly and are operational internally,” said Tyler Maybee, director of operations for Denver’s transportation services, who said the district is creating an in-house student ridership technology solution with the GPS provider alongside a smaller technology company.

“We have another vendor that is more of a barrier than opportunistic and has prevented our innovation from raising the bar within their own technology. It has forced us to find many workarounds and begin to search for a better partner that has a similar vision to fully integrate transportation technology.”

With about 5,000 to 7,000 students being transported daily across Denver, Maybee said time will tell the success of the new project.

“But all signs point to a more knowledgeable and connected DPS community and a reduction in the number of calls our dispatchers receive regarding missing students and requests for bus information,” he said.

Keeping Data Secure
On the topic of data security for this type of technology, Ammon noted it’s crucial to have “procedural aspects in place to make sure that you know that information is
protected.” Easier said than done as it’s a process that can have an “enormous number of tentacles into it,” he added.

An Education Week article found that education was the fourth-most targeted sector during the first half of 2025, based on data collected by Comparitech.

“Schools are tempting targets for hackers because they have tons of sensitive data and have become more reliant than ever on digital tools,” the article stated. Amy McLaughlin, the project director for the Consortium for School Networking’s (CoSn) cybersecurity initiatives, was quoted saying that districts are aware of the security concerns but face challenges of funding and staff to ensure that data and cybersecurity issues are adequately addressed.

Brown said she keeps physical security on a tight lockdown as each tablet has a unique PIN that only she and the individual driver has access to.

Bill Westerman, Tyler’s director of integration solutions, confirmed that all Tyler Drive tablets are encrypted and that districts can choose how registration information is shown when student data is being inputted.

Maybee said the Denver IT team has a series of regulations in place to prevent student data from falling into the wrong hands and that vendors are required to sign a data privacy agreement “to make sure their systems meet the same level of security our network has to maintain adequate protections,” he continued. “We limited the amount of personal identifiable information on the ID virtual and physical ID cards to make sure even if a card was misplaced and then subsequently found that a student’s information is not at risk. This also includes encrypting the QR code so that a scan must be tied to our system to make any sense out of the resulting scan data.”

Edulog’s Lam-Nyugen Bull, who serves as the company’s chief experience officer, said the software company maintains SOC 2, Type 2 compliance and that “all data is encrypted at rest and in transit and we regularly undergo third-party penetration testing and evaluation of our overall security posture.”

As a certified risk manager, Ammon encouraged student transportation professionals to find resources or individuals that can assist with being able to “talk to your vendor intelligently about their data security procedures.”

Especially when integrating different vendors’ technology options into one transportation operation, he said that collaboration is crucial with increased risk of
malicious cybersecurity attacks.

“From a vendor perspective, it’s very likely that each district will have its own flavor of how it wants to deal with this, and so like as a vendor, I should know that,
right? Because I should be responding to what your requirements are as a customer, right? To assume that all 16,000 school districts in the country want exactly the same response in the event of it is, I think, a fallacy,” Ammon said. “There should be some collaboration between the district and the vendor in terms of, here’s our expectations around this, here’s the universe of what’s possible. How do we want to narrow that universe so that it fits whatever we’re doing?”

Evolving Technology
RFID cards, QR codes, barcodes and manual checklists are all ways that student ridership can be documented. Most industry experts agree that RFID cards can help keep tabs on the students on the bus without exposing their information, but what are the future possibilities when it comes to this technology?

Ammon noted that video camera facial recognition or biometric scans are trickier territory to navigate as those types of technology naturally raise a high level of privacy concerns with parents.

“There is no technology impediment today that would stop us from doing [options like biometric scanning],” said Zach Moren, Transfinder’s manager of sales enablement and engineering. “But schools need to consider a few things when looking at ridership solutions. What is the most cost effective? What is the most reliable to capture as close to 100 percent of riders as possible? And what technology can be easily adopted and utilized by bus drivers, students and the community? Based on those requirements I’m skeptical we will see a major change in technology anytime in the near future because RFID solves each of those challenges so effectively.”

Moren noted that Transfinder is developing a digital wallet card that students could access on their smartphones, “like they would a credit card or concert ticket,” which Moren said could address the issue of RFID cards being lost or damaged.

“As schools continue to prioritize student well-being, the evolution of ridership verification technology is set to move beyond isolated solutions and adopt a more holistic approach, intertwining safety and health measures with the core mission of ensuring every child’s secure passage to and from school,” said Edulog’s Nyugen-Bull
when discussing the future of this technology.

Brown noted that one Tyler software feature she found to be immensely helpful is the ability to run health reports to make sure drivers were aware of health information for the students on their routes, such as food allergies or other relevant factors such as anxiety. She said this information was historically kept in a folder or backpack on the bus, which was not the best way for drivers to quickly access the information and be aware of important student information or emergency contact details.

She also noted that Tyler is doing “an amazing job of making updates throughout the year, so that it’s not just a dead program and [it’s] improving every year,” she continued. “And I think they do an amazing job in getting the in-user’s input because they are creating something that they feel is going to work for everybody.

Because there [are] different circumstances in small districts versus large districts.”
Integration and collaboration continue to be important factor for companies and districts as they work together to keep student data secure and improve on the implementation of this technology to benefit not only the students but student transportation operational workings.
